The U.S. Department of State’s list was last updated October 2, 2026. The bond rule applies to certain otherwise eligible B-1/B-2 visa applicants whose passports are issued by a listed country. The $20,000 figure is the highest of three possible bond amounts—not an automatic deposit for every applicant.
Is India affected by the $20,000 U.S. visa-bond rule?
No. India does not appear on the Department of State’s list of countries subject to visa bonds, as last updated October 2, 2026. Indian passport holders should not submit a bond under this rule unless the Department of State changes the list and directs them to do so.
The requirement is based on the nationality shown on the passport, not the country where the applicant applies. It concerns applicants who are otherwise eligible for a B-1/B-2 visitor visa and whose passport was issued by a country on the list.
What does the $20,000 deposit mean?
For a covered applicant, a consular officer may require a bond of $10,000, $15,000, or $20,000. The officer determines the amount at the visa interview. The highest amount is not the standard amount for everyone, and paying a bond does not guarantee that a visa will be issued.

What should a covered applicant do?
- Attend the visa interview first. Do not pay a bond in advance. The consular officer will determine whether a bond is required and, if so, its amount.
- Follow the officer’s instructions. Submit DHS Form I-352 only after a consular officer directs you to do so. Use the direct Pay.gov link provided in those instructions; the Department of State warns applicants not to pay through other websites.
- Make sure the obligor is the payer. A third party may fund the bond, including someone outside the applicant’s home country, but the payer’s name must match the obligor named on Form I-352. The obligor is the person eligible for a refund if the bond terms are met.
- Pay in U.S. dollars. The obligor bears any exchange-rate fluctuations.
- Follow the travel and stay conditions. Bond holders must enter and depart through designated commercial air ports, including CBP preclearance locations. Charter air, general aviation, land, and sea ports are excluded.
When can the bond be returned?
The Department of State says a bond is returned automatically in the listed situations when the applicant complies with its terms. DHS uses its Arrival and Departure Information System to capture stay and departure information. A breach can result in forfeiture; DHS refers suspected breaches to USCIS for a determination.

Why does the rule exist, and can it change?
The Department of State describes the program as operating under INA Section 221(g)(3), established by a Final Rule issued August 3, 2026. It says the overstay rates used are B-1/B-2 rates from DHS’s Entry/Exit Overstay Report.
The country list is time-sensitive. Check the Department of State’s current “Countries Subject to Visa Bonds” page immediately before applying or taking any action, because its roster may change. The date above identifies the version of the list used here.
