Uttar Pradesh’s October 16, 2026 Rajya Sabha election has a reported working quota of 37 first-preference votes per seat, based on an effective Assembly strength of 397. On that October 2 estimate, the NDA’s baseline points to seven seats and the Samajwadi Party (SP), supported by Congress, to two; the tenth seat depends on the final candidate slate and how MLAs vote. The three scenarios being discussed are BJP eight–SP two, BJP seven–SP three, or a contested BJP eight–SP three lineup. None is a confirmed deal or result.

What is being elected, and when?

Ten Uttar Pradesh Rajya Sabha seats are in this round. Nine are regular vacancies because their incumbents’ terms end on November 25, 2026. The tenth seat became vacant when Dinesh Sharma resigned on September 11 after his appointment as Lieutenant Governor of the Andaman and Nicobar Islands. Polling is scheduled for October 16, alongside one Rajya Sabha poll in Uttarakhand. News On AIR reported October 6 as the last date for nominations; the final candidate list determines which scenarios remain possible. News On AIR

How many seats can the BJP-led side win?

The latest cited arithmetic, reported by Hindustan Times on October 2, puts the NDA baseline at seven seats and SP with Congress at two. That leaves one seat as the potential contest. The report estimates BJP at roughly 255–257 MLAs and its core NDA partners at 288–289 combined, with the broader alliance tally potentially as high as 292 if some unaffiliated legislators support it. These are reported estimates, not certified commitments from individual MLAs. Hindustan Times

The Election Commission’s terms table lists the Uttar Pradesh Assembly’s full size as 403 seats. That is not the same as the effective strength used in Hindustan Times’ October 2 quota calculation: vacancies reduce the number of participating Assembly members and affect the votes needed for a seat. Why do reports cite both 36 and 37 votes?

The figures come from different snapshots and should not be combined. Hindustan Times’ October 2 report uses an effective strength of 397 and a quota of 37 first-preference votes. An earlier Indian Express report published September 22–23 listed BJP at 256 MLAs, SP at 101, BJP allies at 36 more and two Jansatta Dal (Loktantrik) MLAs supporting the NDA. It used 36 MLAs per seat as shorthand and said the BJP-led side could claim eight seats while SP with Congress could secure two. The Indian Express

The later report’s 37 is the newest working estimate here, not an independently recalculated figure from a final poll-day roll. Vacancies and the effective voting strength matter, so the earlier 36 and later 37 should not be treated as interchangeable.

The three scenarios

Scenario Candidate slate What it would mean
1. Consensus arrangement BJP eight; SP two Could be uncontested if exactly ten candidates contest ten seats. The October 2 report says BJP would need support beyond its core tally to reach eight; the arrangement is not confirmed.
2. SP tries for a third BJP seven; SP three SP could seek an additional seat ahead of the 2027 Assembly election. The report names Dhanraj Parimal Nathwani as an unexpected variable. The outcome depends on political choices and support not guaranteed by the baseline arithmetic.
3. Both sides push for the marginal seat BJP eight; SP three Eleven candidates would contest ten seats, making the poll contested. The decisive uncertainty would include alliance cohesion, unaffiliated MLAs, abstentions and ballot management; neither side can be said to have secured the marginal seat before voting and counting.

These are conditional configurations described in the October 2 Hindustan Times analysis, not a final slate or forecast of a declared result. In the first two scenarios, a no-contest arrangement is possible only if the number of candidates does not exceed the ten vacancies. Hindustan Times

How the Rajya Sabha vote works

MLAs do not simply cast a single vote in a first-past-the-post contest. The Election Commission says Rajya Sabha members representing states are elected by elected members of the state Legislative Assemblies through proportional representation by the single transferable vote. MLAs mark preferences, and later preferences can be transferred during counting if no candidate reaches the quota. Election Commission of India: Rajya Sabha elections FAQ

The ECI FAQ says Rule 39AA is intended for an MLA to show a marked ballot only to the authorised agent of that MLA’s own party, not an agent of another party. It also states that voting in a particular manner does not disqualify an MLA from Assembly membership. Parties’ concerns about discipline and ballot oversight are relevant to the arithmetic, but the rule is not evidence of cross-voting in this election. Why is cross-voting a concern?

The concern is prospective: if eleven candidates contest ten seats, the marginal contest could make party discipline, coordination between SP and Congress, support from NDA partners or unaffiliated MLAs, and abstentions consequential. Hindustan Times cited the 2024 Uttar Pradesh Rajya Sabha poll as precedent, naming SP MLAs it said had aligned with the BJP amid cross-voting allegations. That is historical context reported by the outlet, not proof of a similar event in 2026. The sources cited here do not establish that cross-voting has occurred in the 2026 poll. Hindustan Times

What to watch as the vote approaches

  • The final candidate list: whether parties field the numbers assumed in any of the three scenarios will decide whether the poll is uncontested or contested.
  • Support beyond stated party tallies: the October 2 figures include estimates for NDA partners and possible support from unaffiliated MLAs, not confirmed vote commitments.
  • Coordination and ballot management: in an eleven-candidate contest, the reported analysis identifies alliance cohesion, SP–Congress coordination, abstentions and possible cross-voting as uncertainties—not established events.
