In the United States, employees at a video game studio covered by the National Labor Relations Act (NLRA) can organize with coworkers, form or join a union, support an organizing drive, or choose not to participate. The usual paths are an election conducted by the National Labor Relations Board (NLRB) or voluntary recognition by the employer after the union demonstrates majority support. At least 30% support is generally needed to petition for an NLRB election, but the union wins that election only when a majority of votes cast favor representation.

Coverage and procedure depend on facts such as whether a person is legally an employee, whether the studio falls under federal jurisdiction, which jobs belong in the bargaining unit, and whether any statutory exclusions or election bars apply. This is a federal-law overview, not a determination about a particular studio or worker.

What unionizing means at a game studio

A union is the employees’ representative for bargaining with the employer over wages and other terms and conditions of employment. The NLRB summarizes the core protection this way: “Employees covered by the National Labor Relations Act are afforded certain rights to join together to improve their wages and working conditions, with or without a union.”

Those rights can apply before any union is formally recognized. Employees may act together about pay, scheduling, leave, health and safety, benefits, workload, workplace policies, or other issues affecting the group. This kind of concerted activity can be protected even when no union is involved.

The NLRA does not automatically cover every person who works around a game. Supervisors, independent contractors, some managers, guards, and confidential employees may be excluded under the law. Public-sector workers and people covered by different labor statutes can face different rules. A job title alone does not always settle the question; actual authority, duties, employment relationship, and the employer’s jurisdiction matter.

For a case-specific answer, contact the NLRB or a qualified labor attorney. The agency’s employee-rights guidance is available at NLRB Employee Rights.

Rights during an organizing drive

Activities employees may undertake

  • Discuss unionization, pay, schedules, benefits, safety, or other workplace concerns with coworkers.
  • Ask coworkers to sign union authorization cards.
  • Distribute union literature where the employer’s neutral rules allow it.
  • Form, join, or assist a union.
  • Choose not to join, support, or assist a union.
  • Act together for mutual aid or protection without a union.

These protections concern employee conduct, not an unlimited right to use every company resource. The NLRB explains that working time is for work. An employer may enforce a nondiscriminatory rule against solicitation during working time and may restrict distribution during working time or in working areas, provided it does not single out union activity for worse treatment. Exact application can depend on whether communication occurs in a break room, chat channel, email system, or another medium and on the wording and enforcement of the rule.

Employer conduct that can cross the line

An employer may not threaten, coerce, spy on, or retaliate against covered employees because of protected organizing or concerted activity. NLRB examples include threatening job loss or loss of benefits, threatening to close the studio, coercively questioning workers about their support, promising new benefits to discourage support, or monitoring organizing efforts in a coercive way. Whether a particular incident is unlawful depends on the facts, context, and current Board law; preserve the evidence rather than assuming the legal conclusion.

Lawful, neutral workplace rules remain possible. A studio can generally apply the same safety, confidentiality, anti-harassment, access-control, and work-time rules it applies to other subjects. A rule that appears neutral on paper but is enforced only against union communications can create a different legal issue.

How employees start the process

1. Talk with coworkers and identify shared issues

Organizers commonly begin by listening to coworkers in the proposed unit and documenting common concerns. Keep discussions factual and respectful. Do not access confidential personnel files, source code, customer data, or security systems to build support. Organizing rights do not authorize misconduct or disclosure of protected information.

2. Select a union or organize with employee support

Employees may seek assistance from an established labor organization or pursue recognition through an employee organizing committee. A union typically explains authorization cards, possible unit definitions, and the filing process. Signing a card can indicate support for representation, but the legal effect of a card depends on the route being used and the language on the card.

3. Choose election or voluntary recognition

The two principal routes have different support standards and procedures.

Route Support needed to begin How representation is established Important procedural points
NLRB election At least 30% of employees in the proposed unit must support filing a petition. This is a petition threshold, not a vote to unionize. The union is certified when a majority of votes cast in the secret-ballot election favor it. The NLRB investigates the case, resolves unit and eligibility issues, and sets election conditions. Objections or alleged interference can affect the result and timetable.
Voluntary recognition Evidence that a majority of employees want representation, commonly signed authorization cards. The employer recognizes the union without an NLRB election. The NLRB describes voluntary recognition as another route when majority support is shown. The employer and union then have a bargaining relationship.

The NLRB’s election overview explains filing and pre-election issues at Conduct Elections. The agency’s rights page also describes voluntary recognition and employee protections at Your Right to Form a Union.

4. File an election petition, if that is the chosen route

A union or employees can file an NLRB petition after obtaining the required showing of interest. The regional office examines whether the employer is subject to the NLRA, whether the proposed unit is appropriate, whether a recent election or existing contract creates a bar, and which employees are eligible. The 30% showing starts the case; it does not guarantee that an election will be ordered or that the union will win.

5. Resolve the bargaining unit and election conditions

The proposed unit identifies the employees who will vote and, if the union prevails, be represented together. Relevant factors can include job duties, full-time or regular part-time status, worksite or reporting relationship, and statutory exclusions. The parties may agree on the election date, place, ballot wording, unit, and voter eligibility. If they cannot agree, an NLRB regional director can hold a hearing and issue an order setting the conditions.

6. Vote by secret ballot

The NLRB conducts a secret-ballot election. Certification requires a majority of votes cast to favor the union; abstentions and nonvoters do not count as votes for representation. The agency can investigate objections and allegations that conduct interfered with employees’ free choice. Because the issues and objections differ from case to case, the NLRB does not promise one fixed duration for every election.

Who belongs in the bargaining unit?

A bargaining unit is not necessarily an entire studio. It is the group of employees whose interests and working conditions are sufficiently related for collective bargaining. A unit might be defined by a combination of roles, employment status, and location or reporting relationship. Managers, supervisors, guards, confidential employees, and other excluded categories may be left out.

The proposed unit has practical consequences. Only eligible employees in that unit vote, and the resulting contract generally covers that represented group. Employees outside it do not automatically receive a vote or representation merely because they work for the same company.

A 2026 game-industry example: Wizards of the Coast’s MTGA unit

An NLRB docket provides a concrete illustration without creating a universal template. In Wizards of the Coast LLC, Case 19-RC-385755, the agency recorded certification of the Communications Workers of America (CWA) as representative on July 1, 2026, for a Magic: The Gathering Arena (MTGA) unit.

The docket lists managers, supervisors, guards, and confidential employees among exclusions. This example shows how a unit can be written around particular roles, employment status, and a reporting location. It does not mean that every studio must use the same list, that every technology worker is eligible, or that every Wizards workplace has the same unit. Review the case record at NLRB Case 19-RC-385755.

What happens after recognition or certification?

The employer and union must bargain

After voluntary recognition or NLRB certification, the employer and union become bargaining representatives for the unit. They must meet and bargain in good faith over wages and other terms and conditions of employment. Subjects can include hours, leave, health and safety, insurance, benefits, and workplace policies. The NLRB’s collective-bargaining resources are at GC Collective Bargaining Resources.

Good-faith bargaining is not a guaranteed result

The duty to bargain requires genuine negotiations, not acceptance of every proposal. Neither side is guaranteed a particular wage, benefit, remote-work rule, staffing level, or other outcome. The eventual agreement depends on bargaining proposals, the parties’ lawful positions, and the negotiations. Certification also does not instantly rewrite every workplace policy; changes normally arise through bargaining or other lawful processes.

Keep records and use the right forum

Employees who believe a studio interfered with protected rights should preserve dates, messages, policy versions, witness names, and the exact words or conduct involved. The NLRB can explain filing options and jurisdiction. A labor attorney can assess deadlines, remedies, employee classification, state-law issues, and facts that general guidance cannot resolve. Do not assume that a complaint automatically pauses an election or bargaining deadline.

Common decision points for a studio organizing drive

  • Unsure whether you are covered: examine actual duties and employment status, not only the title shown in a directory.
  • Unsure whether to seek an election: compare the transparency of a secret-ballot vote with the evidence and employer cooperation needed for voluntary recognition.
  • Disagreement over who votes: focus on job duties, regular full-time or part-time status, location, reporting lines, and statutory exclusions.
  • Concern about online discussions: check whether the same communication and solicitation rules apply to nonunion subjects and whether the discussion occurs during work time.
  • Concern about retaliation: document the conduct promptly and seek advice from the NLRB or qualified counsel rather than confronting coworkers or managers with unsupported legal accusations.

Key takeaway

For covered U.S. game-studio employees, organizing is a protected collective process: build support, define the appropriate unit, choose election or voluntary recognition, and bargain after recognition. The 30% figure opens an NLRB election petition; it is not the winning vote. A majority of votes cast is required for certification, and recognition creates a duty to bargain without promising any particular contract terms. Because coverage, unit boundaries, employer conduct, and deadlines are fact-specific, use the NLRB or qualified labor counsel for an individual situation.
