Yes, you may be able to receive unemployment benefits after getting severance, but severance does not have one uniform effect across the United States. Your state’s unemployment insurance (UI) rules and the way your former employer pays severance can affect eligibility, the benefit amount, or when payments begin. Report the payment accurately and ask the unemployment agency in the state where you worked how your specific arrangement is treated.

How unemployment benefits and severance differ

Severance pay is money an employer provides under an agreement, policy, or plan. Unemployment insurance is a state-administered program for eligible workers who are unemployed through no fault of their own and meet other state requirements. One payment comes from an employer arrangement; the other depends on a state benefits claim.

When might money be paid? As stated in the severance terms, such as a lump sum or payments over time. According to the state’s claim process and rules. The effect of severance on timing is state-specific.
Federal income tax treatment Generally taxable. Generally taxable; recipients may request federal withholding or make estimated payments.

Can you get unemployment if you receive severance?

Possibly. A layoff may be a lack-of-work separation, but that alone does not guarantee benefits: you still need to meet your state’s eligibility requirements. Separately, states may treat severance differently depending on the payment arrangement. Do not assume that a lump sum, salary continuation, or another form of severance will have the same effect everywhere.

The U.S. Department of Labor describes unemployment insurance as a federal-state program and says eligible workers must also meet requirements under state law. Its general guidance does not establish one nationwide rule for whether severance delays benefits or changes a weekly benefit amount. Check with your state agency about your particular payment terms before relying on a start date or benefit estimate.

What to do after a layoff

  1. Read your severance documents. Check whether the offer provides a lump sum, salary continuation, or another arrangement. Note the payment dates and any conditions. Severance generally depends on the applicable agreement or plan; the federal baseline is described by the U.S. Department of Labor.
  2. Find the correct unemployment agency. In the usual case, file in the state where you worked. If you worked across state lines, worked remotely, or now live in a different state, ask an agency for filing instructions. USAGov’s unemployment benefits page, updated March 28, 2025, directs applicants to their state program.
  3. File promptly under that state’s current instructions. State rules determine eligibility and how severance may affect the claim. Do not wait for a general nationwide answer about severance: ask the agency handling your claim.
  4. Report severance accurately. Answer the claim’s questions about payments truthfully. Ask the state agency whether your specific arrangement affects the claim’s start date, weekly benefit calculation, or reporting obligations.
  5. Check ongoing requirements. Follow the agency’s instructions for claim certifications and eligibility. Many states require claimants to look for work; confirm the rules that apply to your claim with the agency or USAGov.

How to find the right state office

The U.S. Department of Labor’s unemployment insurance guidance directs workers to their state unemployment insurance office. USAGov also provides a state-by-state route through its unemployment benefits page. Use the agency’s current instructions, especially if your work location, residence, or employer crosses state borders.

Plan for federal taxes on both payments

Severance pay and unemployment compensation are generally subject to federal income tax, according to the IRS. The tax handling can differ: unemployment recipients can request federal income tax withholding using Form W-4V or make estimated tax payments. The IRS explains withholding and reporting unemployment compensation on Topic no. 418; its guidance on what to do if you lose your job also discusses severance and unemployment compensation. Check current IRS and state tax instructions for the tax year in which you receive the payments.
