UK Video Doorbells and CCTV: The Privacy Rules for Homeowners

In the UK, a home video doorbell or security camera is generally outside data protection law when it records only your private domestic property. If it captures identifiable people beyond your boundary—on a pavement, a shared landing or a neighbour’s property—data protection duties apply. That does not automatically make the recording unlawful, but you need a justified purpose and must minimise the intrusion.

Does my video doorbell record my neighbour’s property?

Check the camera’s actual field of view, including what it captures when motion detection activates or the camera streams live. The boundary matters more than whether the device is called a doorbell, CCTV camera or security camera. The ICO’s home CCTV guidance and GOV.UK’s domestic CCTV guidance say data protection law applies when a system records identifiable people outside private domestic property, including in public or communal areas.

Capturing a small part of a neighbouring property or public area does not, by itself, establish that you have committed an offence. It does mean you should be able to explain why that capture is needed and show that the camera is not recording more than necessary. The ICO says a legitimate interest such as protecting your home may justify CCTV, but you must be able to demonstrate that this interest outweighs the privacy intrusion.

Keep the view as narrow as possible

  • Point the camera at your own entrance or property rather than a neighbour’s windows, garden or door.
  • Use privacy zones, masking or filters to block areas that do not need to be recorded.
  • Consider whether lighting or another less intrusive security measure would meet the need.
  • Recheck the view and settings periodically, especially after moving the camera or changing its software settings.

What should I do if the camera captures beyond my property?

Once the system captures identifiable people beyond your boundary, treat the footage as personal information and manage it accordingly. The rules do not set a universal number of days for keeping home CCTV: retention should be limited to what is necessary for the security purpose.

Set up the system responsibly

  1. Define the purpose. Decide what security concern the camera addresses and what area or images are genuinely needed.
  2. Minimise capture. Reposition the camera or use privacy masking to exclude neighbouring, public and shared spaces where possible.
  3. Make recording clear. Put up an appropriate notice where recording takes place and tell neighbours where appropriate. A notice is one transparency measure; it does not replace the other responsibilities.
  4. Limit access and secure footage. Restrict who can view recordings, secure the device and associated app, and keep software up to date.
  5. Delete footage regularly. Use a retention period tied to the security need, or automatic deletion where available. Keep relevant footage only as long as necessary for that purpose.
  6. Handle people’s requests. Be prepared to respond to a person asking for footage in which they appear or can be heard, or asking you to erase it or stop using it.

The ICO’s surveillance principles guidance explains that UK GDPR and the Data Protection Act do not prescribe a specific minimum or maximum retention period. The reason for recording determines how long keeping footage is necessary.

Do I need my neighbour’s consent or a CCTV sign?

Consent is not usually the test for home CCTV. The ICO says consent will rarely be required, but if your camera records beyond your property you must be able to show that your legitimate interest outweighs the effect on other people’s privacy. You should give appropriate notice when recording takes place and make the system’s purpose clear.

If someone objects, consider what they say and whether you can reduce the capture—for example, by changing the angle or applying a privacy mask. An objection does not automatically require you to move the camera, but the ICO says you should have a strong reason to continue collecting that person’s information after they object.

The domestic CCTV guidance says the Surveillance Camera Code is not a legal requirement for household operators. The Code applies as a statutory matter to relevant authorities’ overt systems in public places in England and Wales; domestic operators are encouraged, rather than required, to adopt it voluntarily.

Can I record audio on a doorbell camera?

Audio is a separate and often more intrusive feature. The ICO says audio recording should generally be off by default unless you can evidence a specific need. Recording private or face-to-face conversations is highly intrusive and unlikely to be justified in most circumstances. Ask whether video alone meets the security purpose, and make it clear to people if audio recording is enabled.

Some smart doorbells can stream live video, save or edit footage, share recordings or use facial recognition. The ICO’s smart doorbells guidance is written for commercial use, not as a household checklist. It notes that facial recognition used to uniquely identify people is likely to involve special-category data and needs additional protections.

Can I post doorbell footage on social media?

Do not upload identifiable clips simply because your camera recorded them. GOV.UK says recordings should be used for the purpose for which the system was installed and specifically warns that social-media sharing is not an appropriate use. Preserve relevant footage for its security purpose, but avoid public identification, speculation or accusations based on a short or partial clip.

Can I ask my neighbour for CCTV footage?

Yes. If you appear in or can be heard in a recording, you can ask the owner what the camera captures and why, request a copy of relevant footage, object to its use or ask for erasure. The ICO suggests asking to see a sample recording and whether privacy filters are being used; a direct conversation may resolve a misunderstanding. In most cases, the owner should respond within one calendar month.

If the owner continues recording after you object, the ICO says they should have a very strong reason. If you remain dissatisfied, you can raise the matter with the ICO. For an ongoing neighbour dispute, the ICO suggests trying informal resolution, contacting a landlord or housing officer where applicable, and considering mediation; legal action is a last resort. CCTV use alone is unlikely to amount to harassment without other misconduct.

Has the law or official guidance changed recently?

The Data (Use and Access) Act 2025 received Royal Assent on 19 June 2025. GOV.UK says most of its data protection and privacy provisions came into force on 5 February 2026, and the ICO says relevant provisions are now in force. The ICO is updating its guidance following the Act, so check its current pages if you need to act on a specific dispute or system.

GOV.UK’s domestic CCTV guidance was updated on 21 May 2026. Its central practical message remains that a domestic CCTV or video surveillance system should be operated responsibly and with respect for other people’s privacy.
