In the UK, a home CCTV camera can capture a public area or neighbouring property, but the boundary matters: if it records people beyond your private domestic property, UK GDPR and the Data Protection Act 2018 apply, according to the government’s domestic CCTV guidance, updated 21 May 2026. That does not make every such recording automatically unlawful. You must operate the system responsibly, minimise unnecessary intrusion and meet the applicable data-protection duties. Rules differ by country, so this article covers the UK and identifies Ireland and Switzerland only as separate examples.

When does a home camera bring data-protection rules into scope?

The UK government guidance covers CCTV and similar video surveillance, including video-equipped doorbells. It says UK GDPR and the Data Protection Act 2018 apply when a household system captures people outside the boundary of private domestic property. Examples include a neighbour’s home or garden, shared spaces, and public areas such as a pavement or road. The Information Commissioner’s Office (ICO) regulates those data-protection laws.

The trigger is capturing people beyond the private boundary; it is not a blanket ban on a camera that happens to include part of a street. The operator must use the system responsibly and respect other people’s privacy. As the government guidance puts it: “A domestic CCTV or video surveillance system needs to be operated in a responsible way that respects the privacy of others.”

Can my neighbour’s CCTV record my garden, or can I point a camera at the street?

Under the UK guidance, either view may bring data-protection obligations into scope if the camera captures people beyond the operator’s private domestic property. The guidance does not say that recording a neighbour’s garden or any part of a public area is automatically unlawful. Whether the setup is responsible depends on its purpose, what it captures and how the footage is handled.

A camera aimed at your own entrance may incidentally include a small part of a pavement. That is different in practical terms from a view that unnecessarily takes in a neighbour’s private garden. The guidance asks operators to consider what the camera needs to see and to reduce intrusion where its view may include neighbouring property, pavements or other areas. It does not establish a universal permitted viewing angle or a fixed distance from a boundary.

How to set up household CCTV with less impact on privacy

  1. Decide whether recording is needed. Consider why you need CCTV and whether another measure, such as improved lighting, could meet the security need.
  2. Limit the view to what serves that purpose. Position the camera to focus on the part of your property that needs protection. If its view may include a neighbour’s property, pavement or other area, consider privacy filters or blockers to obscure those areas.
  3. Consider recording schedules and audio separately. Ask whether continuous recording is necessary and whether the system needs to record sound. The government guidance expressly treats audio as a question to consider; a video security need does not by itself establish a need to capture conversations.
  4. Be transparent. The guidance recommends informing neighbours and putting up a notice that recording is taking place. A notice does not, by itself, make an intrusive setup responsible or satisfy every applicable duty.
  5. Check the system from time to time. Keep date and time settings accurate, and periodically review whether the system is still needed and positioned to limit intrusion.

A feature described as “privacy zones” or a privacy filter may help mask areas outside the intended view, but the feature alone cannot establish compliance. Check what the particular camera actually masks; the UK guidance supports considering privacy filters, not any model-specific claim about how a product processes or stores video.

How to handle footage once the camera is operating

  • Keep to the stated purpose. Use recordings for the reason the system was installed, rather than treating captured footage as available for unrelated uses.
  • Restrict access and secure the recordings. The operator is responsible for the installation and recorded information. Limit access to people who need it and keep the footage secure.
  • Delete footage when it is no longer needed. The UK household guidance does not prescribe one retention period for every home system. Keep recordings only as long as necessary for the purpose; do not treat a particular number of days as a universal rule.
  • Deal appropriately with requests from people recorded. The domestic guidance specifically refers to responding appropriately to subject access requests. What must be provided depends on the request and the applicable rules.

Household cameras, business CCTV and public-authority systems are not interchangeable

UK business CCTV has separate government guidance. It says a business must register its details with the ICO and pay a data-protection fee unless exempt; inform people they may be recorded, usually using clearly visible and readable signs; control access to footage; and use the system for its intended purpose. It also says a person can ask for images of themselves and that footage is usually provided free within one calendar month. These are business-facing instructions, so do not assume every detail applies to a domestic operator without checking the household guidance and the circumstances.

The Surveillance Camera Code of Practice is also distinct. The domestic CCTV guidance says the code applies to overt systems operated by relevant authorities in public places in England and Wales. The Biometrics and Surveillance Camera Commissioner encourages household operators to adopt the code voluntarily; it does not directly govern every home camera.

How the examples in other countries differ

Jurisdiction What the cited authority says Source and date
United Kingdom When household CCTV captures people beyond the private domestic boundary, including in neighbouring homes or gardens, shared spaces or public areas, UK GDPR and the Data Protection Act 2018 apply. The guidance calls for responsible use and privacy-conscious operation. UK government / Biometrics and Surveillance Camera Commissioner, domestic CCTV guidance, updated 21 May 2026.
Ireland The Data Protection Commission says a householder whose system captures images or sounds outside the property perimeter, such as neighbouring homes or gardens, public footpaths or streets, cannot use the household exemption and must comply with data-protection obligations. It identifies lawful basis, transparency or signage, limited retention, security, and access or erasure requests as relevant matters. Data Protection Commission (Ireland), “Domestic CCTV,” 14 January 2021.
Switzerland The federal data-protection authority says private video surveillance of identifiable people is governed by the Federal Act on Data Protection and advises limiting the recording area to the protected object. It also identifies transparency and privacy concerns. Federal Data Protection and Information Commissioner (Switzerland), “Video Surveillance by Private Individuals,” accessed 4 October 2026.

These are jurisdiction-specific examples, not a common rule for every country. If the camera is outside the UK, check the current law and guidance from the relevant local regulator before deciding what to record or how to respond to a complaint.
