U.S. Announces PERM Suspensions for Microsoft, Adobe and Six Other Employers

On October 8, 2026, Vice President JD Vance and Labor Secretary Keith Sonderling announced suspensions from the Department of Labor’s Permanent Labor Certification program, or PERM, involving Microsoft, Adobe and six other employers. Officials cited alleged fraud or abuse; the reports available that day did not establish a final finding of wrongdoing against any named company. The reported action targets a step used in many employer-sponsored green-card cases—not the H-1B visa program itself.

Which employers were named, and what was alleged?

Same-day reports named Microsoft, Adobe, Cognizant, Infosys, Tata Consultancy Services, Wipro, HCL and Capgemini. The administration described the suspensions as a response to alleged fraud or abuse and investigations. Those are allegations, not a reported final adjudication that the companies committed fraud.

The Associated Press reported that Vance criticized Microsoft’s use of H-1B visas while referring to layoffs and counts of H-1B approvals and green cards. Those figures were attributed to Vance in the AP account; they are not independently established here. Microsoft’s reported response was that most of its H-1B filings in the prior fiscal year were for current employees. Reports differed in how they described the response, so that characterization should be treated as the company’s position, not a verified finding.

What is PERM, and how does it fit into a green-card case?

PERM is the Department of Labor’s permanent labor-certification process. It is a step in many employment-based permanent-residency cases, not the green card itself and not a visa category. In most cases, an employer must obtain DOL certification before submitting an immigrant petition to U.S. Citizenship and Immigration Services (USCIS). PERM is not a universal requirement for every green-card category.

DOL describes the certification test as whether there are enough U.S. workers able, willing, qualified and available for the job in the intended employment area, and whether employing the foreign worker would adversely affect the wages and working conditions of similarly employed U.S. workers. The employer must obtain a prevailing-wage determination before filing. The Department of Labor’s Permanent Labor Certification (PERM) program page explains the process.

Does this mean H-1B visas are suspended?

No such broader action is established by the reports described here. They say the announced suspensions concern PERM. H-1B is a temporary work-visa program; PERM is a labor-certification step used in many employment-based green-card cases. A restriction involving PERM should not be described as ending or suspending the H-1B program.

That distinction does not answer what happens to any particular worker’s H-1B status or immigration case. The information available in same-day reporting does not establish that an individual’s temporary work authorization changes because of the PERM announcement.

What happens to pending or existing green-card cases?

The available reports do not specify how the suspensions affect pending PERM applications, certifications already issued, or later stages of a case. Nor do they establish the suspensions’ full legal scope or duration. Those details require a written agency order or reliable subsequent agency or company guidance. Without that information, it is not possible to infer a case outcome from the headline alone.

  • If your employer is named, ask its immigration team or your immigration attorney whether the announcement applies to your specific filing and what written guidance they have received.
  • Do not assume that a pending case has been denied, that an existing approval has been revoked, or that your H-1B status has changed based only on the announcement.
  • Before making a decision about work, travel or a filing deadline, get advice based on your individual case from qualified immigration counsel or authoritative agency guidance.

What is known—and what remains unresolved?

  • Reported: On October 8, 2026, administration officials announced PERM suspensions involving eight employers: Microsoft, Adobe, Cognizant, Infosys, Tata Consultancy Services, Wipro, HCL and Capgemini.
  • Alleged, not established as a final finding: Officials cited fraud or abuse as the reason for the action.
  • Clear from the program’s role: PERM is a DOL labor-certification step used in most, but not all, employer-sponsored employment-based green-card cases; it is distinct from the H-1B temporary visa program.
  • Unresolved in the information available as of October 8: The exact legal scope and duration of the suspensions, and their effect on pending applications, existing certifications and individual cases.

The Associated Press, Axios Local/Seattle, TechCrunch and Axios reported on the announcement on October 8, 2026. The Department of Labor’s PERM program page describes the ordinary certification process; the reports cited here do not provide a written order detailing the suspensions’ case-by-case effects.
