The proposed 250-foot arch at Memorial Circle has not received final approval from the National Capital Planning Commission, and courts have imposed limits on construction-related activity while lawsuits proceed. Opponents challenge the administration’s authority to build it and its environmental review; concerns about possible military uses are tied to President Trump’s reported announcement, not to confirmed final design specifications.
What is proposed, and where would the arch stand?
The proposal is for a 250-foot arch, measured from its base to the top of its statuary, at Memorial Circle on Columbia Island, near the west end of Arlington Memorial Bridge. The administration’s stated aims are to celebrate Americans’ achievements, inspire patriotism and love of country, and beautify the capital, according to the National Capital Planning Commission (NCPC).

On July 9, 2026, the NCPC recorded preliminary approval of the site and building plans with comments. That action moved the proposal to another stage of review; it was not final NCPC action or, by itself, construction authorization. Commissioners had not resolved whether the Height of Buildings Act applies to the federal government and requested a justification for the proposed height before final action.
Why is the arch facing legal challenges?
There are two separate lawsuits, with different plaintiffs and claims. In Lemmon v. Trump, three veterans and an architectural historian argue that Congress must expressly authorize a permanent commemorative structure at this site. Arlington County’s separate case focuses on the pace of the project and the adequacy of environmental review. The allegations in either lawsuit should not be treated as court findings.

| Case | What the plaintiffs argue | Status and response |
|---|---|---|
| Lemmon v. Trump | The plaintiffs’ March 5, 2026 filing argues that the Commemorative Works Act (CWA) and 40 U.S.C. § 8106 require congressional authorization for the arch and compliance with the CWA. | A September 4, 2026 court order imposes notice and construction-related restrictions while the case proceeds. The order is not a final ruling on whether Congress must authorize the arch. |
| Arlington County’s case | Filed in the Eastern District of Virginia on October 8, 2026, the county’s suit alleges the project could reach ground-disturbing construction before full environmental review. The county seeks compliance with the National Environmental Policy Act (NEPA) and proper analysis and testing. | County Board Chair Matt de Ferranti said the county’s concerns about local impacts had been ignored. White House spokesman Davis Ingle said the administration had complied with legal requirements and called the lawsuit meritless. These are the parties’ positions, not findings in the case. |
What does the Commemorative Works Act require?
The plaintiffs’ claim that Congress must authorize this arch is contested; it is distinct from the CWA’s agency-review process. The NCPC says CWA section 8905 gives the NCPC and the Commission of Fine Arts a role in reviewing and approving the site and design of a commemorative work on land under National Park Service or General Services Administration jurisdiction in Washington, DC, and its environs. The plaintiffs’ filing also points to the act’s purposes, including protecting the L’Enfant and McMillan plans, public use of open space, and appropriate design and location for future commemorative works.
What has the court ordered about construction?
The September 4 order by Judge Tanya S. Chutkan requires defendants to give the court 48 hours’ notice before activity at Memorial Circle, except for limited on-site archaeological information-gathering. It also says that construction or demolition in preparation for construction before the National Park Service issues final agency action authorizing construction, or without 14 days’ notice, would violate the order and a prior consent order. This is a procedural restriction during the litigation, not a decision that the arch is lawful or unlawful.

What objections have been raised about the site and design?
Critics cited in Associated Press reporting have objected to the arch’s scale, potential effects on the skyline and historic views, safety in a busy area, and the project’s legal authority. One specific concern is the view between the Lincoln Memorial and Arlington House at Arlington National Cemetery, which critics regard as a symbol of post-Civil War reconciliation.

The commission’s records identify outstanding issues that include height justification, traffic and transportation, pedestrian access, parking, loading and pickup/drop-off arrangements, safety or navigational lighting, and the final choice of granite cladding. NCPC also called for coordination with the Federal Highway Administration and other agencies. AP reported that commissioners raised concerns about height, lighting, stormwater, traffic, parking, and visitor management; it said the commission had received 1,700 public comments, most opposing the arch.

Could the arch be used for military purposes?
Associated Press reported on October 7, 2026, that Trump said he had agreed, at the military’s request, to convert the planned arch into a “top grade Military Complex.” The NCPC project information described here does not establish what that phrase would mean in final specifications. In particular, it does not confirm that drones, snipers, ammunition, or other military equipment would be installed or stored there.
Sara Nelson, president of the Association of Flight Attendants-CWA, criticized the possibility of military activity near the approach to Ronald Reagan Washington National Airport. AP quoted her saying: “DCA is already stretched to its limit, we do not need an obstacle taking up space in our flight path. Nor should commercial aviation have to dodge military drones, missiles or snipers while attempting to take off or land at Washington National Airport. Safety first always.” Those are her concerns, not evidence that such features have been approved or that a particular aviation risk has been measured.

Would the arch affect flights into Reagan National Airport?
Before Trump’s military-complex announcement, the Federal Aviation Administration said the arch would not pose an aircraft hazard, according to AP. The FAA recommended marking and lighting it so pilots could see it. NCPC’s July project record separately says it requested information about any FAA-required navigational or safety lighting.
