Who was convicted in the TRICARE fraud case?
A Fort Worth federal jury convicted Kevin D. Curry on September 24, 2026. The Justice Department describes Curry as a 64-year-old licensed professional counselor from Frisco, Texas, who owned and operated three purported mental health clinics:
- Acuity TMS of Plano LLC in Texas
- Acuity TMS of Fort Worth LLC in Texas
- Emerald Coast TMS of Fort Walton Beach LLC in Florida
The case concerned claims for transcranial magnetic stimulation (TMS), a form of therapy. The DOJ’s announcement of the conviction, issued September 25 and updated October 1, 2026, summarizes the trial evidence and the jury’s verdict.
How much did TRICARE pay in the $26 million case?
DOJ says Acuity billed TRICARE more than $26 million in claims it describes as false, fraudulent and tainted by kickbacks. TRICARE paid approximately $17 million. The billed total and the amount paid are different figures: the $26 million is not the amount DOJ says the program disbursed.

What did DOJ say the clinics did?
According to DOJ’s account of the trial evidence, more than $5.5 million in kickbacks were offered and paid to induce active-duty servicemembers, veterans and family members to consent to TMS treatment. DOJ says those people did not qualify for the treatment and often did not receive it.
DOJ also says Curry used doctors’ credentials without their knowledge or consent, falsely represented himself as a medical doctor, and directed staff to fabricate records. Those descriptions are DOJ’s account of the evidence; the jury’s formal findings are the counts of conviction listed below.

What did the jury convict Curry of?
The jury found Curry guilty on nine counts:
- Three counts of health care fraud
- Three counts of offering and paying illegal health care kickbacks
- Three counts of engaging in monetary transactions in criminally derived property
DOJ says proceeds funded hotel stays, a lavish casino-themed party and a gold-plated Tesla Cybertruck worth more than $100,000. The agency’s announcement does not give a fuller transaction-by-transaction accounting of that spending.
What happens next, and what penalties are possible?
Sentencing had not occurred as of DOJ’s October 1, 2026 update. DOJ says each count carries a maximum sentence of 10 years in prison. That is a statutory maximum, not a prediction or an imposed sentence: the judge will determine the sentence after considering the sentencing guidelines and statutory factors.

How this case fits into DOJ’s broader fraud enforcement
DOJ says its Health Care Fraud Strike Force Program had charged more than 6,200 defendants since 2007, in cases involving collective billing of federal health programs and private insurers exceeding $45 billion. The program then comprised nine strike forces. Those figures describe the program as a whole and are separate from the amounts in Curry’s case.
