In a 2025 interview, OpenAI CEO Sam Altman cautioned that people are telling ChatGPT intensely personal things while ordinary AI conversations generally lack the legal confidentiality protections of a licensed therapist, doctor, or lawyer. His practical message: do not enter information you could not tolerate being retained, reviewed, disclosed through legal process, or exposed by an account, integration, or security failure.
That does not mean every chat is public or automatically handed to authorities. It means “private in my account,” “not used to train models,” and “legally privileged” are three different claims.

What Sam Altman actually warned about
TechCrunch reported on July 25, 2025, that Altman was discussing people using ChatGPT for therapy and emotional support. He said AI conversations do not currently have an established equivalent of therapist–patient or attorney–client privilege. If a court or another lawful process demanded relevant records, a provider could potentially be required to produce them. Read the interview report.
Altman has also argued that medical- and legal-advice conversations with AI should eventually receive stronger protections comparable to professional consultations. That is a policy position, not a current guarantee. The viral headline turns this into “never tell AI one particular secret,” but his point was broader: do not mistake an AI chatbot for a confidential professional.

The rule to remember
Before sending a prompt, ask: Would serious harm result if this exact text, document, or identity became available to the provider, an authorized administrator, a legal process, or an attacker? If the answer is yes, remove identifying details, use an approved system with appropriate controls, or speak directly with a qualified professional.
What not to paste into a consumer chatbot

OpenAI’s HIPAA guide says consumer ChatGPT and ChatGPT Business are not eligible services for handling protected health information under that guide. Do not assume that Temporary Chat makes a chatbot a HIPAA-covered clinician; product, contract, configuration, and jurisdiction all matter. See OpenAI’s HIPAA guide.
Is ChatGPT private?
Private from the public
A normal chat is not automatically published for everyone. Exposure can still occur through a compromised account, shared link, screenshot, browser or workplace monitoring, uploaded files, a custom GPT action, or another connected integration.
Private from model training
On personal workspaces, turn off Improve the model for everyone and new conversations will not be used to improve models, according to OpenAI. They remain in chat history until you delete them. Data Controls details.

Legally privileged
Training opt-out does not create therapist–patient, doctor–patient, or attorney–client privilege. That legal gap is the central point behind Altman’s warning.
Could OpenAI be forced to provide chats?
A provider may receive a subpoena, warrant, court order, or other legal demand. Whether it must produce information depends on the process, jurisdiction, relevance, applicable policy, and whether the data still exists. It is inaccurate to say that authorities can automatically read everything, but it is also unsafe to assume a chat is immune from disclosure.
OpenAI says deleted chats are removed from the account immediately and scheduled for permanent deletion within 30 days, subject to legal, security, and de-identification exceptions. Temporary Chats may also be retained for up to 30 days for safety purposes. Read the retention policy.
Controls that reduce exposure
Turn off model improvement
- Open ChatGPT and select your profile icon.
- Choose Settings, then Data Controls.
- Turn off Improve the model for everyone. The setting applies across your account, including web and mobile, according to OpenAI’s help page.
On mobile, open the sidebar, tap the profile icon, choose Data Controls, and switch off the same setting. Check OpenAI’s current control instructions.

Use Temporary Chat when appropriate
Start a new conversation and select Temporary at the top of the interface. OpenAI says these chats do not appear in history, do not create memories, and are not used to improve models. They may still be retained for up to 30 days for safety, and a custom GPT’s external action can send information to another company under that company’s privacy policy. Temporary Chat FAQ.
Delete instead of archive
Archiving only hides a conversation. Deleting starts the stated deletion process. Uploaded files can be stored separately in a Library, project, or custom GPT, so remove those files separately when applicable. OpenAI’s retention and file guidance.
Inspect integrations
Before sending sensitive material, review custom GPT actions, connected apps, browser extensions, and workplace integrations. Temporary Chat is not a universal shield against those additional recipients.

- Redact identity: replace names with “Employee A” or “Client B.”
- Generalize numbers: use approximate amounts, dates, ages, and locations.
- Remove credentials: never include passwords, tokens, keys, or recovery phrases.
- Summarize manually: paste only the necessary excerpt instead of an entire contract, medical record, or case file.
- Separate advice from records: ask for general information rather than an identifiable personal history.
- Use approved tools: follow your employer’s AI and data-classification rules.
- Check recipients: confirm whether an action or integration sends data elsewhere.
- Contact a professional: use a doctor, therapist, lawyer, or other qualified adviser when confidentiality or regulated advice matters.
For example, replace “My employee John Smith, SSN 123-45-6789, stole $14,000 from our Chicago office” with “An employee at a midsize company may have misappropriated approximately $14,000. What evidence should an employer preserve before speaking with counsel?” The redacted prompt still is not legal advice, but it removes unnecessary identifiers.

Consumer accounts versus business workspaces
Personal ChatGPT
Personal plans are convenient for low- and medium-sensitivity brainstorming, writing, coding, and research. Users must actively disable model improvement if they do not want new chats used for that purpose, and the account can accumulate histories and files. Personal plans are a poor fit for trade secrets, regulated records, credentials, or information covered by an NDA. Business and Enterprise
OpenAI says Business workspace data is excluded from training by default, encrypted in transit and at rest, and not automatically visible to other members. Administrators still receive some operational and usage information, and organizations may set retention, compliance, export, or access policies. Business controls do not eliminate legal-disclosure risk or override an NDA.
ChatGPT Business is listed at $20 per user per month with annual billing or $25 monthly, with a two-user minimum on the cited pricing page. Enterprise uses custom pricing and adds options such as custom retention, data residency, SCIM, role-based access controls, support, and contractual review. Local or self-hosted AI
Running a model locally can reduce dependence on a hosted provider, but it transfers responsibility for device security, backups, access controls, logs, updates, and hardware. “Local” is not automatically secure if a computer, synced folder, extension, or server is compromised.
Using AI for emotional support
Chatbots can help with journaling prompts, emotional check-ins, and general coping information. They are not automatically confidential therapists. In an immediate crisis or risk of harm, contact local emergency services or a qualified crisis resource rather than relying solely on a chatbot.
The Bottom Line
If you would require a confidentiality agreement, professional privilege, or a court order before telling a human, do not casually paste the information into a consumer chatbot. Minimize identifying details, use the available controls, inspect integrations, and go directly to a qualified professional when confidentiality is essential.
