Caroline Downey’s October 1, 2026, National Review essay, “The Cornell Seven Case and the Perils of Sexual Liberation,” argues that a culture treating consent as its only restraint can permit degrading outcomes. That is the essay’s opinion, not a finding established by the Cornell case. The underlying events remain disputed: a former student’s civil allegations have not been adjudicated, and the criminal investigation has reopened.
What happened in the Cornell Seven case?
A former Cornell student identified in court papers as Jane Doe filed a civil complaint in September 2026 alleging that seven members of the Chi Phi fraternity drugged and sexually assaulted her at the fraternity’s Cornell house in October 2024. The seven men have not been criminally charged, according to the Associated Press. The complaint’s allegations are not a court finding.
The criminal investigation was reopened after the civil filing. New York Gov. Kathy Hochul appointed state Attorney General Letitia James as special prosecutor to take over the probe. Tompkins County District Attorney Matthew Van Houten said, “Seeking justice sometimes requires us to reconsider or reopen cases when we are provided with additional evidence,” the AP reported.
Did the woman tell police she was raped?
The public disagreement cannot be accurately reduced to a claim that she never told police she was raped. The AP reported that excerpts from a campus-police interview transcript, obtained by CBS News, included the woman saying, “Yes. It was coercion, yes,” and describing herself as “completely and totally incapacitated” before some sexual abuse. AP also reported that she said, “I can say with 100% confidence I was raped.” These are reported excerpts from an interview, not a judicial finding.

The district attorney said the initial decision not to prosecute relied on a signed written summary of the 2024 interviews rather than the full transcript. According to the AP, he said that summary did not include the statements describing rape or coercion and did not allege that she had been drugged against her will. The central documentation question is what investigators recorded, what reached the prosecutor, and how those records informed the initial decision.
Why did prosecutors reopen the investigation?
The civil complaint brought the matter back into public and legal focus, and the district attorney reopened the criminal investigation after it was filed. Hochul then appointed James as special prosecutor. The available accounts describe a renewed investigation; they do not establish what its eventual findings or charging decisions will be.

The AP’s account and reporting by KPBS/NPR describe conflicting accounts and scrutiny of how the initial decision was made. A reopening is not proof that the allegations are true, just as the earlier decision not to prosecute is not proof that they are false.
How do the criminal investigation and Cornell’s inquiry differ?

These processes answer different questions and can reach different outcomes. A university disciplinary sanction is not a criminal conviction; an absence of criminal charges does not resolve the civil allegations. Cornell says the Chi Phi chapter was closed in 2024 and remains barred from campus. It has cited federal privacy laws in declining to detail individual sanctions.

AP also reported that describing Cornell’s process as merely requiring “apology essays” is misleading: Cornell said essays were not the sole consequence for anyone charged.

Downey’s essay advances a wider cultural argument, including claims connecting feminism, pornography, hookup culture and the alleged incident. The case reporting summarized here does not establish those causal relationships, nor does it provide a population statistic or study substantiating them. The Cornell case can be discussed as a specific, unresolved set of allegations and as a test of institutional documentation and response; it cannot by itself prove a broad claim about an entire movement or culture.

Downey’s deck states, “With consent as its only moderating principle, the sex-positivity movement invited a world of depravity.” That is the author’s thesis, not a neutral summary of established facts. Keeping the distinction clear matters: disagreement with her cultural argument does not decide the allegations, and the allegations do not independently validate the essay’s broader causal claims.
