The tribunal directed the vehicle’s insurer, The New India Assurance Company Ltd, to deposit the compensation for her; it also reportedly allowed the insurer to recover the amount from the civic side because of breaches involving the truck’s fitness certificate and the driver’s licence.
What happened in Kalyan
Amit was playing on a road opposite a residential building on May 22, 2021, when a KDMC garbage truck reversing at high speed hit him, according to a PTI report published by Hindustan Times on October 1, 2026. He suffered fatal injuries.
His mother sought compensation before the Thane Motor Accident Claims Tribunal (MACT). The tribunal’s original order was not available in the reports, so the ruling and its reasoning here are described as reported, rather than as independently verified against the order.
Who was ordered to pay, and who may ultimately bear the cost
The reported direction separates payment to the claimant from recovery between the insurer and the civic side. The tribunal directed New India Assurance to deposit ₹5 lakh, with interest from the date the compensation petition was filed, within one month for transfer to Amit’s mother. In practical terms, the reported order tells the insurer to fund the award for the claimant, while allowing it to seek recovery from the civic side. The reports do not establish whether any appeal or stay followed.
Why the tribunal reportedly allowed recovery
PTI reported that RTO records showed the truck’s fitness certificate expired on March 10, 2013, and was never renewed. The driver’s transport-class licence expired on August 13, 2019.

KDMC reportedly argued that the driver had been supplied by its contractor, Vishal Expert Services Pvt Ltd, and relied on government resolutions said to extend the validity of certain documents during the COVID period. The tribunal reportedly rejected that defence because the licence had lapsed before the pandemic. It also said KDMC, as the truck’s owner, was expected to verify licences of contractor-supplied drivers; according to PTI, KDMC did not produce a verification report.
PTI quoted MACT Member R V Mohite as saying: “The opponent No.1 KDMC was expected to verify driving licence of drivers supplied by Vishal Expert.” The report also reproduced the tribunal’s reasoning that a resolution dated March 26, 2021 could not account for a licence that had expired in 2019, before lockdowns, and that the driver had operated the vehicle without a valid licence and fitness certificate. These are quotations as reproduced in the news report, not independently checked against the tribunal order.

How the reported ₹5 lakh award was calculated
The reports say the tribunal used notional annual income of ₹30,000 and a multiplier of 15, along with conventional heads of compensation. They do not provide a complete calculation schedule or itemize the conventional heads, so the available reporting does not support reconstructing the exact arithmetic behind the final award.
