Tariffs and technology supply chains: answers to common business questions

There is no single “technology tariff.” Your bill depends on the item’s Harmonized Tariff Schedule (HTS) classification, country of origin, customs value, import date, and documented end use. For covered semiconductors and related products, U.S. Customs and Border Protection (CBP) describes a 25% additional ad valorem duty under the Section 232 regime established by the White House proclamation of January 14, 2026. Other electronics may face different Section 232 or Section 301 measures, ordinary HTS duty, exclusions, or no additional duty. The practical answer is an item-level classification and landed-cost process that is reviewed whenever a tariff notice changes.

Why a technology tariff cannot be quoted as one percentage

“Technology” is a commercial category, not a customs classification. A server, accelerator board, memory module, optical transceiver, laptop, or manufacturing tool can fall under different HTS headings. The applicable charge can also change with the product’s technical specifications, origin, customs value, import date, and use after importation.

Import duties are normally assessed when merchandise enters the United States. The importer may absorb the cost in its margin, pass it to a customer, or split the effect between price and margin. In the cases it examined, the U.S. International Trade Commission (USITC) found that importers bore nearly the full cost of the tariffs. That finding is evidence about examined tariff actions, not a guarantee for every product or company.

For planning, separate these questions:

  • What is the item? Identify the legal HTS heading and any technical subheading requirements.
  • Where was it made? Country of origin is determined under customs rules and may differ from the supplier’s billing location.
  • When does it enter? Effective dates and transition provisions can change the result.
  • How will it be used? Some exclusions depend on a specific end use, such as repair, research, or a qualifying data-center project.
  • What is the customs value? Duty is generally calculated against the entered value, with valuation rules controlling which costs are included.

A finance team should therefore avoid applying a blanket percentage to total technology spend. Build exposure from the stock-keeping unit (SKU), purchase order, or bill-of-materials level.

What changed for semiconductors in January 2026

The White House proclamation dated January 14, 2026, created a Section 232 framework covering semiconductors, semiconductor-manufacturing equipment, and derivative products. The proclamation explains that semiconductors are essential to each of the 16 critical-infrastructure sectors identified by National Security Memorandum 22 of April 30, 2024.

CBP’s 2026 guidance describes a 25% additional ad valorem duty for certain covered semiconductor imports. “Additional” means this charge is added to any ordinary HTS duty and other applicable measures unless a specific provision says otherwise. Importers must use the relevant Chapter 99 reporting provisions together with the product’s normal HTS classification.

The 25% figure is not a universal rate for every chip or electronic product. Coverage depends on the tariff headings and technical rules in the current HTS and CBP instructions. The bulletin illustrates why a generic description such as “processor” or “memory” is inadequate: it addresses logic-chip performance parameters, DRAM bandwidth thresholds, semiconductor-equipment headings, and derivative products.

End-use exclusions and special treatment

The proclamation and CBP guidance provide exclusions or special treatment for specified uses. The conditions must be tested against the actual transaction and supported with records; a product’s marketing label is not enough. The categories described in the guidance include:

  • Specified data-center equipment and projects.
  • Repair or replacement parts used to restore existing equipment.
  • U.S. research and development activities.
  • Eligible startup activities.
  • Non-data-center consumer applications.
  • Civil-industrial uses.
  • Public-sector uses.
  • Other identified technology-supply-chain uses listed in the applicable provisions.

Each category can have technical, documentary, or project-specific limits. Treat an exclusion as a customs claim that requires evidence, not as a general exemption for a company or industry.

How to determine whether an imported technology product is covered

Use the current USITC HTS archive as the starting point, then reconcile it with the latest proclamation, Chapter 99 language, and CBP Cargo Systems Messaging Service (CSMS) notices. A repeatable classification workflow reduces both overpayment and penalty risk.

  1. Describe the physical item. Capture function, architecture, principal use, power rating, interfaces, packaging, and whether the item is a component, finished device, or manufacturing tool.
  2. Map technical thresholds. For chips, record parameters that CBP identifies, such as logic-chip performance or DRAM bandwidth. Preserve manufacturer datasheets and revision numbers.
  3. Select the ordinary HTS heading. Classify the merchandise under the current HTS before applying Chapter 99 or Section 232/301 provisions. Do not classify from a supplier’s commercial code alone.
  4. Confirm origin and valuation. Record the country where the applicable substantial transformation occurred, the entered value, currency, assists, and any related-party valuation adjustments.
  5. Check additional actions. Search the current Chapter 99 provisions and effective dates for Section 232, Section 301, or other measures that attach to the heading or origin.
  6. Test end-use conditions. Match the importer, facility, project, and actual use to the exclusion language. Assign an owner for collecting certificates, contracts, bills of materials, deployment records, and repair documentation.
  7. Obtain a binding view when material. For high-value or technically ambiguous items, seek a formal customs classification or specialist review before the next entry rather than relying on an informal description.
  8. Version-control the decision. Store the HTS revision, CBP notice, effective date, ruling or analysis, and evidence used. Reopen the file after every policy change or product redesign.

Build a landed-cost model instead of multiplying spend by a headline rate

Landed cost should show the cash and operating consequences of importing one item or a defined shipment. A practical unit formula is:

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Landed cost = entered value + ordinary duty + additional tariff + freight + insurance + brokerage and customs fees + compliance labor + inventory carrying cost + expected delay or disruption cost.

The additional tariff is usually calculated as an ad valorem percentage of the entered value. For illustration, a $1,000,000 entered value subject to the CBP-described 25% semiconductor duty creates $250,000 of additional duty before ordinary duty, logistics, and other costs. The illustration does not establish that the merchandise qualifies for the 25% measure; classification and end use must be confirmed first.

Model component What to capture Why it changes the decision
Entered value Invoice price, assists, related-party adjustments, currency Every ad valorem charge scales from this base
Ordinary HTS duty Rate under the current tariff line Applies independently of additional measures
Section 232 or 301 duty Chapter 99 provision, rate, origin, effective date Can add materially to the ordinary duty
Logistics Freight, insurance, brokerage, port and handling charges Route changes and congestion alter delivered cost
Compliance Classification reviews, certificates, recordkeeping and audit time Exclusions may save duty but require evidence and controls
Working capital Transit inventory, safety stock and payment timing Longer or less predictable supply lines tie up cash
Operational risk Delay, rework, shortage and qualification costs A nominally cheaper source can be more expensive after disruption

Run sensitivities for tariff rate, exchange rate, freight, demand, lead time, and the probability that an exclusion is denied. Show finance the result per unit, per shipment, and for the annual plan so procurement can compare like with like.

What tariff evidence says about prices, imports and U.S. production

USITC analysis of Section 301 tariffs reports a 72.3% reduction in semiconductor imports, a 4.1% increase in U.S. semiconductor prices, and a 6.4% increase in the value of U.S. semiconductor production. These are findings for the examined Section 301 measures and period, not forecasts for the January 2026 Section 232 program.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

USITC also associated examined Section 232 tariffs with a $3.5 billion reduction in downstream U.S. production in 2021. The result shows why a tariff decision should include customers that use the imported component, not just the importer’s own gross margin. A duty can support domestic output in one stage while raising input costs or reducing production in another.

Exemptions require an evidence file

End-use treatment is a frequent source of errors because the same chip or board can be eligible in one deployment and ineligible in another. Before entry, connect the item to a specific project and retain:

  • Product datasheet, part number, revision, and technical parameters.
  • Purchase order, commercial invoice, packing list, and entry data.
  • Importer, consignee, installation site, and final customer.
  • Statement of intended use and, when relevant, proof of repair or replacement.
  • Bill of materials or equipment configuration tying the component to the project.
  • Contracts, funding records, or organizational documents supporting research, public-sector, startup, civil-industrial, or data-center treatment.
  • Controls preventing diverted or mixed use after importation.

Separate qualifying and non-qualifying inventory in the enterprise-resource-planning system. If a project changes, pause the exclusion claim and reassess the entry rather than carrying the old designation forward.

Should you diversify suppliers, nearshore, reshore or absorb the duty?

There is no universally superior response. USTR’s 2025 resilience policy series emphasizes better data, supplier diversity, and transparency, while IMF analysis highlights the trade-off between resilience and efficiency. Option Potential benefit Costs and limits to test
Supplier diversification Reduces dependence on one factory, country or route Second-source qualification, smaller volumes, duplicated tooling and quality oversight
Nearshoring Shorter transit and potentially faster recovery from disruption Higher unit cost, limited semiconductor capacity, origin rules and new logistics lanes
Reshoring Greater control over critical production and domestic policy exposure Capital expenditure, workforce, permitting, technology transfer and long qualification cycles
Absorbing the duty Fastest operational response and no supplier change Margin compression and continuing exposure if rates or volumes rise
Passing through the duty Protects gross margin when contracts allow Customer resistance, demand loss and renegotiation effort

Score each path on total landed cost, qualification time, available capacity, quality, geopolitical and tariff exposure, working capital, and reversibility. A dual-source arrangement is often more practical than an immediate factory move, but only if the second source has tested capacity and approved process controls.

How finance can model tariff exposure under uncertainty

Start with a baseline using the current HTS classification, origin, value, and end use. Then create explicit scenarios rather than one blended forecast:

  1. Base case: current duty actions and confirmed exclusions continue through the planning period.
  2. Rate case: the additional duty changes while volume, value and origin remain constant.
  3. Origin case: sourcing shifts among countries with different measures or ordinary HTS rates.
  4. Exclusion case: an eligible end use is documented and accepted, or an expected exclusion is unavailable.
  5. Disruption case: lead times, freight, safety stock and expedite costs increase at the same time as tariff expense.
  6. Demand case: higher customer prices reduce volume, changing the fixed-cost absorption of domestic operations.

For every scenario, report duty dollars, landed cost per unit, gross-margin impact, cash tied in inventory, and the break-even point for an alternate supplier. Keep tariff assumptions separate from exchange-rate and freight assumptions so management can see which variable drives the result.

Data architecture and review cadence

Maintain an item-level tariff register linked to procurement and finance systems. At minimum, each record should contain:

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.
  • SKU and supplier part number.
  • Ordinary HTS code and Chapter 99 code, if applicable.
  • Country of origin and manufacturing site.
  • Supplier, importer of record, and customs broker.
  • Bill-of-materials position and finished-product relationship.
  • Documented end use, project, and exclusion status.
  • Entered value, currency, quantity, and import date.
  • Current Section 232, Section 301, or other duty action.
  • Effective date, sunset or review date, and evidence location.
  • Owner responsible for revalidation.

Use internal purchase orders, bills of materials, entry summaries, and supplier declarations for operational exposure. BEA’s Global Value Chain statistics add a macro view of foreign value added and links between countries and U.S. production; the agency describes these statistics as a way to better understand supply chains that connect countries to produce goods and services.

Set a formal review after every White House proclamation, USTR action, HTS revision, or CBP CSMS bulletin. For stable items, a scheduled quarterly check can supplement event-driven reviews; high-value semiconductor entries may justify review before every shipment.

Common failure modes and fixes

Using a product name as the classification

Symptom: “AI chip,” “server,” or “memory” appears in the system with no technical attributes. Fix: classify by function, construction and the parameters in the HTS and CBP guidance, retaining the datasheet used.

Assuming the supplier’s country is the origin

Symptom: the invoice address is used without tracing manufacturing. Fix: obtain a documented origin analysis and update it when wafer fabrication, assembly or testing moves.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Claiming an exclusion without proving use

Symptom: all purchases for a customer are marked “data center” or “research.” Fix: link each entry to a named project, site and end-use file, and segregate mixed-use inventory.

Ignoring downstream exposure

Symptom: procurement reports duty while operations reports only unit price. Fix: connect tariff scenarios to customer demand, production value, lead time and working capital.

Failing to version decisions

Symptom: a classification memo has no effective date or source notice. Fix: archive the HTS edition, CBP bulletin, proclamation and approval owner with every tariff record.

Authoritative sources for ongoing checks

The current USITC HTS archive supplies tariff headings and Chapter 99 provisions. CBP CSMS bulletins provide operational instructions and technical classification details. White House proclamations establish Section 232 actions and exclusions, while USTR policy papers explain Section 301 measures and resilience initiatives. BEA Global Value Chain statistics support value-added exposure analysis, and IMF research provides context for the resilience-versus-efficiency trade-off. Check the original agency publication and effective date before changing a customs entry or financial forecast.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

How to make the decision

First protect compliance: classify accurately, prove origin and end use, and calculate the duty under the current HTS. Next quantify the exposure with a landed-cost model and scenario range. Then compare diversification, nearshoring, reshoring, pass-through and absorption using capacity, quality, qualification time, cash and reversibility—not tariff rate alone. The companies that respond fastest are usually those with a maintained item-level data set and a review process tied directly to policy changes.

Product prices and availability are accurate as of the date/time indicated and are subject to change. Any price and availability information displayed on Amazon at the time of purchase will apply.
