It can mean a camera recording a public area, a system matching a face to an identity, a phone generating location data, or a government agency collecting communications-related information under a specific legal authority. These practices differ in purpose, scale, legal rules, and oversight; a camera in public is not equivalent to every form of government or commercial monitoring.
What is surveillance?
Surveillance is the observation, collection, or analysis of information to monitor people, places, or events. It may be direct, such as watching a live camera feed, or indirect, such as retaining records and linking them later to identify patterns or individuals.

The word covers a range of technologies and practices, including video and audio capture, drones, license-plate readers, facial recognition, location data, communications-related records, and sensors embedded in devices or shared spaces. The observer may be a government agency, business, institution, or private individual. Who is collecting information—and under what authority—matters as much as the technology itself.

These examples are not interchangeable. A useful way to assess any system is to ask what it collects, whether it identifies people, who can access or share the information, how long it is retained, and what oversight or recourse exists.

How does government surveillance work?
In the United States, government surveillance is not one unified program with one set of rules. Local policing, public-space monitoring by federal agencies, and intelligence collection for national-security purposes can involve different authorities, procedures, and oversight. The details depend on the agency, the information sought, the purpose, and the applicable law.
Public-space monitoring
The U.S. Government Accountability Office (GAO) found that selected Department of Homeland Security law-enforcement agencies use more than 20 types of detection, observation, and monitoring technologies. Its review included drones, pole-mounted cameras, facial recognition, and license-plate readers. GAO noted that such tools may be used in public places where a warrant is not necessarily required in advance, while also raising privacy, civil-rights, and civil-liberties concerns. That finding is about the selected agencies and technologies; it is not a blanket rule for all government surveillance.
National-security authorities
National-security collection operates under defined legal authorities and oversight regimes. The Office of the Director of National Intelligence (ODNI) publishes annual statistics on certain authorities, including the Foreign Intelligence Surveillance Act (FISA) and National Security Letters. Its report covering calendar year 2025, released in 2026, says Section 702 targets are non-U.S. persons. The Reforming Intelligence and Securing America Act, enacted in April 2024, reauthorized FISA Title VII authorities for two years and added compliance and reporting provisions. This framework concerns specified national-security authorities; it should not be applied to local policing, consumer devices, or other countries.

ODNI estimated 349,823 Section 702 targets in calendar year 2025, compared with 291,824 in 2024 and 268,590 in 2023. These are target estimates reported by ODNI, not a count of every person whose information may have been incidentally collected, accessed, or otherwise affected by surveillance. The figures describe this particular authority and should not be read as a census of surveillance overall.
Can the government watch you without a warrant?
There is no universal yes-or-no answer. Whether a warrant is required depends on the type of surveillance, the information sought, where and how it is collected, the government actor, and the legal authority involved. The GAO finding about selected DHS technologies in public places illustrates that some monitoring may occur without a warrant in advance; it does not establish that every form of observation or data collection is warrant-free.
Nor does the absence of a warrant necessarily mean there are no rules. Statutes, agency policies, oversight processes, and limits on use or retention may apply, but their scope varies. A national-security authority such as Section 702 has its own legal framework and oversight; it is not a general permission for all agencies to monitor anyone. A question about a particular search, device, investigation, or data source requires the facts and jurisdiction to be considered.

What is facial recognition surveillance?
Facial recognition software analyzes an image of a face and compares its features with another image or a collection of images. It can support identity verification, such as checking whether someone matches an enrolled image, or help generate investigative leads by searching images against a reference gallery. Those uses have different consequences: a mistaken match in a lead-generating search can bring an uninvolved person into an investigation.
GAO reported in 2022 that 18 of 24 surveyed federal agencies used facial recognition for one or more purposes in fiscal year 2020. Fourteen of 42 surveyed federal agencies employing law-enforcement officers reported using it in criminal investigations. These are dated survey findings about the agencies surveyed—not current usage rates for every agency, and not a measure of accuracy or the number of people searched.
Meaningful evaluation should examine the system’s intended use, the image sources and reference galleries, how matches are reviewed, the possibility of error or bias, and what happens to people flagged by a search. A result should not be treated as proof of identity merely because software returned a match.

How do surveillance cameras affect privacy?
A camera can capture more than the person or event an operator intends to observe. Depending on placement and settings, footage may reveal who visits a location, when they arrive, who accompanies them, and how they move through a space. Storage and search tools can make recorded footage available well after an event has passed.
Camera systems also differ in what they do with recordings. Some are used to view or retain video; others may be connected to facial recognition, other AI-based tracking, audio capture, or additional sensors. Testimony in a congressional hearing described the spread of consumer and business cameras, increased capacity to store video and audio, sensors in devices and shared spaces, and the integration of cameras with AI-based tracking. That testimony provides context about possible practices, not a measured inventory of all cameras or a count of how widely each capability is used.
For a home security camera system or a camera in a shared space, privacy depends on design and use: which areas enter the frame, whether audio is recorded, who can view footage, whether analytics identify or track people, how footage is shared, and when it is deleted. A device’s presence alone does not answer those questions.

How can surveillance be regulated?
Regulation is more useful when it addresses the full life of the information, not just the moment a sensor captures it. GAO’s oversight work highlights gaps and uneven approaches among federal agencies, while ODNI’s transparency materials describe a narrower national-security framework. Neither should be mistaken for a single rulebook covering every public agency, business, or country.
- Necessity and purpose: Define a legitimate, specific purpose and require a reason to use the technology, rather than collecting information simply because collection is possible.
- Data scope and targeting: Limit what is gathered and whose information is sought. Distinguish targeted collection from broader capture of people who happen to be nearby or connected to a target.
- Notice and consent: Clarify when people are informed, whether consent is meaningful in the setting, and what exceptions apply.
- Access, sharing, and retention: Restrict who may view or transfer records, log access, set deletion schedules, and document exceptions.
- Accuracy and bias evaluation: Assess performance for the actual context of use, identify disparate risks, and establish human review and correction procedures.
- Transparency and independent oversight: Publish policies and aggregate reporting where possible, audit compliance, and provide a way to challenge misuse or incorrect records.
GAO’s 2024 report found that 16 of 24 large federal agencies reported addressing civil-rights and civil-liberties protections in separate policies or privacy compliance activities, while eight reported not considering them in those activities. GAO recommended clearer government-wide guidance; its report page stated that legislative action had not occurred as of February 2026. The finding describes variation in those surveyed agencies, not the absence of every safeguard across the federal government.
The State Department’s archived summary of principles endorsed in 2023 identifies internet controls, video surveillance paired with AI, and big-data analytics as areas requiring responsible use and human-rights safeguards. It is policy guidance, not a statute or a complete statement of current law.
How to compare two surveillance systems or policies
When two systems look similar from the outside, compare their actual data practices and controls. These questions apply to cameras, biometric tools, location-data systems, and government collection programs, though the legal obligations differ by context.

- Who and what is in scope? Determine whether collection is targeted, limited to a site or event, or likely to include bystanders and people not suspected of anything.
- Why is collection allowed? Find the stated purpose and legal basis, and check whether use is restricted to that purpose.
- Are people notified, and can they consent? Consider the setting and whether a person has a real choice, not just whether a notice exists.
- Who can access or share the information, and for how long? Look for access controls, sharing limits, retention schedules, deletion practices, and exceptions.
- How are errors and bias assessed? Ask whether the system has been evaluated for the relevant use and whether people can correct or contest an adverse result.
- Who audits it, and what recourse is available? Look for independent review, public reporting, complaint channels, and remedies when rules are broken.
