The Supreme Court has reportedly reversed lower-court custody orders favoring a father and allowed a mother to take their two children to the United Kingdom and enroll them in school there. The permission is subject to conditions: she must provide the school details within six weeks and produce the children before the Court whenever required. The ruling, as described by Hindustan Times, weighs the children’s welfare and wishes alongside the mother’s employment and proposed arrangements; it does not establish that the father’s pending criminal allegations were proven.
What the Supreme Court reportedly ordered
Hindustan Times reports that the Court made an earlier stay of the lower-court custody orders absolute and permitted the mother, for the present, to take the children to the UK and enroll them in school. She must provide details of the school within six weeks and undertake to bring the children before the Court whenever required. The report said the matter was expected to return to court in January 2027; that is a reported next step, not confirmation of what happened afterward.

The mother’s work and plans for the children
The couple married in 2011 and separated in 2018, when the mother was four months pregnant. She raised the children after leaving the matrimonial home. The report says she worked at IIT Jodhpur, VIT University in Vijayawada and later in Bengaluru before obtaining a lecturer position at the University of Hull.
Earlier orders reportedly characterized her employment moves as a “nomadic life,” granted sole custody to the father and rejected relocation. The Supreme Court reportedly rejected that negative assessment, treating the mother’s efforts to work and provide financial security for herself and the children as factors in her favor. She alleged that the father had caused difficulties at her workplaces, including through RTI applications and complaints; that is her account as reported, not an independently established finding here.
The children’s wishes and well-being
The report says the Court considered the children’s expressed wishes and counsellors’ reports. Those reports recorded that the children were reluctant to interact with their father during visitation sessions. The decision was thus reported as considering their circumstances and emotional well-being, rather than treating the relocation question as a simple choice between parents’ preferences.

The pending POCSO prosecution
Hindustan Times reports that the Court considered a pending POCSO case against the father. According to the report, the son disclosed allegations of sexual abuse to a psychiatrist at NIMHANS, after which a chargesheet followed. The allegations are not established as proven by the information available here. The report says the Court regarded granting custody to the father as unwarranted while the prosecution remained pending; the exact procedural details and judicial reasoning require the judgment or court records.

The report says the Court rejected the argument that moving to the UK would necessarily cut the children off from their Bengali cultural roots. It also says the Court did not treat the paternal grandparents’ pension as income supplementing the father’s ability to provide for the children.

Hindustan Times reported the father’s monthly earnings as about ₹17,000 from part-time lecturing and his parents’ joint pension as about ₹1 lakh monthly. These are approximate, case-specific figures attributed to that report, not independently verified amounts.

The reported outcome is case-specific. It illustrates that a parent’s proposed move abroad may be considered alongside the children’s welfare, their stated wishes, safety concerns, schooling and the practical arrangements for their care. It does not establish a general rule that a parent may relocate children without permission, or that employment abroad by itself decides custody. The available report describes a court-authorized move with continuing obligations to provide school information and produce the children when required.
Hindustan Times attributes to the Court the sentence: “Meeting these requirements is the primary duty of the parents themselves.” The precise wording and context should be checked against the judgment before relying on it as a primary-source quotation.
