Stablecoin regulation explained: reserve, redemption, and disclosure requirements in the U.S. and EU

Stablecoin rules answer three practical questions: what assets must support each token, how holders can get money back, and what the issuer must disclose. Under the U.S. GENIUS Act framework, a permitted payment stablecoin issuer must maintain identifiable reserves equal to at least the outstanding token supply, publish clear redemption and fee policies, and report reserve details every month. The EU’s MiCA regime requires legally and operationally segregated reserves for asset-referenced tokens, protects a holder’s right to redeem at all times, and requires plans for stressed markets and issuer failure.

Those obligations do not make every stablecoin interchangeable. The issuer’s authorization route, reserve assets, custody arrangements, redemption process, fee schedule and insolvency protections still depend on the jurisdiction and token classification. Use the checks below to evaluate a specific coin instead of assuming that a U.S. rule applies in Europe, or vice versa.

What stablecoin regulation is designed to control

A stablecoin is marketed as maintaining a stable value, usually against a fiat currency. Regulation focuses on the mechanism behind that promise rather than on the token’s name or trading price. The main controls are:

  • Backing: which assets may be held against outstanding tokens and whether the backing must equal the supply.
  • Redemption: how a holder requests payment, how long settlement can take, which thresholds apply and what fees are charged.
  • Transparency: how often the issuer reports supply, reserves, asset composition, maturity or tenor and where assets are held.
  • Supervision: which authority authorizes and monitors the issuer.
  • Failure handling: how reserves are protected and how redemption proceeds if the issuer becomes insolvent or loses authorization.

A reserve requirement is not the same as a government guarantee or bank-deposit insurance. It is a rule about assets and issuer conduct. A holder still needs to understand who owes the redemption payment, which law governs the claim and how to submit it.

How the U.S. GENIUS Act framework works

Who the U.S. rules cover

The GENIUS Act framework applies to permitted payment stablecoin issuers supervised through federal or qualifying state pathways. The word “permitted” matters: the obligations attach to issuers operating through an authorized route, not automatically to every token traded by U.S. residents. The framework also concerns payment stablecoins, so a token with a different legal classification may fall outside these particular provisions.

At least one dollar of eligible reserves for each dollar of tokens

Section 5903 of the 2025 U.S. statute requires an issuer to “maintain identifiable reserves backing the outstanding payment stablecoins … on an at least 1 to 1 basis.” In practical terms, the reserve value must be at least equal to the number of outstanding payment stablecoins, using the reserve categories allowed by the law.

The eligible categories identified in the statute include:

  • U.S. coins and currency;
  • money held at a Federal Reserve Bank;
  • demand deposits; and
  • other specified liquid, government-backed assets.

The 1-to-1 requirement is an asset-backing floor, not a promise that the token will always trade at exactly one dollar on an exchange. Market prices can move away from the target while a holder is buying or selling through a secondary market. The statutory redemption relationship is with the issuer, subject to the issuer’s published procedures and the applicable law.

Redemption procedures and fee disclosure

Issuers must publicly, clearly and conspicuously explain how holders redeem payment stablecoins. The procedures must be timely and written in plain language. A usable policy should let a holder identify the submission channel, information or verification steps, processing sequence and expected settlement conditions without having to infer them from technical documentation.

The statute also requires issuers to disclose all fees associated with purchasing or redeeming the payment stablecoins. Those charges must be presented in plain language rather than hidden in a spread, an unexplained service charge or a separate schedule that the holder cannot reasonably find. If the issuer changes purchase or redemption fees, it must provide at least seven days’ advance notice.

The seven-day rule is notice, not a guaranteed seven-day redemption window. The law’s cited requirements do not establish one universal settlement time for every issuer. Read the issuer’s actual procedure for cut-off times, business-day limits, minimum or maximum amounts, identity checks, banking dependencies and any suspension conditions.

Monthly reserve reporting

U.S. permitted issuers must publish reserve information every month. The required transparency layer covers:

  • outstanding payment-stablecoin supply;
  • the total amount of reserves;
  • reserve composition;
  • the composition of the reserves in enough detail to identify the asset categories;
  • average tenor; and
  • the geographic location where reserves are held in custody.

Monthly publication gives users a recurring snapshot rather than a one-time marketing statement. Compare the reported token supply with the reserve amount, then examine whether the asset mix, average tenor and custody geography create timing or concentration risks. A report can show what the issuer says it holds; it does not, by itself, establish that every asset is immediately transferable to a particular holder or that a third party has guaranteed the report.

How EU MiCA approaches stablecoins

Asset-referenced tokens are a distinct category

MiCA distinguishes asset-referenced tokens from electronic-money tokens. The reserve and redemption points described here concern asset-referenced tokens. Classification matters because the legal duties depend on what the token claims to reference and how it is structured. Do not transplant the asset-referenced-token rules to every euro- or dollar-linked token without checking its MiCA category.

Reserve assets must be segregated and liquid

For an asset-referenced token, MiCA requires an asset reserve that is legally and operationally segregated from the issuer’s estate and from the reserves backing other tokens. Legal segregation is intended to separate the reserve from the issuer’s general property; operational segregation requires the systems and accounts used to manage it to keep it distinct in practice. MiCA also addresses liquidity risk, so the reserve is not treated as a purely theoretical pool of assets that cannot support redemptions when demand rises.

This is a different formulation from the U.S. 1-to-1 wording. The U.S. provision identified above specifies an at-least-1-to-1 backing ratio and eligible asset categories. The cited U.S. text does not state an equivalent legal-and-operational segregation rule in the same terms, while MiCA’s reserve rule emphasizes both segregation and liquidity protection.

A permanent right of redemption

Article 39 of Regulation (EU) 2023/1114 states: “Holders of asset-referenced tokens shall have a right of redemption at all times against the issuers.” That is a continuing legal right, not merely an exchange feature that operates while market liquidity is available.

MiCA requires the issuer’s redemption procedures to explain the conditions and mechanics of exercising that right. The policy must address thresholds, timeframes, what happens in stressed markets, valuation and settlement. A holder should therefore look beyond the headline claim that redemption is available and check the operational rules: when a request is considered received, how the token value is calculated, which payment method is used and whether a threshold changes the process.

Orderly redemption if the issuer fails

MiCA requires an orderly-redemption plan for circumstances including insolvency, likely inability to perform obligations or withdrawal of authorization. The plan is designed to keep the process organized when ordinary operations are no longer reliable. It should cover how holders are treated, how reserve assets are realized or transferred and how outstanding claims are settled under the applicable procedures.

This failure planning is a major point of comparison with ordinary market trading. Selling a token to another trader may be possible during normal conditions, but it is not the same as exercising a legal claim against the issuer during an authorization or insolvency event.

U.S. and EU requirements compared

Regulatory axis U.S. GENIUS Act framework EU MiCA material described here
Eligible reserve assets Identifiable reserves backing outstanding payment stablecoins on at least a 1-to-1 basis; categories include U.S. coins and currency, money at a Federal Reserve Bank, demand deposits and specified liquid government-backed assets. Asset reserve for asset-referenced tokens; the cited material emphasizes segregation and liquidity risk rather than a single numeric ratio.
Legal and operational segregation The cited section requires identifiable backing; it does not state an equivalent legal-and-operational segregation rule in the same terms. Reserve must be legally and operationally segregated from the issuer’s estate and from reserves for other tokens.
Issuer authorization and supervision Permitted payment stablecoin issuers operate through federal or qualifying state supervisory pathways. MiCA authorization and supervision apply according to the token’s classification; withdrawal of authorization is one of the events covered by orderly-redemption duties.
Redemption timing, thresholds and fees Public, clear and conspicuous redemption procedures; all purchase and redemption fees in plain language; at least seven days’ notice before fee changes. A universal settlement time is not specified in the cited section. Holders have a right of redemption at all times. Procedures must cover thresholds, timeframes, stressed markets, valuation and settlement; the cited material does not provide one universal fee schedule.
Disclosure frequency and fields Monthly publication of outstanding supply, reserve amounts and composition, average tenor and geographic custody location. The cited material requires reserve and redemption policies but does not set out a matching monthly field list.
Insolvency and orderly redemption The cited requirements describe reserves and redemption disclosures; they do not provide the MiCA-style orderly-redemption plan in the material summarized here. Orderly-redemption planning is required for insolvency, likely inability to perform obligations or withdrawal of authorization.

The table compares the provisions described in the U.S. statute and MiCA materials. It is not a claim that every stablecoin offered in either market has the same authorization, reserve composition or consumer-access route.

How to evaluate a stablecoin before relying on it

  1. Identify the issuer and legal category. Find the legal entity that promises redemption, the jurisdiction in which it is authorized and whether the token is a U.S. payment stablecoin, an EU asset-referenced token, an electronic-money token or another category. A ticker symbol alone is not enough.
  2. Locate the current reserve disclosure. For a U.S. permitted issuer, look for the latest monthly report. Check the date, outstanding supply, total reserves, asset categories, average tenor and custody locations. Make sure the report covers the token you hold, not a similarly named product.
  3. Read the redemption policy end to end. Record the request method, identity checks, supported payout currency, processing timetable, minimum or maximum amounts, cut-off times and any conditions that can delay settlement. For an EU asset-referenced token, confirm that the policy explains stressed-market treatment, valuation and settlement.
  4. Calculate the real fee. Include purchase charges, redemption charges, banking costs and any conversion spread disclosed by the issuer. If you are in the United States, check the date of the fee schedule and whether a change was announced at least seven days in advance.
  5. Check liquidity and custody details. Reserve composition and average tenor indicate how quickly assets may be mobilized. Geographic custody information can reveal cross-border dependencies. Neither field guarantees instant payment, but both help you identify operational exposure.
  6. Read the failure provisions. Determine what happens if authorization is withdrawn, the issuer cannot perform or insolvency occurs. EU users should look for the orderly-redemption plan required by MiCA. U.S. users should distinguish the statutory disclosure and reserve requirements from any separate contractual or insolvency protections.
  7. Match the network to your transaction. A stablecoin can exist on several blockchain networks. Confirm that the sending wallet, receiving wallet and redemption service support the same network and token contract before transferring funds. A technically irreversible transfer to an unsupported network may not be recoverable through the issuer’s redemption process.

What monthly disclosures can—and cannot—tell you

A monthly report is most useful as a trend record. Save successive reports and compare supply growth with reserve growth, changes in asset categories, shifts in average tenor and movement in custody locations. A sudden change may warrant reading the issuer’s accompanying explanation and redemption terms before increasing exposure.

Disclosure is not the same as independent verification. The requirements described here specify what an issuer must publish, but the cited material does not establish one universal audit format, assurance level or publication deadline beyond the U.S. monthly requirement and the seven-day fee-change notice. Look for the report’s methodology, measurement date and definitions, and avoid treating a balance-sheet snapshot as a guarantee that every redemption request will settle immediately.

Self-custody does not create reserve backing

Common mistakes and how to avoid them

  • Confusing a market peg with a redemption right: An exchange price near one dollar does not prove that the issuer will redeem your token. Find the issuer’s legal redemption procedure.
  • Assuming “fully backed” means cash in a bank account: U.S. rules allow several eligible categories, including specified government-backed assets. Read the composition and average tenor rather than relying on a slogan.
  • Ignoring jurisdiction: A token available through a U.S. app may be issued under a different entity or offered under different terms in the EU. Match the product, issuer and user location.
  • Overlooking fee-change notices: A fee page can change. U.S. users should check whether the issuer gave the required seven days’ notice before relying on a new schedule.
  • Treating a wallet as insurance: Self-custody reduces dependence on an exchange’s private-key controls, but it does not protect against issuer insolvency, a reserve shortfall or a wrong-network transfer.
  • Skipping stressed-market language: For an EU asset-referenced token, read how the issuer handles valuation, thresholds and settlement when markets are disrupted. Those details determine how the permanent redemption right works in practice.

What remains jurisdiction-specific

The U.S. and EU frameworks share a focus on reserves, redemption and transparency, but they do not create a single global rulebook. Implementing regulations, supervisory guidance, effective dates and the assets supported by a wallet or redemption channel can change. A business serving customers in both markets may need separate authorization analysis, disclosures and operational procedures.

For a specific token, verify the current issuer terms and the applicable regulator’s materials on the date you act. The decisive questions are concrete: Which entity owes me redemption? Which assets back the supply? Where are they held? How do I submit a request, what will it cost and how long can it take? What happens if authorization is withdrawn or the issuer fails?

Bottom line

U.S. GENIUS Act rules emphasize identifiable, eligible reserves at a minimum 1-to-1 ratio, plain-language redemption and fee disclosures, and monthly reporting. MiCA adds legally and operationally segregated reserves, liquidity safeguards, a redemption right at all times and orderly-redemption planning for failure or loss of authorization. Evaluate a stablecoin by those enforceable details—not by its ticker, exchange price or the fact that a wallet can store it.
