Sports betting means staking money on the outcome of a real sporting event or a specific part of it. Daily fantasy sports (DFS) usually means paying an entry fee, building a fantasy lineup from real athletes, and competing against other entries based on those athletes’ statistics. The formats differ, but neither label alone determines whether a particular product is legal: rules depend on the state and the exact wager or contest.
How sports betting and DFS work

What DFS scoring means in practice
DFS compresses the season-long fantasy format into daily or weekly contests. Participants select athletes for a lineup, often within a salary-cap budget, and earn points from the athletes’ real-world statistical performances. The contest’s scoring rules determine how those statistics translate into results; the details vary by contest. The Congressional Research Service describes these mechanics in its 2016 report on daily fantasy sports, which is useful for explaining the format but not for current availability or market conditions.
That structure makes DFS different from a direct bet on a game, but it does not establish that every fantasy product qualifies for a legal exception or is treated alike in every state.

Why the legal distinction is not simple
Sports wagering is state-dependent
In 2018, the Supreme Court invalidated the federal Professional and Amateur Sports Protection Act (PASPA), leaving each state to decide whether to allow sports wagering. The IRS summarizes that change on its sports wagering page. A general description of betting does not tell you whether a particular operator or bet is permitted where you live.
UIGEA sets conditions for a fantasy-sports exception
The Unlawful Internet Gambling Enforcement Act (UIGEA) includes an exception for certain fantasy contests at 31 U.S.C. § 5362(1)(E)(ix). Among its conditions, prizes must be established in advance; winning outcomes must reflect relative knowledge and skill and be based predominantly on accumulated statistics from multiple real-world sporting events; and an outcome cannot be based on one team’s performance or solely on one athlete’s single performance. This is a defined federal-law feature, not a blanket statement that all DFS is legal or that fantasy contests are never gambling. State rules and the precise product remain relevant.

Illinois offers a state-specific example: its statute says fantasy contests are legally distinct from sports wagering and provides for regulation of fantasy contest operations. That provision is Illinois law, not a nationwide rule. See 230 ILCS 45/25-120, whose source note cites Public Act 104-468, effective June 16, 2026.

To determine whether a specific activity is allowed, check the current rules from your state regulator and the terms for the exact operator, bet, or contest. A general label such as “DFS” or “sports betting” is not enough to resolve the legal question.
How to compare the money involved
Sports betting uses a stake on a wager; DFS generally uses an entry fee for a contest. But those structures alone do not show which has better odds or expected value. Odds, entry fees, payout rules, scoring systems, and the number and skill of competing entries differ by product. The basic format distinction cannot support a fair comparison of likely returns.

Historical DFS figures should not be mistaken for current expectations. The Congressional Research Service reported that, during the first half of the 2015 MLB season, 1.3% of players won 91% of player profits, citing a 2015 Sports Business Journal report. It also cited a summer 2015 Eilers Research survey in which 70% of DFS participants reported losing money. Those dated figures describe specific historical evidence, not today’s contests or a prediction for an individual player.

The IRS page discusses federal excise taxes on businesses that accept sports wagers. It lists a 0.25% tax on the amount wagered and a $50 annual occupational tax for wagers authorized by a state, and a 2% tax and $500 annual occupational tax for wagers not authorized by a state. These are taxes on the business of accepting wagers, not personal tax rates for bettors, and they do not explain how an individual’s DFS proceeds are taxed. For personal tax obligations, consult current IRS guidance appropriate to your situation.
