Renters in Spain may be eligible for general rent assistance, a separate youth program, or housing support for people facing an emergency or particular vulnerability. The State Housing Plan 2026–2030 sets national rules, but autonomous communities and the cities of Ceuta and Melilla administer the programs and their application calls. Tenant rights depend in part on the lease, the home’s location, and the landlord’s status; there is no single rent cap that applies to every Spanish rental.
Which housing assistance may be available?
The State Housing Plan 2026–2030 provides several distinct routes. Its eligibility rules are not an automatic entitlement to payment or to a particular home: regional authorities manage applications, and local calls, documentation requirements, and budgets matter. Check the housing authority for the autonomous community or city where the home is located.

| Route | Who it is for | What the national plan provides |
|---|---|---|
| General rent assistance | Lower-income households renting or using a dwelling or room as their usual and permanent home, subject to the applicable income and rent limits. | Up to €250 per month for a dwelling or €150 for a room, subject to a limit of 40% of rent and possible increases in specified circumstances. |
| Youth rent assistance | Applicants aged 35 or younger, including those aged 35, who meet the other requirements. | Assistance for two years, with a possible extension of up to two more years if the regional authority agrees and the applicant remains eligible. |
| Immediate housing support | People in specified vulnerable or emergency situations, including some people facing eviction, homelessness, violence, or inadequate housing. | Help intended to secure a suitable dwelling or other accommodation; the plan sets maximum monthly amounts for rent assistance. |
| Rental non-payment coverage | Landlords letting homes to young people or vulnerable groups, under a mechanism developed locally. | A separate framework for coverage if rent is unpaid; it is not a rent subsidy paid to the tenant. |
The amounts in the plan are statutory maxima, not a promise that an applicant will receive the maximum. The plan generally prevents combining its rent assistance with another public payment for the same purpose, with specified exceptions for some vulnerable groups. Confirm compatibility with both programs before relying on more than one benefit.

Applicants generally need to hold, or be able to sign, an eligible lease or use agreement; establish that the home is their habitual residence; meet the income test; and stay within the applicable rent ceiling. The decree sets a general household income threshold of up to five times IPREM, with higher thresholds in defined cases, including certain disability, family, or victim circumstances. It does not mean every household below that ceiling automatically qualifies.
#1 Best Overall
For a dwelling, the plan allows up to €250 a month; specified circumstances involving dependants or disability may permit an increase within the 40%-of-rent limit. For a room, the stated maximum is €150 a month, also subject to the 40% limit. The regional call determines how to apply and document the rules.
Youth rent assistance
The youth line is for people aged up to and including 35. Its baseline income ceiling is five times IPREM, with specified higher limits for some disability and family circumstances. The decree’s standard maximum monthly rent is €1,000 for a dwelling and €600 for a room. In a municipality or settlement with 10,000 residents or fewer, the standard ceilings are €500 for a dwelling and €250 for a room. The decree allows higher ceilings in defined exceptional cases.

If a recipient moves within the same autonomous community or city, they must notify the granting authority within the required period and meet the requirements for the new contract to preserve the aid. Check the award conditions with the authority before moving.
Immediate help in an emergency or vulnerable situation
The plan covers specified situations such as gender-based or sexual violence, trafficking or exploitation, single-parent families, eviction from a usual home, homelessness, shanty-town or inadequate housing, and housing emergencies. Other people may qualify following an assessment of particular vulnerability. The response is intended to be an appropriate dwelling or, if that is not possible, another suitable form of accommodation.

The plan states a maximum of €300 per month for a usual dwelling and €200 for a room, in each case capped at 60% of monthly rent. Calls for this support are intended to be continuous and permanent, subject to budget and administration. A statutory support route does not guarantee a vacant placement or immediate payment in every locality. If you are in immediate danger, contact the relevant emergency service, social services, or housing authority directly.
Coverage for unpaid rent
The state-backed non-payment framework sets basic conditions for autonomous communities and Ceuta and Melilla to develop their own mechanisms for homes rented to young people and vulnerable groups. It is landlord-facing coverage, not money that a renter can treat as a subsidy. Verify whether a local mechanism exists and applies before relying on it.

What tenant protections apply to a residential lease?
The Urban Leases Act (Ley de Arrendamientos Urbanos, or LAU) is the core statute for ordinary urban residential leases. The applicable rules can depend on the lease’s date and type, the home’s location, and the landlord’s status. Transitional rules and later amendments can also matter, so an individual dispute cannot be decided from a general overview alone.

For qualifying housing leases, the LAU provides mandatory minimum extension periods of five years when the landlord is an individual and seven years when the landlord is a legal entity. These periods are subject to the Act’s conditions, notice rules, and exceptions. Check which statutory version and transitional provisions apply to the particular contract.

Rent at the start of a new contract in a stressed area
For a new contract in a declared stressed residential market area, the LAU can restrict the starting rent by reference to rent under the home’s previous residential lease during the preceding five years. Additional rules can apply to certain large landlords and under the relevant reference-price system. The restriction depends on the area’s declaration and the circumstances of the home and landlord; it is not a nationwide cap on every rental.
Annual rent updates under the measure published in September 2026
Royal Decree-Law 26/2026 was published on 30 September 2026 and, unless an individual provision says otherwise, enters into force the following day. It sets an extraordinary limit on annual updates falling between its entry into force and 31 December 2027. Where rent is at or above the applicable maximum reference-price limit, the measure says no increase applies. In other cases, landlord and tenant may agree a different increase under the law; without such an agreement, an increase cannot exceed 2%.
Do not apply those rules to a lease by looking at the percentage alone. The relevant reference-price ceiling, lease terms, location, and legal status affect how the measure applies. The measure is newly published as of 4 October 2026.

The landlord has statutory conservation duties. If necessary conservation work, or work ordered by a competent authority, makes the home uninhabitable, the tenant may choose to suspend the lease or end it without compensation. During a suspension, rent and the contract period are paused until the work is complete.
Security deposit
The LAU requires a cash deposit equal to one month’s rent for a residential lease. If an amount due has not been returned within one month after the keys are handed back, it accrues legal interest. Procedures for depositing the security with the relevant authority can differ by region. Keep the lease, payment evidence, inventory, and a record of the handover.
Quick Recap
How to check the right program and protect your position
- Find the responsible authority. Identify the autonomous community or city where the home is located, then consult its current housing-assistance portal or call for the State Housing Plan programs. National rules do not show whether a local call is open.
- Gather the evidence that fits your situation. This may include the lease or room agreement, proof of habitual residence, income documents, and evidence relevant to age, disability, household status, violence, eviction risk, or an emergency.
- Ask about eligibility and administration. Confirm the applicable income and rent limits, required documents, deadline, payment process, award duration, and whether the aid can be combined with another benefit. For immediate housing needs, contact social services or the housing authority as well as checking the written program rules.
- For a rent increase or dispute, check the exact contract and facts. Keep the lease and written communications. Establish the contract date and type, location, landlord category, and whether the issue concerns a new lease or an annual update. For an eviction notice, deposit dispute, or contested increase, seek case-specific legal or tenant-support advice promptly.
