South Korea has proposed, but the official materials cited here do not confirm that it has adopted, new civil procedures for seizing and selling virtual assets to collect debts. The National Court Administration announced a draft amendment to the Civil Execution Rules on July 2, 2026, with public comments due August 11. Those materials do not establish a November start date or that the amendment is now in force. The draft describes two different routes: enforcement against a debtor’s claim to receive assets from a third party, and enforcement against virtual assets themselves.

Are South Korea’s crypto debt-enforcement rules already in force?

The timing in the original headline is not confirmed by the official notice. The National Court Administration’s July 2, 2026 announcement describes a proposed partial amendment to the Civil Execution Rules and sets August 11, 2026, as the public-comment deadline. The notice explains the intended procedures; it does not establish that the amendment was finally promulgated or that it takes effect in November. The official notice is available from the National Court Administration.

That distinction matters: a draft describing how courts could handle virtual assets is not proof that every proposed method is currently available to creditors or that an asset can necessarily be recovered. The announcement says the rules are intended to address the growing use of virtual assets as targets in civil enforcement, but it does not supply a final commencement date.

What are the two proposed enforcement routes?

The draft separates a creditor’s attempt to reach a debtor’s right to receive virtual assets from a third party from an attempt to seize the virtual assets themselves. The procedures, participants and point at which seizure takes effect differ.

Draft route What the creditor targets Who the proposed process involves Proposed path to liquidation
Enforcement against a claim The debtor’s claim to receive virtual assets held by a third party, such as a service provider The court may restrain the provider and debtor; the creditor may ask the court to require the third party to disclose information The claim could be converted to cash by assignment, sale or another appropriate method, including a provider sale or transfer to an enforcement-officer account before sale
Enforcement against the assets The virtual assets themselves The court issues a seizure order and restricts the debtor’s disposal; the assets are transferred to an enforcement officer Liquidation could proceed by assignment order, sale order or another appropriate method, including a sale through a virtual-asset service provider

These are mechanisms described in the proposed amendment notice, not two interchangeable labels for one process.

Route 1: reach the debtor’s claim against a third party

Under the proposal, a creditor could seek a court order attaching the debtor’s claim to receive virtual assets from a third party. The order would bar the provider from transferring the assets to the debtor and bar the debtor from disposing of or receiving them. A creditor could also ask the court to require the third party to state whether the claim exists, the amount and type of assets held, and whether priority claims or other enforcement actions exist.

If the claim is reached, the draft would allow conversion to cash through assignment, sale or another appropriate method. The notice identifies a sale by the service provider and a transfer to an enforcement-officer account before sale as possible approaches. It does not guarantee that a particular provider holds assets for a debtor or that a sale will succeed.

Route 2: seize the virtual assets themselves

For enforcement against virtual assets themselves, the proposed sequence is a court seizure order, a restriction on the debtor’s ability to dispose of the assets, and transfer of the assets to an enforcement officer. In this route, the notice says seizure would take effect when the enforcement officer receives the assets. Liquidation could then take place under an assignment order, sale order or another appropriate method, including sale through a virtual-asset service provider.

How would the proposal fit into ordinary debt enforcement?

South Korea’s Supreme Court describes civil execution as a process for using court authority to enforce a creditor’s right when a debtor does not perform voluntarily. A creditor needs an enforceable title, such as a final judgment, a provisionally enforceable judgment or a notarial deed. Ordinary monetary enforcement proceeds through seizure, liquidation and distribution. The Supreme Court’s civil-enforcement explainer outlines that framework.

The Civil Execution Act version shown by the National Law Information Center is effective February 1, 2026. Article 227 provides that a court’s seizure order for a monetary claim is served on both the third-party debtor and the debtor, and that the effect arises when the third-party debtor is served. The proposed crypto-specific procedures would add rules tailored to virtual assets and claims to receive them; they do not mean that a creditor can simply take a debtor’s Bitcoin without court process. See Article 227 of the Civil Execution Act.

What does the Supreme Court’s Bitcoin seizure decision establish?

A separate Supreme Court decision dated December 11, 2025, addressed Bitcoin seizure in criminal procedure, not civil collection of unpaid debts. The Court’s English summary says Bitcoin’s independent manageability and transferability can make it an item subject to seizure by a court or investigative agency under the Criminal Procedure Act, if legal requirements are met. That decision is background on the legal treatment of Bitcoin; it does not establish that the proposed civil-enforcement rules are in force. Read the Supreme Court summary of Order 2025Mo45.

What should creditors and debtors take away?

  • For creditors: The proposal describes court-supervised routes to reach either a claim against a third party or the virtual assets themselves. It does not make enforcement automatic, remove the need for an enforceable title, or assure successful recovery.
  • For debtors: The proposed restrictions would be imposed through court process. The notice does not describe a way to avoid a valid enforcement order by changing how assets are held.
  • For anyone relying on the November date: The July notice and its August comment deadline do not verify final adoption or commencement. Those dates should not be treated as proof that new rules begin in November.
