Sniffer Dogs, Bloodstain Patterns and Ballistics: What New Studies Say About Forensic Evidence

Recent legal scholarship is renewing a basic question for courts: how strong is the science behind forensic evidence, and how confidently should experts describe what it shows? The methods are not interchangeable. A dog-handler team makes a detection decision; bloodstain pattern analysis interprets how stains formed; firearm and toolmark examination compares bullets or cartridge cases with a firearm. Studies provide useful evidence about some of these tasks, but they do not support a single reliability score for all three.

What the new legal scholarship is questioning

A University of British Columbia release published October 5, 2026, summarizes three legal articles: one published in the Alberta Law Review and two described as forthcoming in the Canadian Bar Review and Dalhousie Law Journal. The release argues that courts should scrutinize the scientific support for police dog searches, bloodstain pattern analysis and ballistics evidence, including the confidence with which experts present their conclusions. The underlying legal articles are not available in the material summarized by the release, so their specific arguments and case analyses cannot be assessed here.

Sara Gordon, associate professor at UBC’s Peter A. Allard School of Law, put the concern this way: “Just because a technique has been used in court for decades doesn’t mean we should take its reliability for granted, especially when someone’s liberty is at stake in a criminal trial.” Longstanding use is not, by itself, a measurement of accuracy.

What each kind of evidence actually does

Evidence type Question it addresses What a study needs to measure
Detection-dog alert Did a particular dog-handler team indicate the target odor under the search conditions? Detection performance, missed targets, false alerts, and variation between teams and settings.
Bloodstain pattern analysis What mechanisms or events could have produced the observed stains and patterns? How consistently analysts classify or interpret test patterns, and how often conclusions are incorrect or differ.
Firearm and toolmark examination Do features on a bullet or cartridge case support an association with a particular firearm? How often examiners reach correct, incorrect, or inconclusive conclusions under defined test conditions.

These are different tasks and outcomes. An alert is a dog-handler team’s response, not a laboratory measurement of an odor in isolation. Bloodstain analysis concerns interpretation of patterns, while firearm/toolmark examination compares marks on ammunition components with a firearm. A study of how blood moves after a shot, for example, does not measure the accuracy of firearm identification.

Bloodstain analysis: measurable error and disagreement

The National Institute of Justice’s February 28, 2022 summary of a black-box study reports results from 75 practicing bloodstain pattern analysts working on selected test material. Their conclusions were wrong about 11% of the time on average. Two analysts’ conclusions contradicted one another at an overall rate of about 8%, and a second analyst reproduced erroneous responses between 18% and 34% of the time. These are distinct measures: incorrect conclusions, disagreement, and reproduction of errors are not interchangeable.

The figures describe that study’s design and material; they are not a universal error rate for all analysts, all types of stains, or actual casework. NIJ notes that inconsistent terminology and classification standards may contribute to variation. The NIJ summary is therefore evidence that performance and consistency can be tested—and that the test’s scope matters—not a simple percentage to apply to every courtroom opinion.

New technical work addresses narrower questions

A 2025 Forensic Science International paper reports that an XGBoost machine-learning model achieved 92.89% accuracy when classifying impact spatter versus gunshot backward spatter in the study’s dataset. That result belongs to this particular classification task and dataset. It does not establish the accuracy of bloodstain interpretation generally, validate courtroom use, or show that software can replace expert analysis.

A separate paper by Kowalske, Oleiwi and Williams examined changes to bloodstain patterns in high-heat environments and post-fire scenes. It was first published online on December 19, 2024, and appeared in the March 2025 issue of the Journal of Forensic Sciences. Its subject matters because fire exposure can complicate interpretation; the available account does not establish detailed experimental outcomes. The paper is the source for its methods and findings.

Detection dogs: results depend on the team and the task

A dog’s alert is produced by a dog-handler team working in particular conditions. To evaluate a search, it matters what odor the team was trained to detect, whether the target was present, how searches were conducted, and whether handlers or evaluators knew the target locations. Results for one type of detection cannot automatically validate another.

A 2025 proof-of-concept black-box study tested 56 explosive-detection dog-handler teams at three locations in the United States over two days. The authors report that no team would have passed the tested OSAC/ANSI/ASB Standard 092 certification assessment, and that performance varied across sites and trials. The study’s subject was explosive detection: it does not directly establish how drug-detection teams, other canine searches, or any individual alert would perform in court. See Karpinsky and colleagues’ study for its scope and results.

Ballistics: keep identification separate from spatter physics

Firearm and toolmark evidence compares marks on bullets or cartridge cases with marks associated with a firearm. The materials summarized in the UBC release raise scrutiny of ballistics evidence, but the studies described here do not provide a ballistics error rate or a new test of firearm identification. It would be inaccurate to infer one from research on blood patterns or canine searches.

A 2024 Physics of Fluids study indexed by the Office of Justice Programs examined how muzzle gases affect forward spatter of viscoelastic blood in close-range shooting. That is work on the physical formation of spatter, not on whether an examiner can correctly associate a bullet or cartridge case with a firearm. It may inform interpretation of a scene, but it is not a reliability test of firearm/toolmark conclusions.

How to assess a forensic claim in court

The useful question is not simply whether a method is “reliable.” Ask what precise claim the expert is making and whether evidence supports that claim at that level of certainty. A careful assessment should establish:

  • The task: Is the evidence a detection alert, a classification of a blood pattern, an interpretation of events, or a comparison of firearm marks?
  • The test conditions: Was the assessment blinded? What was the sample, setting and target? How closely did these resemble operational casework?
  • The measured outcome: Did the study measure errors, disagreements, detection, classification accuracy, or something else?
  • The boundaries of the conclusion: Does the expert distinguish an observation from an inference, state uncertainty, and avoid extending a result beyond the tested conditions?
  • Alternative explanations: Could other mechanisms or circumstances produce the same pattern, alert, or mark association?

Those questions also explain why the numbers above cannot be used to rank dogs, bloodstain analysis and ballistics on one scale: they measure different outcomes in different settings.
