Usually, no—official U.S. and UK agencies do not encourage paying ransomware demands, and payment guarantees neither restored data nor deleted copies. In a real incident, however, the decision belongs to the victim and depends on verified recovery options, operational and data impact, legal and sanctions exposure, and advice from qualified incident-response and legal professionals. Treat payment as a last-resort business and legal decision, not as a technical fix.
What paying a ransomware demand can—and cannot—do
Ransomware commonly combines encryption with a threat to publish or sell stolen information. Criminals may promise a decryption key, deletion of copied data, or an end to further attacks in exchange for cryptocurrency or another payment. Those promises are not enforceable warranties.

The FBI states that paying does not guarantee an individual or organization will get its data back. A decryptor may fail, work only partially, or leave an extensive restoration job. Systems can remain compromised because the attacker’s access, persistence, or malware was not removed. The FBI’s position is explicit: “The FBI does not support paying a ransom in response to a ransomware attack.” FBI ransomware guidance

Payment also cannot establish that stolen information was deleted. The UK National Cyber Security Centre (NCSC) advises victims to assess what data may have been compromised and warns that they cannot trust a criminal’s promise to delete it. Extortion can continue after payment, including a second demand, threats to publish, or attacks on customers and partners. UK NCSC payment guidance

Paying may therefore buy a possibility—a working decryptor or temporary silence—not a reliable outcome. It can also expose the victim to sanctions, regulatory, financial, and security consequences. The NCSC and UK law enforcement say they do not encourage, endorse, or condone ransom payments. UK NCSC response guidance
The questions to answer before considering payment
Do not start with the ransom amount. Build a documented picture of the incident and compare payment with every realistic recovery path.
| Question | What to establish | Why it changes the decision |
|---|---|---|
| How much operational disruption is occurring? | Which services are unavailable, which safety-critical functions are affected, what manual workarounds exist, and how long they can continue safely. | A demand may be smaller than disruption costs, but a large apparent loss does not prove payment will restore operations. |
| Are backups usable? | Whether backups exist, are isolated from the attacker, are malware-free, and have been tested for restoration. | A clean, restorable backup can remove the main reason criminals claim payment is necessary. |
| Is an independent recovery route available? | Known decryptors, third-party recovery methods, software or cloud-provider assistance, and law-enforcement or researcher access to keys. | A decryptor supplied by criminals is not the only possible technical option. |
| What data may have been accessed? | Evidence of files staged or exfiltrated, the sensitivity of those files, affected people, and the credibility of the attacker’s sample. | Payment cannot be treated as proof that disclosure will stop; notification and protection duties may still apply. |
| What is the total cost? | Downtime, restoration, forensic work, legal advice, security improvements, staff time, insurance terms, ransom transaction costs, and possible regulatory consequences. | Comparing only the demand with downtime produces an incomplete calculation. |
| Could payment be unlawful or restricted? | The payee’s identity and affiliations, sanctions regimes, payment channel, sector rules, and every jurisdiction connected to the victim or transaction. | A payment can create sanctions or other legal exposure even when operations are under severe pressure. |
| Would the original access be closed? | How the intruder entered, which accounts or credentials were abused, what persistence remains, and whether containment has been independently validated. | Paying without removing access can invite reinfection or a repeat demand. |
The NCSC recommends involving decision-makers and technical staff, considering insurers and independent cyber-incident-response specialists, documenting the reasoning, assessing business and data impacts, and investigating the original compromise. NCSC decision guidance

What to do immediately after discovering ransomware
These steps apply before a payment decision. Adapt them to your organization’s incident plan and safety requirements.
- Protect people and critical services. If the incident affects medical care, industrial control, transport, or other safety-sensitive operations, use established emergency procedures and keep essential services safe while systems are isolated.
- Isolate affected systems. Disconnect infected devices and restrict network paths to stop spread, but do not casually power off systems when doing so could destroy volatile evidence. Coordinate with an experienced incident-response team.
- Preserve evidence. Where safe and feasible, collect relevant disk images, memory captures, logs, malware samples, ransom notes, wallet addresses, email headers, and indicators of compromise. CISA advises preserving volatile evidence and coordinating with law enforcement. CISA StopRansomware Guide
- Report promptly. In the United States, reporting options identified by federal guidance include the local FBI field office, the FBI Internet Crime Complaint Center (IC3), and CISA. UK organizations should use current UK incident-reporting channels and government signposting. Reporting remains appropriate whether or not payment is made. FBI reporting guidance CISA joint advisory
- Preserve the attacker’s communications. Keep ransom notes, chat transcripts, deadlines, cryptocurrency addresses, file samples, and any proof-of-life material. Do not edit or delete messages that may help identify the group or recover keys.
- Call the right specialists. Use independent forensic and recovery expertise, your insurer’s approved contacts where applicable, and qualified counsel. Avoid relying solely on the attacker’s explanation of what happened.
- Verify backups before restoration. Check that backup copies predate the compromise, are not encrypted or tampered with, and can be restored in a clean environment. Reconnecting compromised devices or restoring into an infected network can reinfect recovered systems. CISA recovery guidance
How recovery alternatives compare with payment
Clean backups and rebuilds
Backups are useful only when they are both clean and restorable. Have responders identify the likely intrusion date, scan backup sets, and test restoration on isolated infrastructure. Rebuilding from known-good images and rotating credentials may take longer than a criminal’s promised key, but it removes dependence on an untrusted party and helps eliminate persistence.
Decryptors and independent technical assistance
Law enforcement, security researchers, or service providers may have a decryptor for a particular ransomware family or campaign. Do not assume a tool works merely because a filename or ransom note looks familiar; confirm the strain, preserve originals, and test on copies. Ask authorities whether a relevant key or decryptor is available.

Workarounds and staged restoration
Some organizations can continue limited operations with paper procedures, alternate systems, unaffected cloud services, or segmented facilities. A staged recovery can reduce pressure while investigators determine what was accessed and close the entry path.
What a criminal decryptor would still require
Even if a key is delivered, recovery may involve decrypting large data sets, repairing corrupted databases, rebuilding servers, validating backups, and reissuing credentials. A decryptor does not prove that the attacker has left the network or that copied data will not be published.
Legal, sanctions, and reporting exposure
Payment rules depend on the victim, the attacker, the payment method, and every jurisdiction involved. Obtain current legal advice before transferring funds.

United States sanctions
The U.S. Treasury Department’s Office of Foreign Assets Control (OFAC) warns that ransomware payments may create sanctions exposure when a sanctioned person, group, or entity is involved. Prompt reporting and cooperation with law enforcement may be mitigating factors in an enforcement matter, but they do not make a payment lawful or guarantee a particular result. Check current sanctions information and have qualified counsel assess the transaction. OFAC ransomware advisory
UK and cross-border requirements
The UK NCSC says a payment may not be lawful if it is made to a sanctioned entity or area. Organizations should consider the laws and regulations of every jurisdiction in which they operate, where affected people live, and where the transaction is arranged. UK NCSC payment guidance

The 2024 text of 6 U.S.C. § 681b contains deadlines of 72 hours for covered cyber-incident reports and 24 hours for covered ransom-payment reports. Those figures do not mean every victim is covered or that the current implementing rule applies to every incident. Confirm the covered entity, triggering event, and current rule with counsel or CISA rather than treating the deadlines as universal. 6 U.S.C. § 681b

If personal, health, payment-card, government, or other regulated information may have been accessed, notification and documentation duties may apply. The deadline and recipient depend on the jurisdiction, sector, contract, and facts established by the investigation. Preserve evidence and obtain current advice instead of assuming that payment ends the obligation.
Independent reader supportYour contribution helps us test, update, and keep practical guides available for everyone.Questions to ask your response team and decision-makers
- What evidence shows encryption, exfiltration, or both?
- Which systems and accounts are still under attacker control?
- What is the earliest trustworthy restore point?
- Have backups been tested in an isolated environment?
- Is there a confirmed decryptor for this exact ransomware variant?
- What independent evidence supports or contradicts the attacker’s claims about stolen files?
- What is the operational impact of waiting 24 hours, 72 hours, or longer?
- Which customers, regulators, insurers, employees, or law-enforcement contacts must be notified?
- Has counsel checked sanctions, anti-money-laundering, reporting, and sector rules for the proposed transaction?
- What steps will remove persistence, reset credentials, close the entry path, and monitor for reinfection?
- Who has authority to approve a payment, and how will the decision and assumptions be documented?
Common mistakes that make the situation worse
- Assuming a deadline is real. Criminals use countdowns to create pressure. Preserve the message and verify the technical and legal facts before acting.
- Negotiating before containment. Communications do not replace isolation, evidence preservation, and investigation.
- Restoring too quickly. Bringing infected devices or unverified backups back online can erase evidence and restart the attack.
- Trusting a sample file as proof. A genuine-looking sample does not establish the full scope of exfiltration or prove that deletion will follow payment.
- Using an unvetted intermediary. Cryptocurrency brokers, “recovery” offers, and anonymous negotiators can add fraud, sanctions, or evidence-handling risks. Use independently qualified professionals and document who is acting for you.
- Keeping the incident secret from authorities. Reporting can support investigations, identify decryptors, and help assess legal duties; it is appropriate whether or not money is transferred.
- Treating payment as closure. After any decision, continue forensic review, credential resets, vulnerability remediation, monitoring, and required notifications.
If the incident affects one person’s computer
Official payment-decision guidance is mainly written for organizations. An individual should not infer from a ransom note that paying will recover personal files or prevent publication. Disconnect the device from networks, avoid deleting evidence, contact current local authorities, and seek qualified technical support. Check whether offline or cloud backups exist, and do not install an unverified decryptor. If identity documents, financial records, or health information may have been taken, ask relevant institutions and authorities about protective steps.
What official guidance actually concludes
The NCSC, the FBI, and CISA converge on the practical position: payment is not endorsed, has no guaranteed result, and should not replace reporting, evidence preservation, containment, clean restoration, and investigation. Joint UK guidance also states, “The ultimate decision whether to pay the ransom is with the victim.” NCSC, ABI, BIBA and IUA guidance

There is no official statistic that can reliably predict a particular victim’s chance of successful decryption, data deletion, or legal safety after payment. Historical loss totals or general incident counts cannot substitute for an assessment of this incident’s backups, compromise, data, jurisdictions, and recovery options.
Guidance and laws change as ransomware tactics, sanctions lists, and reporting rules change. During an active incident, recheck current agency notices and obtain advice specific to the victim’s location, sector, and facts.
