There is no settled answer in the legal scholarship: arguments for sexual autonomy and freedom of enterprise compete with concerns about equality, dignity and social harm. A sound answer also depends on what counts as a “sex robot,” what the device depicts or does, and which country’s law applies. The case for a blanket ban is not established by the sources discussed here; nor do they show that every use or product should be unregulated.
What counts as a sex robot?
The label matters because different products can raise different legal questions. Legal scholar Rigotti distinguishes sex robots from sex toys and pornography. An interactive machine, a non-interactive device and expressive material are not necessarily equivalent for purposes of regulation.

That distinction affects the debate from the outset: rules aimed at machines may not fit a toy or a depiction, while laws governing sexual material may not automatically cover a physical device. The sources reviewed do not establish one universal legal definition that resolves these boundaries.

Why do experts disagree about whether they should be legal?
The case for allowing them
Supporters can point to sexual autonomy: adults’ freedom to make private choices about sexuality. The legal discussion also identifies manufacturers’ freedom of enterprise as a relevant interest. Those interests weigh against restrictions that are broader than needed to address a specific harm.

The case for restrictions
Critics and regulators may be concerned that some designs or uses express gender inequality, objectification or social subordination. These are arguments about dignity and equality, not proof that a particular device causes a particular social outcome. Rigotti’s analysis considers a limited role for criminal law alongside measures directed at underlying social causes, rather than treating prohibition as the only response.
Harm reduction rather than an all-or-nothing rule
A chapter in The Oxford Handbook of Sex, Love, and Romance with Robots argues for harm reduction. Its reasoning is that machines understood to be machines cannot themselves be morally harmed, while the ways they are produced, distributed and used may still raise ethical concerns. That position does not mean every product or practice is harmless; it shifts attention toward the humans and social conditions involved.

These arguments do not settle the policy choice. They do show why the question is better treated as a set of choices about product categories, conduct and safeguards than as a single yes-or-no rule.

Frank and Nyholm ask whether consent between a human and a robot is conceivable, possible and desirable. The question is unresolved in the scholarship described here. It should not be confused with a claim that robots have legal consent rights: the cited work does not establish that law grants them such rights.

The debate also includes a symbolic concern: whether interactions that simulate non-consent could affect human norms. That is an ethical question raised by scholars, not an established empirical finding in the sources discussed here. It is therefore a reason for careful debate, not by itself evidence that a specific restriction would prevent harm.
What does the law currently say?
There is no single global rule to report. Most of the cited material is legal and ethical scholarship, not a comprehensive survey of enacted law. The examples below are limited in scope and should not be read as legal advice or as a complete account of current law.

United States: scholarly analysis and a proposed bill
Marchant and Climbingbear analyze the US legal system and predict constitutional obstacles to some outright restrictions. They also discuss enforcement limits where conduct is characterized as victimless, and argue that prostitution laws may not reach a robot brothel if the activity does not qualify as prostitution. These are the authors’ legal analysis and predictions, not court holdings or a rule applying everywhere.

The introduced text proposes amending federal law to prohibit importation or transportation of child sex dolls. That establishes what the proposal said when introduced; it does not establish that the proposal became law or its later disposition.

Indonesia: a dated country-specific account
A 2023 scholarly article on Indonesia said the devices were not freely sold there in the account it presented. It discusses possible impacts on users and psychological benefits, as well as religious values, decency and existing law. This is a dated discussion of one jurisdiction, not a current legal determination for Indonesia or a guide to other countries.
Child sex devices are a separate legal question
A 2019 Medical Law Review abstract reports that authorities in the UK and US had taken steps to outlaw child sex devices. The abstract does not provide a complete account of the laws’ precise scope, exceptions or current status. It cannot support a broader claim that all sex robots are prohibited in either country.

A defensible approach would avoid treating every product and use as interchangeable. It would need to identify the harm a rule is intended to prevent, assess whether the rule addresses that harm, and account for the relevant liberty and equality interests. Depending on the jurisdiction, policy makers may consider prohibition, narrower restrictions or less punitive measures; the scholarship does not yield one settled model.

- Specify the conduct: separate rules about manufacture, sale, importation, use and commercial venues, since they raise different questions.
- State the justification: explain whether a restriction is aimed at protecting people, addressing equality concerns or another identified interest, rather than assuming that ethical discomfort alone establishes legal necessity.
- Keep the jurisdiction clear: constitutional rules, criminal statutes and enforcement practices differ, and the cited scholarship does not provide a country-by-country legal survey.
These are policy considerations, not a description of a uniform law already in force.
