The U.S. Senate passed the Health Care Cybersecurity and Resiliency Act by unanimous consent on October 2, 2026. The proposal would combine grants and training for health care organizations with stronger federal coordination, rural-provider guidance, changes to breach reporting, and future updates to HIPAA-related security rules. It is not law: the Falls Church News-Press reported that it was sent to the House, where it must pass before it can go to the president.

What the Senate passed—and what happens next

The measure is the Health Care Cybersecurity and Resiliency Act, announced by lead sponsor Sen. Mark Warner and co-sponsors Sens. Bill Cassidy, Maggie Hassan, and John Cornyn. The Senate approved it by unanimous consent, which is distinct from passage in a recorded roll-call vote. The sponsors’ announcement describes Senate action on October 2, 2026. Sen. Senate passage is one step in the legislative process, not enactment. The Falls Church News-Press reported that the bill was sent to the House. It would need House passage before it could be sent to the president. The available reporting does not establish what the House did after October 2, 2026. Falls Church News-Press report

What the bill would do

The sponsors’ summary and linked draft bill text describe a package aimed at prevention, preparedness, and recovery—not a single cybersecurity tool or consumer protection program. Its provisions would involve federal agencies, health care organizations, and future regulatory work.

Coordinate HHS and CISA

The draft would require the Department of Health and Human Services (HHS) and the Cybersecurity and Infrastructure Security Agency (CISA) to coordinate and share health-sector resources and threat information. It also assigns HHS cybersecurity oversight responsibilities and calls for an HHS incident-response plan. That plan would address risk assessment, prevention, detection, limiting damage, protecting data, and recovery. Linked bill text

Offer grants, training, and rural guidance

The proposal would authorize HHS to award grants at its discretion to eligible entities. Applicants described in the draft include certain public or nonprofit health centers, Indian Health Service facilities, hospitals, cancer centers, rural health clinics, academic health centers, and certain nonprofit partners. The text does not guarantee that any organization would receive funding.

Propose specific HIPAA-related security updates

The draft directs HHS to update privacy, security, and breach-notification regulations for entities covered by HIPAA. Proposed minimum requirements include multifactor authentication (MFA), safeguards to encrypt protected health information, and audits that include penetration testing. HHS could set other minimum standards as well.

These are proposed regulatory changes, not security requirements already in force because of Senate passage. HHS would need to carry out the direction through future regulatory updates if the bill became law. Linked bill text

Change breach reporting

The proposal would update the public breach-reporting portal and breach-reporting process. That provision sits alongside the incident-response planning and security-rule provisions: it concerns how breaches are reported and made visible, rather than replacing the need for prevention and recovery measures. Why the bill addresses health care cybersecurity

In a December 4, 2025 release, Warner’s office said that “last year” there were more than 730 cyber breaches affecting over 270 million Americans. The office also said that more than 190 million people’s data was exposed in the Change Healthcare attack. These are figures attributed to Warner’s office and its 2025 release, not independently verified figures in the legislative announcement. Warner’s December 4, 2025 release

The sponsors framed the stakes in terms of patient care and privacy. Warner said cyberattacks on health care systems can have life-or-death consequences and put sensitive information at risk; Cassidy said attacks can shut down hospitals and expose medical records; and Cornyn said patients should be able to trust that online medical data is protected. These are statements by the bill’s sponsors, not independent expert assessments. Sen. Warner’s announcement

Do not confuse it with Warner and Wyden’s separate proposal

A different measure, the Health Infrastructure Security and Accountability Act, was reintroduced by Sens. Mark Warner and Ron Wyden on September 17, 2026. It is not the Senate-passed Health Care Cybersecurity and Resiliency Act. The Warner-Cassidy-Hassan-Cornyn measure described here passed the Senate and combines grants, agency coordination, rural guidance, training, breach-reporting changes, and proposed regulatory updates. Warner and Wyden’s separate proposal is described by its sponsors as establishing minimum standards and includes its own audit and funding provisions. Warner and Wyden’s proposal

Details from the Warner-Wyden proposal—including any funding figures—should not be attributed to the Senate-passed act. The linked bill text for the Senate-passed measure is a draft with an unfilled bill number and introductory placeholders, so it should not be treated as final statutory text. Linked bill text
