On Sept. 30, 2026, the U.S. Senate voted 57-43 against advancing the Ratepayer Protection Act. That is short of the 60 votes needed to move forward. The House had passed the measure 417-3 two weeks earlier, according to the Associated Press. The bill was meant to keep the cost of powering AI data centers from landing on ordinary electricity customers. “Kills” is headline shorthand. This was a failed procedural vote, not a final ruling on the policy. The bill also never promised a specific cut to anyone’s bill.
What the vote did and didn’t decide
The Senate did not pass or reject a finished law on the merits. It fell 3 votes short of the 60 needed to advance the House-passed bill. The Congressional Record identifies the measure as S. 5028, and sponsor Sen. Jon Husted (R-Ohio) said the Senate was considering the House-passed version.

The sources reviewed also don’t establish that the bill would have lowered rates. They describe a proposed mechanism and a failed vote. They don’t show a quantified saving, and they don’t show that the vote itself raised anyone’s bill.

Timeline: from introduction to the 57-43 vote
| Date (2026) | Event |
|---|---|
| June 18 | FERC said it had ordered all six regional grid operators to justify existing tariffs or file reforms for data centers and other large users. This is a separate process from the bill (see below). |
| July 16 | Husted introduced the Ratepayer Protection Act, according to his office. |
| Sept. 16 | The House passed it 417-3 (AP; Husted’s office). |
| Sept. 17 | Husted sought unanimous consent to pass the bill, and a Democratic senator objected. Sen. Martin Heinrich (D-N.M.) then asked for consent on his competing GRID Savings Act, and a Republican senator objected. |
| Sept. 30 | The Senate vote to advance the bill failed 57-43, with 60 required (AP). |
The Sept. 17 objections and the Sept. 30 vote were separate Senate actions. The first was a bid to pass the bill by unanimous consent. The second was a roll-call vote that needed a 60-vote threshold.

What the Ratepayer Protection Act would have done
The bill targeted “who pays for grid upgrades” when a large-load customer, such as an AI data center, connects to the grid. Husted described the core requirement this way on the Senate floor: “The Ratepayer Protection Act would require state utility regulators to consider standards, ensuring that large load customers pay the full, incremental cost of the infrastructure needed to serve them.”
Husted also said that standards regulators consider could include financial assurances. These would protect customers and communities from stranded costs if a planned project were delayed or abandoned.

The key word is “consider”
AP summarized the bill as requiring regulators to consider adopting a federal standard. It did not set a flat command that data centers must cover every cost. The two sides read that design differently:

- Husted’s framing: the bill would make states confront the issue and help prevent cost shifting. In his words, “The company that is creating enormous new demands for electricity should pay the costs required to serve them.” His office said the aim was to protect families and small businesses from footing infrastructure costs for new data centers.
- Democrats’ framing: a consider-only standard is a suggestion, not an enforceable obligation.
Supporters’ goals are stated aims, not measured outcomes.

Why Democrats voted against advancing it
The objection was mostly about enforceability, not about whether data centers should pay.
- Heinrich said the bill relied on voluntary action: “It’s not enough for us to tell states to consider making data centers pay for grid upgrades.” He added: “Rather than voluntary pledges or suggestions to states, Congress needs to pass real legislation with real teeth.” His remarks also raised community concerns beyond cost allocation.
- Sen. Chris Van Hollen (D-Md.) said: “Unfortunately, instead, Republicans put forward a bill with no teeth – and provided no guarantees that we would consider my amendment to this bill.” His alternative is the Power for the People Act.
AP framed the vote as an election-year clash over how to answer voters’ worries about data centers and higher electricity bills. The political context is real. Even so, the policy gap is concrete: a standard regulators must consider versus a mandatory cost obligation.

How the competing proposals differ
Heinrich and Van Hollen backed different Democratic alternatives, and they shouldn’t be treated as one bill. The coverage reviewed supports a clear contrast on one axis, mandatory versus consider-only. It does not give enough bill-text detail to compare every feature, so the other cells say “not stated.”

The price figures Heinrich cited
In his floor remarks, Heinrich attributed price-impact estimates to the Federal Reserve Bank of Dallas. He cited increases of 2–6%, a projected 20–30% by 2028, and $840 per year per family in the mid-Atlantic within two years. These are his statements. The underlying Dallas Fed material was not independently reviewed, so treat them as a senator’s characterization, not verified findings. They are also not an estimate of what this bill would have saved.
A separate track: FERC’s large-load orders
The Senate vote isn’t the only federal action on data-center power costs. On June 18, 2026, FERC said it had ordered all six regional grid operators to justify existing tariffs or file reforms for data centers and other large users. The areas it listed were:
- preventing cost shifting and increasing transparency into transmission costs;
- accommodating co-location and behind-the-meter generation;
- new service for flexible large loads;
- processes to study generation that serves large loads.
FERC described tailored orders rather than one-size-fits-all rules. That process runs independently of the failed bill, so the Senate outcome does not end federal attention to the issue. The sources reviewed don’t say how the regional filings will turn out or when.

Nothing changes automatically. The failed vote did not repeal or add any rule. State regulators already decide how utilities allocate costs for new large customers, and they will keep doing so. FERC’s regional proceedings are the main federal action still in progress. The sources reviewed state no next Senate vote on the Ratepayer Protection Act, and no scheduled action on the Democratic alternatives. Bill and tariff status can change quickly, so check Congress.gov and FERC’s site for the latest.
