Section 73, Section 74 and Section 74A are not interchangeable GST provisions. The first two apply to older tax periods and are separated mainly by the alleged conduct: Section 73 covers non-fraud cases, while Section 74 covers fraud, wilful misstatement or suppression of facts to evade tax. The 2024 transition moves demands for financial year (FY) 2023-24 onward into the new Section 74A framework, which uses a common limitation approach but still treats fraud-related and non-fraud cases differently for payment and penalty.

The financial year to which the tax demand relates is therefore the first classification question. The date on which a notice is issued is important, but it does not by itself decide whether Section 73, 74 or 74A applies.

Section 73 vs Section 74 vs Section 74A at a glance

Provision Conduct alleged Tax period orientation Timing framework Penalty and payment approach
Section 73 Tax not paid or short paid, erroneous refund, or input tax credit (ITC) wrongly availed or utilised for reasons other than fraud, wilful misstatement or suppression of facts to evade tax. Periods through FY 2022-23 under the 2024 transition. The GST Council’s 2024 agenda describes a three-year limit for the order and notice at least three months before the order deadline. Non-fraud treatment, including a pre-notice tax-and-interest route subject to the operative subsection and conditions.
Section 74 The same categories of tax or ITC dispute where fraud, wilful misstatement or suppression of facts to evade tax is alleged. Periods through FY 2022-23 under the 2024 transition. The GST Council’s 2024 agenda describes a five-year limit for the order and notice at least six months before the order deadline. Fraud-related treatment with a higher penalty framework and separate payment windows in the Act.
Section 74A Demand framework for the relevant period whether or not fraud-related grounds are invoked. FY 2023-24 onward under the transition framework. A common time-limit structure applies to fraud and non-fraud cases; the exact calculation must be made from the current subsection and applicable notifications. Payment and penalty still vary according to whether the case involves fraud-related grounds. Exact tiers and windows must be checked in the current text.

The transition is described in Agenda Item 3(iv) of the 53rd GST Council meeting. Section 74A was inserted by section 134 of the Finance (No. 2) Act, 2024 and commenced on 1 November 2024, as recorded in the consolidated Central Goods and Services Tax Act.

Why the financial year comes before the allegation

Section 74A’s commencement date and the financial year of the transaction answer different questions. The provision came into force on 1 November 2024, but the transition framework assigns Section 74A to supplies, returns, credits and refunds relating to FY 2023-24 onward. Earlier periods remain within Sections 73 or 74, depending on the conduct alleged.

For example, a demand concerning FY 2022-23 does not become a Section 74A matter merely because the notice was issued after 1 November 2024. Conversely, a demand concerning FY 2023-24 is oriented to Section 74A even though the relevant transactions occurred before the provision commenced. The notice should identify the tax period and the legal provision relied upon; if those do not match, the mismatch is a point to raise in the reply.

Taxpayers with more than one year in dispute should classify each year separately. A single notice can contain different financial years, but the transition rule means the legal route may differ by year. The period classification should be documented before analysing limitation, alleged conduct or payment options.

What Section 73 covers

Non-fraud grounds

Section 73 applies when tax was not paid or was paid short, a refund was issued erroneously, or ITC was wrongly availed or utilised, and the stated reason is other than fraud, wilful misstatement or suppression of facts to evade tax. The provision is not a general declaration that the taxpayer made no mistake. It is the statutory route for a demand where the department does not rely on those specified fraud-related grounds.

An error in a return, an eligibility dispute over ITC, a classification disagreement or a reconciliation difference can fall within Section 73 if the notice is framed without the required fraud, wilful-misstatement or suppression allegation. Whether the evidence actually supports the department’s chosen ground is a case-specific issue.

Payment before a notice

The Section 73 framework provides a route for paying the identified tax and applicable interest before a notice is served, subject to the conditions and time limits in the current Act. The practical benefit is that a taxpayer can address an accepted short payment without waiting for adjudication. A payment does not automatically validate every calculation in a notice or prevent a dispute about amounts that remain contested; the payment’s legal effect depends on the subsection used and the facts.

Penalty exposure

Section 73 has a different penalty structure from Section 74. The applicable amount and reduction, if any, depend on the stage at which tax and interest are paid and on the wording in force for the relevant proceeding. Do not import Section 74’s fraud-related penalty assumptions into a Section 73 case, and do not assume that selecting Section 73 eliminates all penalty issues.

What Section 74 covers

Fraud, wilful misstatement or suppression to evade tax

Section 74 is the demand route when the department alleges that the non-payment, short payment, erroneous refund or wrongful ITC resulted from fraud, wilful misstatement or suppression of facts to evade tax. Those words describe the statutory grounds; they are not a finding that fraud has already been proved.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

A notice may invoke Section 74, but the taxpayer can challenge whether its factual allegations establish the required elements. The reply should identify the specific conduct said to constitute fraud, the statement said to be wilfully false, or the information allegedly suppressed with an intention to evade tax. A bare label without a coherent factual explanation can be contested, while a detailed allegation supported by records requires a substantive response.

Payment and reduced penalty routes

The Act gives Section 74 cases staged payment opportunities, with different consequences before notice, after notice and after an order. The percentage reductions and precise deadlines are statutory details that can change through amendments or notifications, so they must be read from the current consolidated provision for the tax period and proceeding. Paying an amount simply because a notice uses Section 74 can waive practical options if the payment is not made under the correct statutory route.

Longer older-period limitation

For the older Section 73/74 framework, the GST Council agenda describes a five-year period for passing a Section 74 order, compared with three years for a Section 73 order. The notice must be issued at least six months before the Section 74 order deadline under that framework. These are framework descriptions, not a substitute for calculating the deadline in an individual file. The relevant return date, refund, credit, extensions, exclusions and transitional notifications must be checked.

What Section 74A changes

One framework for FY 2023-24 onward

Section 74A was created for demands relating to FY 2023-24 onward. Unlike the older split, the provision is designed to apply regardless of whether the department invokes fraud, wilful misstatement or suppression of facts. This does not make every case a fraud case. It means the same demand provision is available for both categories of allegation, while the consequences within that provision differ.

Common limitation approach, different consequences

The policy change combines the time-limit framework for fraud and non-fraud demands. The GST Council’s 54th meeting material reproduces Section 74A clauses and shows that payment and penalty treatment remains differentiated. In broad terms, the pre-notice non-fraud route concerns tax plus interest, whereas the fraud-related route also involves a penalty. The exact subsection, payment window, penalty percentage and reduction must be verified in the current Act and any notification applicable to the case.

Because Section 74A is new relative to the older proceedings, a notice should be tested against four separate questions: does it concern FY 2023-24 or later, does it identify the correct tax or return period, does it explain the alleged conduct, and does its limitation calculation use the operative Section 74A rule? The commencement date of 1 November 2024 is only one of those checks.

Why exact Section 74A figures should not be guessed

The reproduced Council material establishes the common framework and the broad distinction in payment and penalty, but it does not establish every tier, post-notice window or interaction with later notifications. A taxpayer should obtain the current consolidated subsection text and the notification history before relying on a particular amount or date. An apparently small difference in the stage of payment can change the penalty outcome.

Notice and order deadlines under the older framework

The following summary reflects the framework described in the GST Council’s 2024 agenda. It is not an automated limitation calculation.

Question Section 73 Section 74
Order period described by the Council agenda Three years Five years
Minimum advance notice before the order deadline At least three months At least six months
Period to which the framework is oriented Through FY 2022-23 Through FY 2022-23
What must be calculated in a live case Relevant tax period, statutory starting point, exclusions, extensions and service date. The same items, plus the Section 74 allegations and any provision affecting the longer period.

The agenda’s “three years,” “five years,” “at least three months” and “at least six months” are statutory-framework descriptions attributed to the Goods and Services Tax Council, not empirical statistics. A proper calculation must use the exact return, refund or credit event and the current law. A notice arriving close to an apparent deadline should not be ignored on the assumption that the headline period alone proves limitation.

How to classify a GST demand notice

  1. List every tax period. Record the financial year, return period, refund period or ITC period for each line item. Separate FY 2022-23 and earlier from FY 2023-24 onward.
  2. Read the provision cited. Note whether the notice invokes Section 73, Section 74 or Section 74A, and whether another provision is cited for recovery, interest, penalty or procedure.
  3. Match the provision to the financial year. Under the 2024 transition, FY 2023-24 onward is oriented to Section 74A, while periods through FY 2022-23 remain in the older Section 73/74 split.
  4. Extract the alleged conduct. For a Section 73 notice, check that the department is proceeding for reasons other than fraud, wilful misstatement or suppression to evade tax. For Section 74, identify the factual particulars supporting each fraud-related allegation.
  5. Reconstruct the limitation calculation. Start from the statutory event identified in the Act, then account for extensions, exclusions, service and any relevant notification. Do not use the notice date as the only input.
  6. Reconcile the amount. Compare taxable value, tax rate, tax already paid, eligible ITC, interest and penalty with returns, ledgers, invoices and prior correspondence. Keep disputed and accepted items separate.
  7. Choose a response route. If an amount is accepted, check whether a payment-before-notice or other statutory route is available. If the ground, period or calculation is disputed, preserve the objection in the written reply rather than making an unqualified payment.
  8. Protect procedural rights. Observe the response date, request relied-upon documents that are missing, attend the hearing if offered or required, and retain proof of filing and payment.

Section 128A: separate relief for certain historic Section 73 demands

Section 128A is not a fourth demand provision and does not change the definition of Section 73. It is a conditional waiver route for qualifying Section 73 demands relating to FY 2017-18, FY 2018-19 and FY 2019-20. The relief concerns waiver of interest or penalty, or both, when the statutory conditions are met and the required tax is paid.

CBIC Circular No. 238/32/2024-GST, dated 15 October 2024, explains eligible procedural stages, full payment of tax and the notified dates. For the cases addressed in the circular, the general full-tax-payment date was 31 March 2025. That date has passed and should not be presented as an open future deadline. The circular also describes a separate six-month period from a specified redetermination order for a particular category.

A taxpayer considering Section 128A should first confirm that the demand is genuinely a Section 73 demand for one of the three specified financial years, identify the procedural stage, verify the tax-payment record and check whether the relevant order falls within the circular’s categories. The waiver is conditional; it is not a blanket cancellation of every interest or penalty connected with those years. Whether any action remains possible now depends on the individual order, payments, applications and any later instructions.

Common classification mistakes

  • Using the notice date instead of the tax year: commencement on 1 November 2024 does not convert an FY 2022-23 demand into Section 74A.
  • Treating a Section 74 label as proof: the department must rely on the statutory fraud-related grounds, and the taxpayer can contest the factual and legal basis.
  • Assuming every ITC dispute is Section 74: wrongful availment or utilisation can be pursued under Section 73 when the specified fraud-related grounds are not alleged.
  • Applying the old three-year or five-year figures mechanically: those figures describe the older framework; a live limitation calculation requires the statutory starting event and all applicable extensions or exclusions.
  • Copying Section 73 or 74 penalty figures into Section 74A: Section 74A has its own clauses and differentiated treatment. Use the current text rather than an old chart.
  • Mixing central and state proceedings: this comparison concerns the CGST Act. A state-level proceeding also requires checking the applicable SGST legislation and notifications.
  • Paying without preserving objections: payment can have different legal effects depending on the subsection and stage. Record whether an amount is admitted, paid provisionally or disputed.

What records to assemble before replying

A reliable response begins with a period-by-period file rather than a single total. Assemble the relevant returns, electronic liability and credit ledgers, purchase and sales registers, invoices, e-way or other movement records where relevant, refund applications, payment challans, reconciliations and prior departmental correspondence. Mark each document with the financial year and issue it supports.

Prepare a schedule with separate columns for tax proposed, tax already paid, ITC involved, interest, penalty, the department’s reason, the statutory provision and the limitation date asserted. This makes it easier to identify whether one notice combines Section 73 and Section 74 reasoning for different items or years. Keep a copy of the notice, annexures, electronic service record, reply, acknowledgement and hearing communications.

Where the notice depends on records not supplied, request them promptly and state why they are needed to answer the allegation. Where the dispute turns on intent, explain the commercial process, controls, contemporaneous records and corrections that bear on whether fraud, wilful misstatement or suppression to evade tax can properly be alleged. A factual explanation is more useful than simply asserting that the case is “not fraud.”

When professional advice is warranted

Consider case-specific GST or tax-litigation advice when the notice alleges fraud, covers several financial years, involves a large ITC or refund amount, arrives near a limitation date, combines central and state legislation, or offers a payment route with a reduced penalty. The adviser should work from the current consolidated Act, the relevant notifications and the complete procedural history—not from a generic Section 73-versus-74 chart.

This article explains the statutory distinction and transition. It does not determine whether a particular notice is valid, whether limitation has expired or whether a taxpayer qualifies for a waiver. Those conclusions require the notice, records, dates and applicable law for the individual case.
