Yes, goods can be detained under Section 129 of the Central Goods and Services Tax (CGST) Act when they are transported or stored in transit in contravention of the Act or its rules. A missing or invalid e-way bill can therefore expose the consignment and conveyance to detention or seizure. However, Circular No. 64/38/2018-GST says proceedings under Section 129 may not be initiated for specifically listed minor discrepancies when the consignment is accompanied by both the required invoice (or other specified document) and an e-way bill. A typo is not automatically harmless, and the circular does not excuse every mismatch.
The outcome depends on the exact error, the documents carried, the movement route, the stage of the officer’s action and the current text of Section 129. The explanation below is based on official CBIC material checked on 13 October 2026; the 2018 circular must be read with later amendments, applicable State or Union Territory law and relevant court decisions.

What Section 129 covers
Section 129 applies when goods are transported or stored while in transit in contravention of the CGST Act or the rules made under it. The proper officer may detain or seize the goods and the conveyance used to move them. An e-way bill is part of the prescribed movement documentation, so the absence of one, an invalid bill or a material inconsistency can be treated as a contravention.

It is an enforcement measure used while the goods are in transit. The officer must examine the documents and facts, and the taxpayer or transporter has an opportunity to respond through the statutory procedure.

Why an e-way bill error matters
An e-way bill links the consignment to its invoice or other specified document, the consignor and consignee, the goods, the route and the vehicle. If the bill is missing or cannot validly cover the movement, the officer may regard the goods as moving contrary to the rules. The invoice by itself does not always cure the problem.
The 14-day point in the current displayed text
The CBIC’s currently displayed Section 129 page states that further proceedings under Section 130 are initiated if the statutory tax and penalty are not paid within 14 days of detention or seizure. Because Section 129 has been amended over time, do not rely on an old article for payment amounts, release conditions or deadlines. Check the version of the Act in force on the date of the interception and the notice actually served.
Can goods be detained for an e-way bill mistake?
There are two fundamentally different situations: a missing or substantively invalid e-way bill, and an e-way bill that contains one of the limited discrepancies identified as minor by Circular No. 64/38/2018-GST dated 14 September 2018.

| Invoice or other specified document is present, but there is no e-way bill | Section 129 proceedings may be initiated. | Carrying an invoice does not automatically replace the e-way bill requirement. |
| Both the invoice (or other specified document) and an e-way bill are present, and the discrepancy fits a listed minor-error example | Proceedings under Section 129 may not be initiated, subject to the circular’s conditions. | The officer must still check that the error is within the stated example and that the supporting documents are consistent. |
| E-way bill is invalid for a material reason, or the discrepancy falls outside the listed examples | The minor-error protection does not apply on the face of Circular 64. | Detention risk remains and the facts must be dealt with under the current Act, rules and applicable decisions. |
The circular uses the words “may not be initiated,” not an absolute prohibition on every possible detention. It also requires the supporting invoice or specified document and an e-way bill. A business should therefore avoid arguing that any typo is automatically protected.

Which e-way bill errors count as minor?
Circular 64 lists examples in which Section 129 proceedings may not be initiated when the consignment has both required documents. The examples are narrow and conditional.
Names with a spelling mistake
A spelling mistake in the consignor’s or consignee’s name is listed where the GSTIN is correct. The correct GSTIN is important because it identifies the registered person despite the textual spelling error. A wrong GSTIN, a different taxable person or an unexplained change of party is not the same situation.
PIN-code mistakes
Certain PIN-code errors are covered when the correct address is stated and the error does not extend the e-way bill’s validity. The circular’s condition prevents a party from using a wrong PIN code to create a longer period of validity or to disguise a different destination.
Limited consignee-address errors
A limited error in the consignee’s address may fall within the clarification when the locality and other relevant details are correct. The protection is not a licence to omit the destination or substitute a different place of delivery.

One or two wrong digits in the document number
The circular includes an error of one or two digits in the invoice or other document number. The discrepancy should remain a recognisable, limited digit error; a completely different document number or a mismatch that prevents the officer from linking the papers is materially different.
Specified HSN-code errors
For the specified four- or six-digit HSN cases, the circular requires that the first two digits and the tax rate are correct. The first two digits identify the relevant broad chapter, while the tax rate helps show whether the classification error changed the tax treatment. A wrong first-two-digit prefix or a different tax rate is outside this stated example.
One or two wrong characters in the vehicle number
The circular lists one or two incorrect characters in the vehicle number. The officer still has to be able to connect the e-way bill to the vehicle and movement. A vehicle number that identifies an entirely different vehicle, or a vehicle substitution with no amendment record, should not be assumed to be a protected typo.
What is not automatically minor
- No e-way bill where the movement requires one.
- Missing Part B information for a road movement, subject to the limited 50-kilometre exception described below.
- A wrong GSTIN, tax rate, document identity or destination that changes the transaction’s substance.
- An error that does not fit one of Circular 64’s listed categories or conditions.
Part B, vehicle details and the 50-kilometre exception
Circular 64 states that omission of Part B information generally makes an e-way bill invalid for road movement. It describes an exception for goods transported up to 50 kilometres within the same State or Union Territory, when the movement is to or from the transporter’s place of business to the consignor’s or consignee’s place of business.

- Please Note: To reach 10Gbps speed, keep the cable under 3.3 ft. For USB A Male to USB C adapters, try flipping the USB C connector. USB C Male to USB A adapters support bidirectional 10Gbps transfer within 3.3 ft
The exception is route-specific. It should not be expanded to an inter-State trip, a longer movement or a route that does not begin or end at the transporter’s place of business. Before relying on it, record the actual kilometres, State or Union Territory and the relevant consignor, consignee and transporter locations.
How detention proceedings work after interception
Circular No. 41/15/2018-GST describes a documentary process for interception and inspection. The procedure must be read with current statutory amendments and the rules in force at the time.
- Verification: The proper officer checks the transport documents, including the invoice or specified document, e-way bill, vehicle details and the goods.
- Statement and inspection record: The person in charge may be asked to give a statement. The officer records the inspection through the prescribed forms and prepares an inspection report.
- Inspection timing: The circular provides for conclusion of the inspection within three working days, subject to a written extension. Keep the date and time of interception and ask for any extension to be recorded in writing.
- Detention order: If the officer considers detention appropriate, the circular describes issuance of FORM GST MOV-06.
- Notice: FORM GST MOV-07 specifies the tax and penalty proposed in relation to the detained goods and conveyance.
- Objections: The owner, transporter or other affected person can submit the relevant documents and objections. The authority should consider the response before passing a reasoned, or speaking, order.
- Release: Release follows payment under the applicable statutory route or furnishing eligible security, depending on the current law and the order.
- Unpaid demand: The current CBIC display states that unpaid statutory tax and penalty can lead to further Section 130 proceedings after 14 days from detention or seizure.
The forms and deadlines on a notice control the immediate response. A transporter should not assume that a telephone assurance, an amended e-way bill generated later or a private settlement replaces a written order.

What to do if your goods are detained
1. Secure the complete movement file
Collect the invoice or other specified document, e-way bill in its original and amended versions, vehicle registration and driver details, transporter details, route plan, loading and delivery records, purchase or sales order and any correspondence explaining the discrepancy. Preserve the electronic files as well as printouts.

2. Identify the exact discrepancy
Write down the field that is wrong and compare it character by character with the invoice and the e-way bill. Classify it against Circular 64’s examples: name spelling with correct GSTIN, qualifying PIN-code or address issue, one or two document-number digits, qualifying HSN error or one or two vehicle characters. Do not describe a material mismatch as a typo merely because it is inconvenient.
3. Check the document conditions
Confirm that both the invoice or specified document and an e-way bill accompanied the consignment. If Part B is incomplete, calculate the actual distance and test the movement against the precise 50-kilometre same-State or Union Territory exception.
4. Read every form and deadline
Note whether you received an inspection record, MOV-06 detention order or MOV-07 notice, and record the date of service. The notice should show the officer’s stated contravention and proposed tax and penalty. Prepare a written response that attaches the matching documents and explains why the facts fit, or do not fit, the circular.

5. Seek release through the correct route
Where the current statute permits release on payment or security, use the prescribed process and obtain receipts and the release order. The amount and form of security depend on the law and notice applicable to the case; do not copy figures from an older version of Section 129.
6. Escalate a disputed or high-value detention
For a substantial consignment, a repeated detention, a disputed classification or a notice threatening Section 130 action, obtain advice from a GST professional familiar with the relevant State or Union Territory practice. The central circular does not decide every factual question, and no general success rate or prevalence figure is established.
Penalty for the listed minor errors
Circular 64 directs a penalty of Rs. 500 under the CGST Act and the respective State GST Act, or Rs. 1,000 under the IGST Act, for each consignment in the listed minor-error situations. It describes recording that penalty in FORM GST DRC-07. These are figures stated in the 2018 circular, not a substitute for checking later amendments, notifications, binding rulings or the wording of the order served in a particular case.
| Movement or tax split | Amount stated by Circular 64 for a listed minor error | Qualification |
|---|---|---|
| CGST plus the respective State GST Act | Rs. 500 | Per consignment; only for the circular’s listed circumstances and document conditions. |
| IGST Act | Rs. 1,000 | Per consignment; verify the current legal treatment before payment. |
Common mistakes in arguing an e-way bill case
- “There was an invoice, so detention is impossible.” Circular 64 specifically says proceedings may be initiated when an invoice is present but the required e-way bill is absent.
- “Any one-character error is protected.” The clarification lists particular fields and limits, not every possible field or combination of errors.
- “Part B can always be left blank.” The circular treats Part B omission as generally invalid for road movement, with only the stated 50-kilometre exception.
- “A corrected e-way bill erases the interception.” A later correction may help explain the facts, but it does not automatically cancel a notice or order already issued.
- “The 2018 amounts and deadlines are permanent.” Section 129 has changed. Use the current Act, rules and forms, not an undated online summary.
- “The circular guarantees release.” Its wording is that proceedings may not be initiated in specified situations. The officer still evaluates the documents and facts, and later law or a court ruling may affect application.
A practical decision checklist
- Was the consignment in transport or stored in transit when intercepted?
- Was an invoice or other specified document physically or electronically available?
- Was there a valid e-way bill for the actual goods, parties, route and vehicle?
- If Part B was incomplete, does the movement fit the exact same-State or Union Territory, up-to-50-kilometre transporter exception?
- Does the discrepancy match one of Circular 64’s listed minor categories?
- Are the GSTIN, tax rate, first two HSN digits, locality, address and route conditions correct where the circular requires them?
- Which written form has been served, and what response or payment date does it state?
- Have you preserved the original records and obtained proof of any payment, security or release?
Bottom line for businesses and transporters
Section 129 creates real detention risk for goods moving without a required e-way bill or with a materially invalid one. A qualifying clerical error is treated differently only when the consignment has both the supporting invoice or specified document and an e-way bill, and the error fits Circular 64’s narrow examples. The safest response is documentary: carry consistent records, identify the precise field in dispute, answer the written notice promptly and verify the current statutory release and payment rules before acting.
