Lui was arrested on October 1, 2026; the Justice Department announcement describes charges, not a conviction. He is presumed innocent unless and until proven guilty beyond a reasonable doubt.
What is Greg Lui accused of?
The U.S. Department of Justice says a federal grand jury returned an indictment against Lui on September 29, 2026. The indictment alleges that, from 2023 to 2024, Lui—38, also known as Yiu Kong Lui—used Earthmade Computer Inc. and co-conspirators to obtain export-controlled, high-end servers containing U.S.-manufactured GPUs and arrange their shipment to China without required U.S. Commerce Department licenses. DOJ describes Earthmade as based in City of Industry and Lui as a San Gabriel resident. The department calls him the company’s owner, rather than CEO. DOJ announcement, October 1, 2026.

How were the servers allegedly sent to China?
According to the indictment as summarized by DOJ, the group allegedly misrepresented the equipment’s end users and destinations to U.S. manufacturers. The servers were then shipped through Malaysia and Singapore and re-exported to China without the required licenses. DOJ does not identify the server or GPU manufacturer, brand, or model, so no particular hardware can be tied to the allegations.

DOJ says Lui submitted a purchase order to a U.S. manufacturer in January 2024 for 27 servers valued at approximately $7,614,000. The indictment further alleges that in March 2024 a co-conspirator emailed a Malaysian government official saying those servers had been transshipped to a buyer in China. These are allegations described by prosecutors, not independently established findings.

What amounts does the indictment cite?
- More than $300 million: DOJ says this is the value of the export-controlled servers the indictment alleges were smuggled to China.
- More than $176 million: The indictment alleges that two Malaysia-based shipment companies paid this amount to Lui between January and October 2024. It should not be treated as proven proceeds.
- Approximately $7,614,000: DOJ gives this as the value of the January 2024 order for 27 servers.
What charges does Lui face?
The indictment contains three counts, according to DOJ:
- Conspiracy to violate the Export Control Reform Act and Export Administration Regulations.
- Outbound smuggling.
- Conspiracy to commit money laundering.
If convicted on all charges, Lui would face statutory maximums of 20 years in prison for the export-control conspiracy count, 10 years for the smuggling count, and 20 years for the money-laundering conspiracy count, DOJ says. These are maximum penalties set by statute, not a prediction of a sentence or likely outcome.

Has Lui been convicted?
No conviction is reported in the DOJ announcement. It says Lui was arrested on October 1, 2026, and was expected to appear and be arraigned the next day in federal court in downtown Los Angeles. The announcement does not establish what happened at that appearance or report a later court outcome. The charges remain allegations, and Lui is presumed innocent unless proven guilty beyond a reasonable doubt.
