Samsung Display has reportedly added a U.S. Patent and Trademark Office challenge to its response to NeoLayer’s patent campaign. ZDNet Korea reported that Samsung Display sought ex parte reexamination of two NeoLayer patents on August 25 and 27, 2026, while NeoLayer is pursuing two separate infringement suits against Samsung entities in the Eastern District of Texas.
What Samsung Display filed
The reported filings are requests for ex parte reexamination of U.S. Patent 8,698,712 and U.S. Patent 8,093,592. The requests challenge the patents’ patentability at the USPTO; they are not a final finding that either patent is invalid.

The filings were attributed to Samsung Display by ZDNet Korea. The report identified August 25 and August 27, 2026, as the request dates. No final USPTO reexamination decision was available in the records reviewed for this report.
How the dispute developed
| Date | Event | What it means |
|---|---|---|
| December 31, 2025 | NeoLayer filed NeoLayer LLC v. Samsung Electronics Co., Ltd. et al., case 2:2025cv01259, in the U.S. District Court for the Eastern District of Texas. | The complaint asserted a patent cause of action under 35 U.S.C. §271 and included a jury demand. The listed defendants were Samsung Electronics Co., Ltd. and Samsung Electronics America, Inc. |
| June 9, 2026 | NeoLayer filed a second Eastern District of Texas case, 2:2026cv00458. | The second complaint again named Samsung Electronics Co., Ltd. and Samsung Electronics America, Inc. |
| August 25 and 27, 2026 | Samsung Display reportedly requested USPTO ex parte reexamination of patents 8,698,712 and 8,093,592. | Samsung added a patent-office patentability challenge alongside the federal-court defense. |
The court complaints name Samsung Electronics companies, whereas the reported USPTO requests are attributed to Samsung Display. Those are related Samsung businesses, but the proceedings should not be treated as one case or as proof that every Samsung entity has the same procedural role.

What the two patents cover
| Patent | Technology described in the August report | Why it matters to the dispute |
|---|---|---|
| U.S. Patent 8,698,712 | OLED pixel-structure technology | It concerns the pixel architecture used in an OLED display rather than a general consumer-device feature. |
| U.S. Patent 8,093,592 | Thin-film-transistor (TFT) technology | Its listed title is “Thin Film Transistor Substrate, Electronic Apparatus, and Methods For Fabricating The Same,” placing the focus on the substrate and fabrication side of display construction. |
Taken together, the reported requests target two foundational layers of a display: the OLED pixel structure and the TFT substrate that drives and controls pixels. That is a broader technical spread than challenging a single model-specific implementation.
What ex parte reexamination does
Under USPTO procedure, a reexamination request asks the agency to reconsider whether issued claims remain patentable in light of patents or printed publications. USPTO Manual of Patent Examining Procedure §2246 says that, if a request is granted, the decision must identify the claims and issues, the relied-on patents or publications, and the rationale for finding a substantial new question of patentability.

- ALL-EXPANSIVE VIEW: The three-sided borderless display brings a clean and modern aesthetic to any working environment; In a multi-monitor setup, the displays line up seamlessly for a virtually gapless view without distractions
- SYNCHRONIZED ACTION: AMD FreeSync keeps your monitor and graphics card refresh rate in sync to reduce image tearing; Watch movies and play games without any interruptions; Even fast scenes look seamless and smooth.
- SEAMLESS, SMOOTH VISUALS: The 75Hz refresh rate ensures every frame on screen moves smoothly for fluid scenes without lag; Whether finalizing a work presentation, watching a video or playing a game, content is projected without any ghosting effect
- MORE GAMING POWER: Optimized game settings instantly give you the edge; View games with vivid color and greater image contrast to spot enemies hiding in the dark; Game Mode adjusts any game to fill your screen with every detail in view
- SUPERIOR EYE CARE: Advanced eye comfort technology reduces eye strain for less strenuous extended computing; Flicker Free technology continuously removes tiring and irritating screen flicker, while Eye Saver Mode minimizes emitted blue light
The threshold decision
The USPTO first decides whether the request raises a substantial new question of patentability. A request being filed is therefore only the beginning. A grant means examination will proceed; it does not by itself cancel or narrow a claim.

The examination limits
MPEP §2258 explains that the claims are examined on the basis of patents or printed publications and that claim scope may not be enlarged during ex parte reexamination. Depending on the examiner’s analysis, claims can ultimately be confirmed, amended, or canceled through the USPTO process, but the available record does not establish which outcome will occur here.

How the USPTO proceedings interact with the lawsuits
The two forums address different questions. The Eastern District of Texas cases concern alleged infringement and the remedies available if infringement is proven. The USPTO proceedings address patentability of the specified claims against the prior-art record considered in reexamination.
- A USPTO decision could change the strength, scope, or enforceability of claims that NeoLayer relies on, depending on the final certificate issued by the agency.
- The reexamination requests do not decide whether a Samsung product infringed, how much money might be owed, or whether a court should award an injunction.
- The reported requests do not show that either patent has already been invalidated. Until the USPTO reaches a final result, the patents remain issued patents subject to the pending court disputes.
Samsung can therefore contest NeoLayer’s rights on two tracks: defending the infringement complaints in federal court while asking the patent office to reassess the asserted claims. The practical value of that strategy will depend on the USPTO’s threshold decision, the prior-art references it accepts, and how the court cases develop.

Where NeoLayer’s campaign fits
Docket and patent-listing information also associates NeoLayer with display-technology cases involving ASUS and BOE, and lists patents 8,093,592 and 8,698,712 in that broader portfolio. That pattern indicates a portfolio-based enforcement campaign involving multiple display companies, not only a single dispute with Samsung.
Samsung Display has previously used different paths in other OLED conflicts. A 2025 report described Samsung Display and BOE agreeing to settle OLED patent and trade-secret lawsuits and withdrawing the ongoing actions. That separate result shows settlement is one possible endpoint in Samsung Display’s broader intellectual-property strategy, but it does not indicate that the NeoLayer cases have settled.

What to watch next
- USPTO institution decisions: The first concrete milestone is whether the office grants either reexamination request and identifies a substantial new question of patentability.
- Claim-by-claim examination: If proceedings begin, the examiner’s treatment of the cited patents and printed publications will show which claims are most exposed.
- Federal-court case development: The Eastern District of Texas dockets will determine how the infringement allegations, discovery, claim construction, and any remedies proceed.
- Resolution or settlement: The cases could end through adjudication, negotiated settlement, or another procedural resolution; no settlement value or damages figure has been established for the NeoLayer dispute.
