Regulators Say Atlantic Coast Life Was Loaded With Private Credit. What’s Actually Known?

South Carolina’s insurance director has asked a court to place Atlantic Coast Life Insurance Company and reinsurer Southern Atlantic Re Inc. into rehabilitation, alleging that risky investments threaten policyholders. As of October 4, 2026, no rehabilitation order had been entered, and the companies disputed the petition. The allegations have not been established by a court.

What did South Carolina regulators allege?

A September 15, 2026, court filing sought state control of Atlantic Coast Life and Southern Atlantic Re through rehabilitation. In its September 16 report, Insurance Journal said South Carolina Insurance Director Michael Wise alleged that the insurers held substantial amounts of high-risk private-credit instruments and unrated collateral loans, with exposure connected to 777 Partners. The petition reportedly also raised concerns about misreporting or disclosure failures.

The regulatory concern, as reported, is that the investments could put the companies’ ability to pay policyholders at risk. These are allegations described in news reports, not findings that the insurers are insolvent, that policyholders have suffered losses, or that anyone committed wrongdoing. The underlying petition and live court docket were not available in the cited accounts, so their summaries should not be treated as a substitute for the filing.

What does the private-credit figure mean?

Insurance Journal reported the petition’s allegation that, at year-end 2025, 30% of Atlantic Coast’s cash and invested assets consisted of sub-investment-grade private-credit instruments and unrated collateral loans. The same report said the investment-management agreements set a 10% limit on private-placement holdings. Both figures are attributed to the regulator’s account of the petition; the 10% figure is an agreement limit, not a statutory cap.

The two figures should not be read as a court-verified measurement of a legal violation. They describe the regulator’s reported characterization of holdings and an agreement limit. The available account does not provide an asset-by-asset schedule or explain how every investment was classified.

How do the reported figures differ?

Figure What it refers to Source and qualification
30% Share of Atlantic Coast’s cash and invested assets said to be in sub-investment-grade private-credit instruments and unrated collateral loans at year-end 2025 Allegation attributed to South Carolina’s insurance director in Insurance Journal, September 16, 2026; not a court finding
10% Limit on private-placement holdings in investment-management agreements Agreement limit described in the petition as reported by Insurance Journal, September 16, 2026; not a statutory cap
17.7% Private credit as a share of portfolio allocations Historical company-profile figure for 2020, published by A-CAP/Atlantic Coast Life on January 4, 2021; not a current audited allocation
Positive 600 to negative 2,000 Change in Atlantic Coast’s risk-based capital ratio associated with the 777 Re failure NAIC meeting material dated August 12, 2025; not a current ratio, and the cited excerpt does not supply the underlying statutory filing

The 2020 company profile’s 17.7% figure provides historical context, not proof of what the portfolio held in 2025 or how the state classified those holdings. Likewise, the NAIC material’s capital figures relate to the 777 Re failure and should not be presented as Atlantic Coast’s current capital position.

What are the relationships among Atlantic Coast, A-CAP and 777 Partners?

Atlantic Coast Life is associated with Advantage Capital Holdings, commonly referred to as A-CAP. A-CAP’s 2020 company profile described Atlantic Coast as part of its company family and said A-CAP acquired the insurer in 2015. Southern Atlantic Re is the reinsurer named alongside Atlantic Coast in the South Carolina petition.

The reports describe exposure or loans tied to 777 Partners. That connection does not, by itself, establish that 777 Partners owned or controlled Atlantic Coast or A-CAP, or participated in alleged misconduct. The NAIC’s reference to Atlantic Coast’s capital shift in connection with the 777 Re failure is regulatory context, not a court determination about responsibility.

Who is to blame, and what happens next?

The available accounts do not establish blame. South Carolina’s director is seeking rehabilitation, while the companies dispute the case; no court had ruled on the petition as of October 4, 2026. A court decision and the companies’ full response would be needed to resolve the contested claims. The cited news accounts do not establish what the court later did.
