Bernstein’s separate assessment is that only roughly 35% of the planned U.S. data-center pipeline has a credible chance of being delivered. Those figures describe a development pipeline, not the amount of computing capacity that will actually reach the grid.
What the 47-plus project count actually measures
RegLayer’s figure is a reported tally of large U.S. projects disrupted during 2026. It includes projects delayed, withdrawn or blocked after community opposition focused on electricity demand, water use and proposed tax incentives. It is not a government census of every project announced in the country, and the “47-plus” wording means the tally is a minimum rather than a final total.

An independent view from Data Center Fights listed 164 projects in 35 states on October 16, 2026. Of those, 36 were classified as blocked, withdrawn or delayed, and 27 states or localities had moratoriums or other limits. Only 30 of the tracked projects had publicly reported capacity, so any megawatt total derived from that tracker is a floor, not a complete estimate.

The two counts are not directly interchangeable. RegLayer’s number covers large projects disrupted during 2026, while Data Center Fights is a broader status tracker with its own inclusion rules and date. Together they show that the political and permitting risks are widespread, even before a project reaches construction.

Why a huge announced pipeline does not equal deliverable capacity
Bernstein applies a probability discount to projects instead of treating every announced megawatt as equally likely. Its October 2026 U.S. headline put the credible share of the planned pipeline at roughly 35%. A separate Bernstein estimate for North America, reported in July, scored 5,324 projects and found 135 GW credible out of a nominal 492 GW, or 33%. The scopes and methods differ, so the two percentages should not be combined into one exact rate.
| Measure | Scope and date | Reported value | How to read it |
|---|---|---|---|
| Credible planned pipeline | United States; Bernstein, reported October 18, 2026 | About 35% | Bernstein’s probability-weighted view of the planned U.S. pipeline |
| Credible pipeline | North America; Bernstein, reported July 2026 | 135 GW of 492 GW, or 33% | A separately scoped assessment covering 5,324 scored projects |
| Total pipeline | North America; Bernstein/Aterio, June 2026 | 337.9 GW | All identified pipeline capacity in that dataset |
| Under construction | North America; Bernstein/Aterio, June 2026 | 63.2 GW | Capacity already in the construction category, not necessarily operating |
| Stranded capacity | North America; Bernstein/Aterio, June 2026 | 38.2 GW, about 11% of the pipeline | Delayed, cancelled, or not approved/withdrawn capacity |
WNT Energy’s report says the 337.9-GW North American pipeline would take about 12 years to absorb at the construction rate observed in June 2026. Its conclusion is that computing demand is growing faster than the power system, equipment supply chain, approval process and engineering workforce can convert plans into available computing power.
How Bernstein decides whether a project is credible
Bernstein’s framework scores more than the size of a site announcement. It probability-weights each project by development stage, tenant or pre-lease quality, the developer’s delivery record and capital, and regulatory risk in the relevant state. Project stage is the largest discount factor, followed by tenant quality.
| Bernstein factor | Stated weight | Evidence a reader should look for |
|---|---|---|
| Power Path | 35% | A documented utility connection, transmission plan and credible energization timetable |
| Capital | 30% | Financing and a budget capable of carrying the project through construction |
| Offtake | 25% | A credible tenant, pre-lease or other evidence that the planned capacity will be used |
| Sponsor Execution | 10% | An experienced developer with a record of delivering comparable facilities |
The weighting explains why a site can have land, a public megawatt figure and an announced tenant yet still receive a low probability: a missing power path or weak capital plan can overwhelm the headline scale.
The bottlenecks pushing projects off schedule
Grid interconnection and transmission
Utilities and regional grids often cannot provide the requested load on the developer’s preferred schedule. A project that has announced capacity but no firm interconnection milestone remains an aspiration rather than available power.

Transformers and other electrical equipment
Long lead times for transformers and related equipment are extending delivery calendars. Axios reported an industry survey in which 44% of data-center leaders said utility wait times exceeded four years. A site can therefore be approved and financed yet unable to energize when its buildings are ready.
Liquid cooling and specialized labor
High-density AI hardware increases demand for liquid-cooling systems. AI Weekly’s summary identified cooling bottlenecks, while Axios also described shortages of specialized cooling and electrical workers. These constraints affect both equipment availability and the ability to install and commission it.
Permits, water and local politics
Community campaigns can trigger hearings, permit delays, moratoriums or withdrawal of a proposal. The disputes often center on water consumption, electricity costs, environmental effects and whether tax breaks justify the public infrastructure required. A project can move backward in status even after a developer has announced a site.
Tenant, financing and execution risk
Projects without a credible offtake agreement, capital plan or experienced sponsor receive steep probability discounts under Bernstein’s method. This is why two facilities with similar nominal megawatt figures can have very different chances of completion.

- Identify the stage. Separate operating facilities from projects under construction, approved projects, announced proposals and land banks. “Announced” is the least informative of those labels.
- Verify the power path. Look for a named utility, an interconnection agreement or study milestone, transmission work and a stated energization date. Without those details, the megawatt figure is not a delivery commitment.
- Check the offtake. Determine whether a tenant or pre-lease is identified and whether the commitment covers the proposed capacity.
- Check capital and the sponsor. Look for a financing plan, construction start, procurement activity and a developer with comparable completed projects.
- Check local and state exposure. Review zoning, permits, water approvals, tax incentives, moratoriums and public hearings. A project facing an unresolved local vote carries a different risk from one with permits in hand.
- Check equipment readiness. Ask whether transformers, switchgear, cooling systems and specialized contractors are scheduled. A building shell alone does not make a data center operational.
The broader U.S. scale behind the disputes
Axios estimated that the United States had about 4,000 data centers, including roughly 580 hyperscale facilities, in 2026. It also reported that at least 75 projects worth approximately $130 billion were politically delayed in the first quarter of the year. That figure covers a different period and set of projects from RegLayer’s 47-plus tally, so it should not be added to it.

At that scale, a local decision affects not only a building but also substations, transmission upgrades, water systems, roads and tax policy. As Axios put it, data centers have become proxy fights over artificial intelligence, jobs, the environment, energy production and energy use.
What the numbers mean for capacity forecasts
The credible share is the key forecasting signal. A nominal pipeline can continue to grow even while the amount likely to reach operation grows much more slowly, because new announcements enter faster than older projects clear power, permitting, equipment and financing hurdles. The 63.2 GW under construction in Bernstein/Aterio’s June North American dataset is a more advanced category than an announcement, but it still is not the same as operating capacity.
For readers comparing company plans or regional build-outs, the most useful question is not “How many megawatts were announced?” It is “How many megawatts have a secured power path, committed capital, credible offtake and a deliverable construction schedule?” That distinction is what the 47-plus disruptions and Bernstein’s roughly 35% U.S. credibility estimate are designed to capture.
