Federal prosecutors have charged Zohar Pinhasi, owner of the Florida ransomware remediation firm MonsterCloud, with wire fraud. The charges are allegations, not a finding of guilt, and Pinhasi is presumed innocent unless and until proven guilty. According to two U.S. Department of Justice releases dated October 7, 2026, MonsterCloud allegedly sold clients decryption without paying attackers, when Pinhasi allegedly paid the attackers himself and charged clients far more than the ransom.
What the government alleges
The Eastern District of New York charging release and the Office of Public Affairs release, both updated October 7, 2026, describe the same core theory. MonsterCloud allegedly represented that it could decrypt ransomware without paying the attackers, using proprietary tools and advanced techniques. The indictment alleges that Pinhasi instead contacted the attackers, paid for decryption keys, and charged clients fees substantially higher than the ransom payment. DOJ further alleges that this approach never remediated the underlying threat, meaning the intrusion itself was not addressed.

The figures, and how to read them
DOJ offers one detailed example and two cumulative totals. All four figures are allegations stated by prosecutors.
Recommended Free Tools
| Measure | Figure as alleged by DOJ | Scope |
|---|---|---|
| Paid to a cybercriminal in an August 2023 example | Approximately $8,200 | One alleged transaction |
| Charged to the client in the same example | Approximately $150,000 | One alleged transaction |
| Ransom payments over the whole alleged scheme | More than $8 million | Cumulative alleged total |
| Charged to clients over the whole alleged scheme | More than $19 million | Cumulative alleged total |
In the August 2023 example, the client charge is roughly 18 times the alleged payment; that ratio is simple arithmetic on DOJ’s approximate figures, not a number DOJ states. The gap between the cumulative totals should not be read as a proven profit. DOJ says Pinhasi allegedly kept the remainder and often extracted a substantial markup, but the release does not give a final adjudicated loss figure.

Why the non-payment claim is the center of the case
The case turns on disclosure and representation. The government’s theory is not that a recovery firm may never deal with an attacker. It is that MonsterCloud allegedly sold a capability, decryption without paying, that it allegedly did not deliver, while paying attackers in secret. Whether a firm negotiates or facilitates a payment is a separate question from whether it tells clients it can recover files independently. The reporting and filings discussed here do not establish a general rule that every recovery provider involved in a payment commits fraud.
What officials said
The following statements appear in DOJ’s October 7, 2026 release. Each describes the government’s allegations, and each should be read with the words “as alleged” in mind.

- No Installation Required - The Data Recovery Stick runs entirely from the USB drive with no software installation on your computer — helping prevent new data from overwriting the files you're trying to recover. This also makes it ideal for use across multiple computers or in emergency situations where installation isn't practical.
- Use the Data Recovery Stick on as many computers as often as needed — simply clear the recovered data between uses to free up storage space. Software updates keep the tool compatible with newer systems and devices, backed by 25+ years of data software expertise from Paraben Consumer Software.
- U.S. Attorney Joseph Nocella, Jr.: “As alleged in the indictment, by falsely claiming to decrypt ransomware without paying off the ransomers, the defendant re-victimized his clients while extracting a hefty profit for himself.”
- Assistant Attorney General A. Tysen Duva: “The defendant is charged with offering an alternative to ransom payments, but instead is alleged to have victimized the victim again and committed additional fraud, harming the victim again.”
- FBI Assistant Director James C. Barnacle Jr.: “As alleged, Zohar Pinhasi claimed to fix ransomware while never remediating the underlying threat. Instead, he turned the victim’s crisis into his own profit center.”
What federal guidance says about paying ransoms
DOJ states that joint FBI and CISA guidance does not recommend that ransomware victims pay ransom. According to the same release, payment does not ensure that data will be decrypted, that systems or data will no longer be compromised, or that stolen data will not be leaked. This article relies on DOJ’s summary of that guidance. Readers who need the exact recommendations should consult the FBI and CISA guidance directly.
What the 2019 ProPublica investigation adds
ProPublica’s investigation, published May 15, 2019, reported that some firms marketing proprietary ransomware recovery methods paid attackers and charged clients additional fees. The investigation included earlier reporting about MonsterCloud. It is useful background that explains why regulators and reporters have looked at this business model before, but it is journalism rather than a court finding, and it does not by itself establish the current charges.

How to check a recovery firm before you hire one
The questions below follow from the allegations. They are editorial suggestions, not an industry standard, and they do not replace legal, insurance, or incident-response advice.
- Does the firm claim independent decryption, or does it negotiate with and pay attackers? Get the answer in writing. A firm that does both should say so plainly before it is hired.
- Who authorizes any payment? Any ransom payment should require the client’s written authorization, and the firm should disclose every payment, the attacker’s demand, and the amount it charges on top.
- Is containment and remediation in scope? Recovering files does not remove the intruder. Check whether the written scope covers closing the access path, not just restoring data.
- How is recovery validated? Ask how the firm will confirm that restored files open correctly and that the environment is clean before systems return to service.
- Are scope, fees, and reporting fixed in writing before work starts? Fees that are substantially higher than any payment the firm makes should prompt questions before you sign.
Where the case stands
As of the October 7, 2026 releases, the matter is at the charging stage. The Office of Public Affairs release also covers the arraignment. Because the status of a federal case can change quickly, check the court docket for later filings before relying on any detail in this article.
