Prediction markets trade contracts tied to real-world events; traditional derivatives usually reference an asset, rate, index or other economic measure. That distinction helps explain how the products are used, but it is not a legal dividing line. The U.S. Commodity Futures Trading Commission (CFTC) says event contracts can fall within the legal definitions of swaps or futures, so the contract terms, venue and applicable regulation matter as much as the label.
The central difference at a glance
A prediction-market contract asks a settlement question such as “Will it rain tomorrow?” or “Will a specified candidate win?” A conventional derivative generally derives its value from something already traded or measured, such as a stock index, interest rate, commodity price or foreign-exchange rate. Both can transfer risk, support hedging, permit speculation and be traded before expiration.

| Comparison point | Prediction-market event contract | Traditional derivative |
|---|---|---|
| Reference | A defined event, occurrence, nonoccurrence or outcome, including weather, political, economic or sports results | Usually an asset price, interest rate, index, commodity, currency or other financial or economic measure |
| Typical payoff | Often a fixed amount for a correct outcome and zero for an incorrect one, although multiple-outcome and range designs also exist | Can be linear, optional or formula-based, depending on whether it is a future, option or swap |
| Meaning of price | A tradable market-implied belief about the specified outcome, shaped by order flow, liquidity and contract wording | A valuation of exposure to the referenced market variable, incorporating price, volatility, interest rates, time and other factors |
| Common uses | Information aggregation, event-linked speculation and, where the terms match an exposure, hedging | Hedging, risk transfer, arbitrage and speculation across financial and commodity exposures |
| Exit before settlement | An exchange order book may allow a trader to sell before resolution; depth and spreads differ by contract | Exit depends on the listed or over-the-counter instrument, venue, counterparties and market depth |
| U.S. oversight | Event contracts offered by a CFTC-registered designated contract market (DCM) face derivatives-market requirements; classification and jurisdiction remain active policy and litigation issues | Oversight varies by product and venue, including rules for futures, options, swaps and security-based instruments |
The practical comparison is therefore not “prediction markets versus derivatives” as mutually exclusive categories. It is event-centered exposure versus exposure centered on a market variable, with legal treatment determined by the actual instrument.
What a prediction-market contract is
The settlement reference is an event
An event contract names the fact that determines settlement. The wording may specify whether a weather station records rain, whether an election result meets a stated condition, whether an economic release crosses a threshold or which of several outcomes occurs. The contract should identify the data source, measurement period, cutoff time, time zone and procedure for resolving disputes. A familiar question such as “Will it rain tomorrow?” is only a starting point; the official rules determine what counts as “rain,” where it is measured and when the answer is final.

Binary, multiple-outcome and range designs
Binary contracts have two results, commonly yes or no. Some list several mutually exclusive outcomes, such as a set of possible winners. Others pay according to a range, for example whether a reported figure lands inside a band or how much of a variable is recorded. A CFTC fact sheet describes these varied structures, so assuming that every event contract pays exactly one dollar or zero can be wrong. The listed contract’s specifications control the payout.
Because settlement is rule-based, two contracts about the same broad event can produce different results if they use different sources, thresholds or deadlines. Read the specification rather than relying on the market’s short title.
Why the price is not a guaranteed forecast
Participants trade the contract itself, not a free poll. Price changes as information, expectations and orders change. A price can be interpreted as the market’s perceived probability only when the contract has a simple, fixed payoff and the relevant fees, spreads and funding effects are understood. Even then, it is an implied belief, not an objective probability or promise of accuracy.

How the event-contract payoff works
The CFTC’s rain example
The CFTC’s educational example uses a one-dollar yes contract on “Will it rain tomorrow?” If the yes position costs 70 cents and rain occurs under the contract’s rules, the holder receives one dollar, for a 30-cent gain before fees and taxes. If the event does not occur, the position loses its investment. The example illustrates the arithmetic; it is not a universal specification for every venue or contract. See the CFTC prediction-markets guide.
- Read the question and settlement rules. Confirm the event definition, source, observation window and resolution date.
- Check the displayed price and quantity. Your cash at risk is affected by the number of contracts and the entry price.
- Account for fees and taxes. The quoted spread and any platform charge reduce the amount you receive or increase your break-even level.
- Decide whether to hold or exit. If an order book has a buyer, you may sell at the available market price before settlement.
- Wait for official resolution if you hold. The contract pays according to the published outcome procedure, not according to an informal consensus.
What changes with other designs
A multiple-outcome contract can divide the available payout among mutually exclusive results, while a range contract may pay only when a measurement falls within specified bounds or may vary the amount across ranges. Some products bundle related yes/no questions. In each case, the displayed price has to be interpreted alongside the exact payoff formula. A 70-cent quote does not have the same meaning when the maximum payout, number of outcomes or settlement formula changes.
What “traditional derivatives” includes
Traditional derivatives are a broad family, not one standardized product. The following distinctions are essential when comparing them with event contracts.

Futures
A futures contract creates an obligation tied to a specified quantity, quality and delivery or cash-settlement date. Its value normally tracks an underlying commodity, currency, interest rate or index. Positions are commonly marked to market, and the trader may have to post margin. A futures price therefore reflects the market value of that exposure over time rather than a simple yes-or-no event payout.

An option gives the buyer a right, but not the obligation, to buy or sell an underlying at a stated strike under defined conditions. The buyer pays a premium; the seller accepts an obligation and may post collateral. Payoff depends on the relationship between the underlying value and the strike, along with time remaining and volatility. Some event contracts resemble binary options economically, but their legal classification depends on the instrument and jurisdiction.
Swaps
A swap exchanges cash flows calculated from reference rates, prices or indexes. Interest-rate swaps, for example, can exchange fixed and floating payments. Swaps are often negotiated over the counter, although standardized forms may be cleared or traded through organized venues. Their documentation defines payment dates, calculation agents, collateral and termination events.
These products can be combined with event-linked references. The reference and payoff—not the marketing label—determine what risk is transferred and how the position behaves.
Key differences that affect a trader
Reference risk versus market-price risk
With an event contract, the main question is whether the specified occurrence happens under the stated measurement rules. With a conventional derivative, the exposure is usually continuous: a futures position changes with each move in the underlying, an option’s value responds to price and volatility, and a swap’s payments vary with its reference rate or index. An event contract can be easier to explain, but it can also create sharp all-or-nothing exposure.

Payoff shape and capital at risk
A fixed-payout event contract makes the maximum settlement amount visible in advance, although fees and the ability to exit can change the realized result. Futures can generate gains or losses greater than the initial margin because the contract represents a larger notional exposure. An option buyer’s maximum loss is generally the premium, while an option seller’s obligation can be substantially larger. A swap can create payment obligations over many dates. Compare notional value, margin, premium, collateral and settlement amount rather than comparing quoted prices alone.

Information value and forecasting
Event prices aggregate the views of traders who put money behind an outcome. The CFTC says such markets can provide information about future events, and media and analysts may cite the resulting forecasts. A price can still be distorted by thin trading, fees, strategic orders, a narrow participant base or ambiguous rules. Conventional derivative prices also contain information, but they primarily price financial exposure, funding and risk rather than a discrete public event.
Hedging and speculation: matching the contract to the exposure
When an event contract can hedge
A farmer facing losses if an early freeze damages a crop could seek an event contract tied to the relevant temperature observation. If the location, dates, threshold and payout align with the actual loss, the contract may offset part of the damage. The CFTC uses event-linked hedging as an example of why these markets can matter to businesses and individuals.
That hedge has basis risk: the farm may freeze while the official station does not meet the threshold, or the station may meet it while the farm suffers no loss. Geographic mismatch, timing, payout limits and fees can leave the hedge incomplete.

An airline can use fuel futures or swaps to reduce exposure to changing fuel prices; an exporter can use currency derivatives to manage exchange-rate risk; an investor can use index options to limit portfolio losses. These hedges work only to the extent that the derivative’s underlying, amount and dates track the exposure. A broad index hedge may not offset a particular stock, just as a weather event contract may not match a specific field.
Speculation is possible in both
A trader may buy an event contract because they believe the market underestimates an outcome, or sell because they believe it overestimates one. Conventional derivatives allow directional bets, volatility strategies, spread trades and arbitrage. In either market, define the maximum loss, liquidity conditions and exit plan before entering.
Trading, liquidity and the decision to exit
Many event contracts use exchange order books. The CFTC notes that customers may be able to trade out before settlement at the prevailing market price. That possibility is not a guaranteed exit: a thin contract may have a wide bid-ask spread, little depth or no willing counterparty at a reasonable price.

- Depth: Look at the quantity available near the current bid and offer, not just the last traded price.
- Spread: A wide difference between buy and sell quotes can consume a large part of a small expected gain.
- Open interest and activity: These indicate participation but do not guarantee that your desired size can be executed.
- Fees: Include entry, exit, settlement and withdrawal charges in the break-even calculation.
- Resolution source: A disputed or delayed data release can postpone settlement or trigger the contract’s fallback procedure.
Listed futures and options can be highly liquid, while other contracts and over-the-counter swaps may require a dealer or bilateral negotiation. Liquidity is a property of the specific instrument and venue, not of the category name.
U.S. regulation as of March 2026
Event contracts can be derivatives under federal law
The CFTC’s March 16, 2026 advance notice of proposed rulemaking (ANPRM) states that prediction-market contracts may fall within the Commodity Exchange Act definition of a swap or may be futures contracts. The notice says a prediction market offering swaps or futures to the general public must register with the CFTC as a designated contract market. It discusses requirements such as listing contracts that are not readily susceptible to manipulation, enforcing contract terms and monitoring trading. The ANPRM requests comments on core principles, public-interest prohibitions, inside information, contract types and other questions; it is not a final rule resolving every issue. Read the CFTC ANPRM for the agency’s current proposal and its stated questions.
Agency position and ongoing litigation
In a 2026 press release concerning litigation involving Nevada, the CFTC said it asserted exclusive jurisdiction over commodity-derivative prediction markets. That is the Commission’s position in the case, not a final nationwide resolution of disputes between federal and state regulators. Availability and legality can differ by country, state, contract and venue. Do not assume that every prediction market is federally regulated or available to every customer.
CFTC Chairman Michael S. Selig said: “Event contracts allow businesses and individuals to hedge event-driven risks, enable investors to manage portfolio exposure, and provide the public with information about the outcome of future events.” The statement appeared in the jurisdiction-related press release and describes the Chairman’s rationale; it does not establish that any particular contract is an effective hedge or an accurate forecast. See the CFTC press release.
History and recent growth in listed event contracts
The CFTC’s educational timeline says prediction markets have existed in the United States since 1988 and that the agency has regulated them since 2004. It identifies the Iowa Electronic Market as an academic and experimental project and records the CFTC’s 2004 designation of Hedge Street as the first DCM offering binary options.

Best Value

|---|---|---|
| 2006–2020 average | About five per year | Average number of event contracts listed each year |
| 2021 | 131 | Event contracts listed |
| 2025 | Approximately 1,600 | Event contracts certified for listing |
These counts do not measure trading volume, active users, liquidity or forecast accuracy. They show listing activity, not how often a contract traded or whether participants could exit efficiently.
A practical framework for choosing the right instrument
- Define the exposure. Write down the loss or gain you are trying to offset: a temperature threshold, a commodity price, an exchange rate, an index level or another measurable variable.
- Match the reference. Choose an event contract only when its event, location, dates and data source track the exposure. Choose a futures, option or swap when a market-variable reference provides the closer match.
- Map the payoff. Calculate the maximum gain, maximum loss, margin or premium, settlement amount and timing. Include partial or multiple-outcome formulas where applicable.
- Check liquidity. Review bid-ask spreads, depth, recent activity and the availability of a counterparty for your intended size.
- Read the rulebook. Confirm resolution methodology, interruption and dispute provisions, early-exit rules, fees and any position limits.
- Verify jurisdiction and access. Identify the venue’s registration, the regulator that applies, customer eligibility and geographic restrictions as of the trade date.
- Set an exit and loss limit. Decide in advance whether you will close before settlement and the worst price or loss you will accept.
Common mistakes and how to avoid them
Treating a quote as a polling result
A tradable price reflects money at risk, order imbalance and market structure. It can move without a new public fact and may not equal a statistically calibrated probability. Use it as an implied market view only after checking the payoff and costs.
Assuming every event contract is binary
Multiple outcomes, ranges and bundled questions exist. Read the payout schedule and resolution source before comparing prices across contracts.
Ignoring the difference between entry and exit
The headline price may be available only for a small quantity. A larger order can receive several prices, and a later sale may cross a wide spread. Estimate the realized result using executable quotes, not the last trade.
Confusing listing growth with market quality
The increase to approximately 1,600 contracts certified for listing in 2025 does not prove that each contract is liquid, widely traded or accurate. Evaluate the individual market.
Assuming the legal answer is settled
The CFTC’s 2026 ANPRM and litigation statements describe an evolving U.S. framework. Distinguish an agency’s position or a proposed rule from a final court decision, and obtain current legal guidance for a specific activity.
Bottom line: compare the exposure, not the label
Prediction-market event contracts center on whether a defined real-world event occurs, while traditional futures, options and swaps generally price exposure to assets, rates, indexes or other economic variables. Event contracts can have clear fixed payouts and may aggregate information, but their prices are not guaranteed forecasts and their liquidity, fees and resolution rules determine real-world results. Traditional derivatives offer a wider range of linear, optional and cash-flow structures, with their own margin, collateral and liquidity risks.
