Prediction Markets vs. Sports Betting: Legality, Fees, Payouts and Settlement Rules (U.S., 2026)

Prediction markets and sportsbooks both let you take a position on an uncertain outcome, but they are different products. A prediction market normally lists an event contract that trades at a price set by buyers and sellers; a basic binary contract may pay $1 if it resolves in your favor and $0 otherwise. A sportsbook accepts a wager at quoted odds, with the operator’s margin generally embedded in those odds.

That distinction affects what you pay, how you calculate a return, whether you can exit early, and which laws apply. Sports-related event contracts are also the subject of active U.S. litigation, so neither “legal everywhere” nor “illegal everywhere” is accurate. Check your state, the platform’s current availability, the exact contract or wager rules, and the applicable court orders before depositing money.

Prediction markets and sportsbooks: the structural difference

How an event contract works

In a prediction market, you trade a contract tied to a defined event. Prices are commonly displayed in cents and move as participants submit buy and sell orders. If the contract is a simple binary proposition, a favorable settlement is usually worth $1 and an unfavorable settlement is worth $0. Your economic result is the settlement value minus what you paid and any applicable trading fees.

You may be able to sell before the event is resolved. That creates a second way to realize a result: close the position at the current market price rather than wait for settlement. The price can rise or fall because of new information, demand, liquidity, or changes in the perceived probability of the outcome. Early exit is an exchange feature, not a promise that a buyer will always be available at a favorable price.

How a sportsbook wager works

A sportsbook posts odds for a specified outcome, such as a team winning, covering a spread, or a player exceeding a statistical line. You choose a stake, and the quoted odds determine the potential profit and total return. The operator builds a margin—often called vig, juice, or hold—into the prices it offers. Unlike an exchange-traded contract, the sportsbook is generally the counterparty setting the menu of prices and accepting the wager.

Why the label is not the legal answer

Calling a sports position an “event contract” does not by itself determine whether it is a federally regulated derivative or a state-law sports wager. Regulators and courts examine the product’s terms, venue, and legal authority, not only its marketing label.

Quick comparison

Question Prediction-market contract Sportsbook wager
Price format Often a price between $0 and $1, displayed in cents Quoted odds, commonly American, decimal, or fractional
Counterparty and pricing Orders from market participants; price changes with supply and demand Operator posts odds and accepts the bet
Basic maximum settlement Usually $1 per binary contract, before fees; special markets can differ Stake plus profit calculated from the quoted odds
Loss if wrong Typically the purchase price plus applicable fees for a contract that settles at $0 Usually the stake, subject to the wager’s rules
Early exit May be possible by selling, subject to liquidity and fees May be available through a cash-out feature, if offered; terms are operator-specific
Settlement Written contract rules, an official result source, and a stated settlement process control the outcome House rules define grading, voids, postponements, and player participation
Legal framework in the United States Sports contracts are disputed between federal derivatives jurisdiction and state gambling authority Generally governed by the laws and licenses of the relevant state or tribal jurisdiction

The table describes common structures, not a guarantee for every product. Read the individual market or wager rules before comparing prices.

Are prediction markets legal in my state?

The federal position

The Commodity Futures Trading Commission (CFTC) describes prediction markets as event-contract markets and states its view that contracts traded on designated contract markets fall within federal jurisdiction. In 2026, the agency brought litigation against New Mexico and Wisconsin to assert exclusive federal jurisdiction over event contracts on designated contract markets. Those filings present the CFTC’s position; they do not automatically settle every state’s treatment of every sports product.

The state position

State officials, including attorneys general in Connecticut and Illinois, have argued that contracts on game winners, point spreads, and player statistics are sports wagers subject to state gambling laws and their consumer-protection requirements. These materials are enforcement positions or advocacy, not a single nationwide judicial ruling.

What the courts have actually decided

The litigation record is not uniform. In KalshiEX LLC v. William Orgel, the Sixth Circuit opinion discusses an Ohio district court’s refusal to grant preliminary relief. The district court concluded, at that stage, that the contracts had not been shown to qualify as swaps subject to exclusive CFTC jurisdiction and that Ohio gambling law had not been shown to be preempted. Other cases have produced different interim results. A preliminary injunction, a dismissal, or an appellate ruling in one jurisdiction should not be presented as a nationwide rule.

A practical state-by-state check

  1. Identify your location. Use the state where you are physically placing the transaction, not merely your billing address.
  2. Check current access. A platform may geofence a state, restrict particular sports contracts, or change access after a new order or enforcement action.
  3. Read the platform’s legal notice. Look for the product’s stated regulatory basis, prohibited jurisdictions, and any arbitration or dispute provisions.
  4. Read the event rules. A contract’s definition and settlement source can matter to its classification and to your actual risk.
  5. Verify current orders and law. Legal availability can change quickly while the federal-state cases proceed.

As of October 13, 2026, the safest description is that treatment of sports-related event contracts is being litigated. The CFTC says federal derivatives law governs contracts on registered exchanges; state gaming authorities argue that sports contracts remain subject to state gambling laws. The answer can depend on your location, platform, product, and the ruling currently in force.

How prediction-market fees compare with sportsbook vig

Contract price plus trading fees

Suppose a binary contract is offered at $0.62. Buying one contract requires $0.62 before fees. If it settles favorably at $1, the gross profit is $0.38; if it settles unfavorably at $0, the loss is the $0.62 purchase price. Add any fee charged when opening, closing, or settling the position to calculate the net result.

For 100 contracts at $0.62, the pre-fee outlay is $62 and the favorable gross settlement is $100. The gross profit is therefore $38, not $100. If the market charges a fee on the trade or on an early sale, subtract that amount from the appropriate side of the calculation.

Do not assume one platform’s formula applies to every market. A February 2026 fee schedule from Kalshi gives a formula for specified S&P 500 and Nasdaq-100 markets; that is not a universal rate for sports contracts. Check the current schedule attached to the exact market and determine whether fees apply to opening trades, closing trades, or both.

Sportsbook odds and the embedded margin

Sportsbook pricing puts the operator’s margin inside the quoted odds. The margin is commonly called vig, juice, or hold. It is not normally shown as a separate line item, so you must use the odds and stake to determine the potential return and then compare that price with an estimated no-margin probability.

Illustrative example: at American odds of -110, a $110 stake produces $100 profit if the wager wins, for a $210 total return including the original stake. A $100 stake at the same odds produces $90.91 profit and a $190.91 total return. These figures are arithmetic examples, not a quote for a particular game. The operator’s margin is reflected in the odds rather than added as a separate trading charge.

Compare on the same basis

A contract price and a sportsbook line are not directly comparable until you align the outcome, stake, and timing. Use these measures:

  • Total outlay: contract purchase price plus applicable fees, or sportsbook stake and any stated charge.
  • Maximum gross settlement: the contract’s defined settlement amount, or the sportsbook’s total return.
  • Net profit if correct: settlement or profit less all fees and the amount committed.
  • Net loss if wrong: the amount forfeited under the exact rules.
  • Exit value: the executable sale price in a market, or the sportsbook’s cash-out offer if one exists.
  • Rule-adjusted value: the effect of voids, partial settlement, postponements, and participation requirements.

No independent, apples-to-apples industry statistic establishes that prediction markets are always cheaper or that sportsbooks always have a higher margin. A platform’s own public statement about blended fees is a company claim, not neutral comparative research. Use contemporaneous quotes for the specific event you are evaluating.

How prediction-market payouts work

Simple binary contracts

For a basic binary contract, the written terms define one favorable result and one unfavorable result. A favorable result normally pays $1 per contract; an unfavorable result pays $0. The payout is fixed at settlement, but your return is not simply “$1.” It is the settlement amount minus the purchase price and applicable fees.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

If you buy at $0.35 and the contract settles favorably, the gross profit is $0.65 per contract before fees. If it settles unfavorably, you lose $0.35 plus any applicable fees. Buying after the price has risen to $0.80 changes both the potential profit and the implied market probability; the settlement amount remains $1.

Scalar and ladder sports markets

Not every sports event contract is binary. Some NFL ladder and escalator products can pay an amount between $0 and $1 based on the official player statistic. A result of 0.6, for example, would produce a $0.60 settlement per contract if the market’s published scale assigns that value. The exact thresholds and calculation must come from that market’s rules.

Combination markets

Combo markets combine component outcomes. If a component settles to a scalar amount rather than a simple yes-or-no value, the combination can produce a partial payout. It is not necessarily an all-or-nothing result or an automatic refund. Read how each component is multiplied, capped, or otherwise carried into the final settlement.

Sportsbook payouts, voids, and cash-outs

A sportsbook pays according to the odds and the wager type. Moneyline, spread, total, prop, parlay, and same-game combination bets can each have different grading rules. A winning ticket generally returns the original stake plus the quoted profit; a losing ticket usually forfeits the stake. A voided or cancelled leg may return the stake, be removed from a parlay, or be handled another way under the operator’s rules.

Cash-out offers are discretionary and can be reduced by the operator’s pricing. If offered, the amount may change as the game or market moves. Do not treat a cash-out button as equivalent to an exchange’s executable bid: the two mechanisms can differ in price, availability, and timing.

Settlement rules that can change the result

Official result source

Find out which league, statistician, data provider, or other authority supplies the official result. A market may use a league’s final statistic rather than a live score or a television graphic. Corrections made after the game can therefore affect settlement.

Event definition and timing

Check the precise start time, completion requirement, statistical cutoff, and settlement window. “Wins the game” could require an officially completed game, while a player-statistic contract may require a minimum number of snaps, minutes, or appearances if its rules say so.

Postponements and cancellations

Rules may treat a postponed game as pending until it is played, or may void the market after a stated deadline. A cancelled event can settle differently from a suspended event. Never infer the treatment from a sportsbook rule when evaluating an event contract, or vice versa.

Did-not-play and injury provisions

Player markets often distinguish between a player who is listed but does not enter the game, one who enters and is injured, and one whose game is abandoned. The DNP and injury treatment varies by market. A sportsbook prop and an event contract on the same statistic can therefore reach different outcomes.

Partial and combination settlement

Scalar contracts and combination products can settle to intermediate values. Confirm whether a partial result is paid proportionally, whether a component is removed, and whether a cap or floor applies.

Early exit, liquidity, and execution risk

An exchange-style market may let you sell a position before settlement, but only if another participant is willing to trade. A displayed price is not the same as a guaranteed fill, especially in a thin market. Account for bid-ask spread, order size, price movement, and any closing fee. Holding to settlement removes the need to find a buyer but leaves you exposed to the final rule-based outcome.

A sportsbook may offer no early exit, or may provide a cash-out quote that changes independently of the theoretical value of the wager. Compare the amount you can actually receive now with the amount you could receive at settlement, including the risk that the offer disappears.

A repeatable method for comparing one event

  1. Write the identical proposition. Make sure both products refer to the same game, market type, player, statistic, and time period.
  2. Capture live prices. Record the contract price and visible fees, or the sportsbook odds, stake, and any stated charge. Note the timestamp.
  3. Calculate both outcomes. Show the favorable and unfavorable net results, not only the advertised payout.
  4. Normalize the stake. Compare one contract, 100 contracts, or a fixed dollar amount consistently; do not compare a $1 contract with a $110 sportsbook stake without adjustment.
  5. Read settlement provisions. Verify official source, postponement, cancellation, DNP, injury, game-completion, partial-payout, and correction rules.
  6. Check exit terms. Record whether selling or cashing out is available, how the price is determined, and what fee applies.
  7. Check jurisdiction. Confirm that the specific product is available to you under current federal, state, and platform restrictions.
  8. Recalculate before submitting. Prices, fees, liquidity, and legal access can change between viewing a market and placing an order.

Common mistakes to avoid

  • Treating a $0.70 contract as a 70-cent bet with a guaranteed 30-cent profit. The $1 settlement occurs only if the contract resolves favorably, and fees reduce the result.
  • Comparing a contract price with sportsbook odds without matching stakes. Use a common dollar basis and show total return.
  • Assuming a binary payout for every sports market. Ladder, escalator, and combo products can pay intermediate amounts.
  • Ignoring closing costs. A fee schedule may charge on both opening and closing trades.
  • Assuming one court order settles the country. The legal posture can differ by state, platform, and procedural stage.
  • Using a live score as the settlement source. The written rules may rely on an official statistic that is corrected later.
  • Assuming DNP or injury treatment is universal. Read the exact player-market language.
  • Confusing a displayed price with an executable price. Liquidity and order size determine whether you can actually enter or exit at that level.

What to verify before relying on a position

  • Your physical jurisdiction and the product’s current availability there
  • The regulator or legal basis the platform identifies for the contract or wager
  • Current entry, exit, settlement, and withdrawal fees
  • The exact event definition and official data source
  • Settlement timing and procedures for postponement, cancellation, suspension, and corrections
  • Player participation, DNP, and injury rules
  • Whether a payout can be partial or scalar
  • Whether early exit is available and how its price is set
  • The amount at risk after every fee, not merely the headline payout

The CFTC’s consumer guidance advises customers to look for clear information about risks, obligations, commissions, fees, penalties, and other costs associated with a trade. That checklist is especially important when a sports product sits between a contract market’s terminology and state gambling law.
