Prediction markets vs. sports betting: How legality, odds, and payouts differ

Prediction markets and sportsbooks both let you speculate on future events, but they are different products. A prediction market is an exchange where traders buy and sell event contracts; the quoted price is the crowd’s implied probability, and a contract normally settles at a fixed amount or zero. A sportsbook is a house-run wagering service: it posts odds, accepts your stake, and builds a margin into those odds. In the United States, the Commodity Futures Trading Commission (CFTC) says federally regulated prediction markets can operate in all 50 states, while sports-related contracts and state gambling laws remain the subject of active litigation. Sportsbooks, by contrast, depend on state gaming licenses and state-by-state rules.

What a prediction market is—and what a sportsbook is

Prediction markets are exchanges for event contracts

A prediction market lists a contract tied to a clearly defined future event. A binary contract asks a yes-or-no question such as whether a team will win, a candidate will win an election, or a specified economic condition will occur. Traders submit bids and offers through an order book. Other traders take the opposite side, and the exchange generally earns a transaction fee rather than betting against its customers.

The CFTC says U.S. prediction markets have existed since 1988 and have been regulated by the agency since 2004. Its consumer guidance describes the basic relationship this way: “A contract’s price reflects traders’ perceived probability of the event outcome.” That price is a market estimate, not a guarantee and not necessarily an objective forecast.

Sportsbooks are house-run wagering products

A sportsbook posts a price for each outcome, accepts your wager, and manages its own exposure. The operator is the counterparty or otherwise controls the book’s risk. Its quoted odds include a mathematical margin—often called the vig, hold or overround—so that the operator expects to earn money over many bets even though individual wagers can win.

The congressional hearing record summarizes the distinction plainly: “In a casino or sportsbook, the house sets the odds and profits when customers lose.” In an exchange, “participants trade with one another, while the platform earns transaction fees for facilitating the market.” That difference affects pricing, execution, settlement and the way you can leave a position.

How odds and prices are created

Reading a binary prediction-market price

A binary contract is commonly quoted in cents. A price of 65 cents is ordinarily read as approximately a 65% implied probability before fees. If the contract’s stated payout is $1 when the event occurs, buying at $0.65 creates a maximum gross gain of $0.35 if the contract wins, or a gross loss of $0.65 if it loses. The arithmetic changes with fees, contract size and the exchange’s published rules.

The price moves as traders place orders, cancel them, or trade against available bids and offers. A 65-cent market therefore says that participants are currently willing to transact around that level; it does not mean the event has a 65% true chance. Thin trading, a wide bid-ask spread, new information and a rush of orders can all move the displayed price.

Sportsbook odds use standardized formats

Sportsbooks normally display American, decimal or fractional odds. The odds determine the profit on your stake, while the operator’s margin is embedded in the prices offered on all outcomes. Your bet slip is the controlling document for the exact stake, potential return, settlement conditions, void rules and any cash-out offer.

Feature Prediction-market contract Sportsbook wager
Displayed price Order-book price, often in cents for a binary contract House-posted American, decimal or fractional odds
What the price means Approximate market-implied probability before fees Profit and return on the stake, with the operator’s margin included
Who sets the quote Traders’ bids and offers; the exchange matches orders The sportsbook sets and can adjust the odds
Typical settlement Fixed contract amount if the specified outcome occurs; zero otherwise, subject to terms Stake plus profit at the posted odds, subject to house and jurisdiction rules
Counterparty Usually another market participant; the exchange generally does not take a side The sportsbook takes or manages the house side

How payouts differ, with numbers

Prediction-market example

Suppose a “Yes” contract is offered at $0.65 and settles for $1 if the defined event occurs. Buying one contract costs $0.65. If “Yes” is confirmed under the contract’s rules, the gross settlement is $1, producing $0.35 before fees. If “No” is confirmed, the contract settles at $0 and the $0.65 purchase price is lost. Selling before settlement can produce a gain or loss based on the price available at that moment.

That example assumes the exchange has a $1 payout and does not include trading or withdrawal fees. Read the contract specification for the number of contracts, minimum tick, fee schedule, treatment of ties or cancellations, source of the final result and settlement time. A displayed price is not the same as your net return.

Sportsbook example

Assume a bet slip offers decimal odds of 1.80 on a $100 stake. A winning wager returns $180 in total: the $100 stake plus $80 profit. A losing wager normally returns nothing. The sportsbook’s prices on every outcome are set so that the combined implied probabilities exceed 100%; that excess is the house margin. American and fractional displays express the same underlying relationship in different formats.

Sportsbook payouts can be altered by rules for postponed games, player participation, parlays, dead heats, corrections and promotional terms. A cash-out button, when offered, is an operator-controlled price rather than a guaranteed right. Check the bet slip and the applicable house rules before placing a wager.

Why the same event can have different numbers

A prediction-market price and a sportsbook line may disagree even when they reference the same game. They can use different event definitions, settlement sources, trading hours, fees, limits and participant pools. A sportsbook may shade a line to balance risk or reflect its commercial margin. An exchange price may move because a few traders submit aggressive orders or because liquidity is limited. Comparing the numbers requires matching the exact proposition, timing and costs—not just the team names.

Who takes the other side?

Exchange model

On a regulated prediction-market exchange, your order is matched with another participant’s order. The CFTC says regulated exchanges, brokers or other intermediaries that provide access “do not take a side of the trade.” The platform’s economic incentive is normally transaction volume and fees, while traders’ gains and losses are determined by their positions and the final settlement.

An exchange still has important responsibilities: publishing contract terms, operating the matching system, maintaining records, collecting required collateral or margin where applicable, monitoring for manipulation and resolving settlement under its rules. “No house side” does not mean no platform risk, no fee or no possibility of an order failing to execute.

Sportsbook model

A sportsbook controls the posted line and accepts wagers under its license and rules. It may offset risk in other markets, but your contractual relationship is with the operator. The operator’s margin is part of the price, and limits, account restrictions or line changes can affect what you can bet and at what odds.

Can you cash out?

Prediction markets: sell into available liquidity

Many prediction markets let you close a position before the event is resolved by selling the contract. The amount you receive depends on the current bid, the number of willing buyers and applicable fees. If the market has moved in your favor, selling can lock in a gain; if it has moved against you, selling realizes a loss. A displayed last-traded price may not be available for the size of your order, so inspect the bid-ask spread and depth.

Holding to settlement avoids an early-sale decision but exposes you to the event definition, timing and settlement process. If the market is halted, illiquid or disputed, you may be unable to exit when you want.

Sportsbooks: operator-controlled cash-out

Sportsbook cash-out is optional and operator-specific. The amount can change rapidly, disappear during a material play or be unavailable for certain bet types. It is not equivalent to selling an exchange contract to another trader. If no cash-out is offered, the bet normally remains open until the sportsbook settles it under the bet slip and house rules.

Legality in the United States as of October 16, 2026

The federal position on regulated prediction markets

The CFTC’s consumer guidance says federally regulated prediction markets can operate in all 50 states. That is the federal regulator’s position about exchanges registered and supervised under federal derivatives law. It does not guarantee that every contract, every sports proposition or every interface will be available to every resident at every moment.

Federal regulation generally means the exchange publishes standardized contract terms, payout and settlement rules, bid and ask prices, and compliance procedures. It can also mean identity checks, financial controls and market-surveillance obligations. The precise protections depend on the registered entity, the product and the applicable CFTC rules.

State challenges to sports-related contracts

States are actively challenging sports event contracts as unlicensed gambling. On June 12, 2026, the CFTC announced a suit against New Mexico after the state sued Kalshi. CFTC Chairman Michael S. Selig said: “New Mexico is the latest state seeking to nullify black letter law and decades of judicial precedent by imposing state gaming laws on federally regulated derivatives exchanges subject to the CFTC’s exclusive jurisdiction.”

That statement describes the agency’s legal position, not a final nationwide resolution. State lawsuits, court orders and injunctions can affect whether a particular sports market is offered or blocked in a state. A platform’s claim that its contracts are federally regulated swaps should therefore be treated as an argument in an active legal conflict, not as a substitute for checking current availability.

Sportsbook legality is state based

Traditional online sportsbooks operate under state gambling frameworks. Where sports wagering is authorized, operators generally face licensing, age and location checks, advertising controls, responsible-gambling requirements and self-exclusion tools. Availability can differ by state, tribal jurisdiction, product type and operator license. In a state without a lawful mobile-book framework, an offshore or unlicensed site does not become legal merely because it accepts a U.S. customer.

How to check your own status

  1. Identify the exact product: an exchange contract, a sportsbook bet, or another derivative.
  2. Read the operator’s current availability notice for your state and the contract or bet-slip terms.
  3. Check your state gaming regulator’s website for licensed operators, prohibited products, enforcement notices and self-exclusion information.
  4. Check for current court orders or injunctions affecting sports event contracts in your state.
  5. Confirm age, identity, geolocation and funding requirements before depositing money.

How to evaluate a prediction-market contract before trading

  1. Read the exact question. Determine what counts as “Yes,” “No,” a win, a loss, a tie or an invalid result. A contract about a championship winner is not necessarily the same as one about a game result, playoff qualification or a point spread.
  2. Check the information source. Find the named league, government release, election authority or other settlement source. Note whether the source must publish by a particular deadline.
  3. Check the close and settlement times. A market can stop accepting orders before the event is complete, and settlement may occur after the underlying result is known.
  4. Calculate the net exposure. Multiply the number of contracts by the purchase price, then add trading fees. Record the maximum possible loss and the fixed settlement amount.
  5. Inspect liquidity. Compare the best bid and offer, spread and available quantity. A price that looks attractive for one contract may be unavailable for a larger order.
  6. Plan the exit. Decide whether you will sell at a target price, hold to settlement or accept that an early sale may not be possible.
  7. Confirm access and restrictions. Complete required identity and location checks and verify that the specific contract is available where you live.

How to read a sportsbook bet slip before placing a wager

  1. Identify the market type. Moneyline, spread, total, prop, parlay and futures bets have different settlement rules.
  2. Record the odds format and stake. Convert the displayed odds to the potential profit and total return shown on the slip.
  3. Review operator adjustments. Confirm whether odds can change before acceptance and whether the displayed price is locked only after the wager is accepted.
  4. Read void and postponement rules. Player participation, venue changes, weather and rescheduling can determine whether a bet stands.
  5. Check cash-out language. If a cash-out amount appears, determine whether it is guaranteed, whether it can disappear and which markets are excluded.
  6. Verify legal and account conditions. Confirm state location, age, identity, deposit and withdrawal requirements and any self-exclusion status.

Consumer safeguards, disputes and practical risks

Identity, age and location

Both products can require identity verification and financial controls. Sportsbooks operating under state licenses commonly use age and geolocation checks and offer self-exclusion. Prediction-market exchanges may apply their own compliance, surveillance and access controls. The existence of a login page does not prove that a product is lawful or available in your jurisdiction.

Settlement and disputes

For an exchange, the contract specification determines what happens when an official result is delayed, corrected, missing or ambiguous. For a sportsbook, the bet slip and house rules determine treatment of postponements, player nonparticipation, statistical corrections and voids. Save the contract or bet slip, transaction record and relevant official result if you need to challenge a settlement.

Liquidity, limits and execution

Exchange liquidity can be thin, especially for niche or newly listed events. You may receive partial fills or a worse average price than the quote you first saw. Sportsbooks can limit stakes, move lines or refuse a wager before acceptance under their rules. Neither product guarantees that the price shown on a screen will remain available.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Market and financial risk

A contract price is an implied probability, not a promise. A sportsbook line is not a guarantee either. News, injuries, weather, official corrections and rule interpretations can change outcomes and prices. Only risk money you can afford to lose, set a limit before trading or wagering, and use available pause or self-exclusion tools if activity is becoming difficult to control.

Common misconceptions

“A prediction market is just a sportsbook with different branding.”

No. The exchange model, order-book pricing, counterparty relationship and settlement mechanics are different. A trader may buy from or sell to another participant rather than place a house bet.

“A 65-cent contract guarantees a 65% result.”

No. It is an approximate implied probability at the time and size of the trade, before fees. It can be distorted by limited liquidity, trading costs or participants’ collective errors.

“Federal regulation means every sports contract is unquestionably legal everywhere.”

No. The CFTC says federally regulated prediction markets can operate in all 50 states, while states are litigating whether some sports event contracts are unlicensed gambling. Availability can change with court action and operator decisions.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

“Cash-out works the same way on both products.”

No. An exchange sale depends on another trader’s bid and market liquidity. A sportsbook cash-out is an optional, operator-controlled offer that can change or disappear.

Which product fits which objective?

  • You want a tradable probability position: An exchange contract may suit you if you understand order books, spreads, fees and settlement definitions.
  • You want a conventional bet with a displayed return: A licensed sportsbook provides a bet slip with posted odds and house rules, where available in your state.
  • You need a guaranteed early exit: Neither product guarantees one. Exchange liquidity can fail; sportsbook cash-out is discretionary.
  • You are choosing based on legality: Verify the exact product, state, license or federal registration and current court status rather than relying on a slogan.

The central distinction is simple: a prediction market turns an event question into a tradable contract whose price reflects participants’ views, while a sportsbook turns an event into a house-priced wager with an embedded margin. The legal boundary for sports contracts is still being tested in U.S. courts, so check the current operator notice and your state regulator immediately before committing funds.
