The format affects pricing, fees, and how a venue may earn revenue, but it does not prove that one option is cheaper. Compare the specific payout, costs, settlement terms, and exit price—and check the current rules where you live.
How prediction markets and sportsbooks differ
A prediction-market contract is tied to a defined event or outcome. Its terms specify what qualifies for settlement, who determines the result, and what the contract pays. On a CFTC-regulated exchange, customers’ bids and asks form an order book. The quoted price reflects what traders are willing to pay; it is not a guarantee of the event’s true probability.

A sportsbook instead accepts a wager under its terms and displays odds for the selected outcome. Those odds determine the potential payout for the stake. Because contract prices and sportsbook odds express potential returns differently, a displayed contract price cannot be compared directly with odds without first putting the stake, payout, and costs on the same basis.
| Comparison | Prediction-market contract | Sportsbook wager |
|---|---|---|
| What the customer takes | A contract tied to an event outcome; the contract terms govern payout and settlement. | A wager accepted at the sportsbook’s posted odds and under its terms. |
| How the price is formed | Trading prices reflect bids and asks in the market; the quoted price is not a guaranteed probability. | The sportsbook posts odds for the outcome and terms it offers. |
| Venue’s role | CFTC-regulated exchanges and intermediaries generally facilitate trades rather than take the other side. Kalshi has described transaction fees as its revenue model; that is the company’s account, not proof of lower customer costs. | The sportsbook accepts wagers. A uniform fee or cost across sportsbooks is not established by the CFTC consumer guidance or NCSL account. |
| Leaving before the result | A customer may be able to trade out at the current market price; the exit may realize a loss or a gain. | Cash-out availability and terms depend on the sportsbook and wager; no universal terms are established by the sources cited here. |
| Settlement | The contract’s stated terms determine the payout and settlement process. | The sportsbook’s wager terms determine how the bet is settled. |
These are broad format differences, not a guarantee that every site calling itself a prediction market is a regulated exchange. CFTC consumer guidance describes protections and duties for regulated exchanges and intermediaries specifically.

Are prediction markets cheaper than sportsbooks?
There is no supported universal answer. The sources discussed here do not establish an authoritative, apples-to-apples average cost for prediction markets versus sportsbooks. A transaction fee on a contract does not, by itself, show that the trade is cheaper than a sportsbook wager; price, spread, payout, and settlement all affect the result.
Compare the same outcome and stake
- Match the event and outcome. Make sure both products settle on the same result, using comparable definitions and settlement sources.
- Record the amount at risk. Note the amount paid to buy the contract or the stake placed on the wager.
- Calculate the gross payout. Use the contract’s actual settlement terms or the sportsbook’s offered odds, not a headline price alone.
- Add trading costs. Include transaction fees and, where applicable, the bid-ask spread. Kalshi charges a transaction fee, according to NCSL, but that account does not supply a universal fee schedule or establish a lower total cost.
- Account for an early exit only if relevant. For a contract, use the current price at which it can actually be sold; an exit can lock in a loss or gain.
- Compare net outcomes. Put the amount paid or risked, fees, and potential payout on the same basis. Read the rules for penalties, obligations, and settlement before trading.
A simple “one cent equals one percent” shortcut applies only when the particular contract’s payout terms make that interpretation valid. Check those terms rather than treating the shortcut as a rule for all contracts.
What U.S. rules apply to sports event contracts?
The legal status of sports-related event contracts is disputed, and it can depend on the state, venue, and current court orders. Federal oversight claims do not erase state enforcement, and a ruling in one case should not be read as a nationwide resolution.

What the Sixth Circuit decided in the Ohio and Tennessee cases
On September 25, 2026, the Sixth Circuit rejected Kalshi’s preliminary-injunction case concerning its sports contracts in Ohio and Tennessee. The court held that Kalshi had not shown those contracts were swaps within the CFTC’s exclusive jurisdiction. It also concluded, in the alternative, that the Commodity Exchange Act did not expressly or impliedly preempt the state gambling laws at issue. The decision concerned preliminary injunctions and sent the cases back for further proceedings; it did not settle the law for every state or every sports contract.
The CFTC’s position and proposed rule
The CFTC continues to assert exclusive federal authority in separate litigation. In a June 12, 2026 suit against New Mexico, the agency stated its position after New Mexico brought its own action against Kalshi. That is the CFTC’s litigation position, not a final resolution of the federal-state dispute.
A CFTC proposed-rule document discusses the agency’s authority over event contracts involving gaming and its review process. It describes how the Commission may determine that certain contracts involving enumerated activities are contrary to the public interest and prohibited from trading, including examining a contract as a whole. It is a proposal, not a final rule.

What protections apply on a regulated prediction market?
CFTC guidance says designated contract markets establish and enforce rules against fraud, manipulation, and unfair trading, including insider trading. It also describes exchange rules and surveillance, access to contract terms, and market-integrity protections. These are features of CFTC-regulated venues, not a blanket assurance covering every service marketed as a prediction market.
Rules do not mean misconduct never occurs. In a February 25, 2026 advisory, the CFTC Enforcement Division discussed cases involving alleged misuse of nonpublic information and fraud connected to Kalshi event contracts, and said the Commission can police illegal trading practices on a designated contract market.

How taxes fit into the comparison
Do not treat a tax paid by an operator as a platform fee charged directly to a customer. The IRS’s sports-wagering guidance, accessed in 2026, describes federal excise tax on wagers accepted by operators:
Free tools Windows power users keep installed
One-click scans. No signup required.
| Wager category in IRS guidance | Operator excise tax | What the rate describes |
|---|---|---|
| Sports wagers authorized by a state | 0.25% of the amount wagered | Tax on the operator accepting the wager, not a stated bettor fee. |
| Wagers not authorized by a state | 2% of the amount wagered | Tax on the operator accepting the wager, not a stated bettor fee. |
The IRS also says gambling winnings, including sports-betting winnings, are taxable and must be reported; withholding and Form W-2G requirements apply in specified cases. The sources here do not resolve the tax classification of every event-contract product. Consult current IRS guidance or a qualified tax professional for your circumstances.
