The two terms are often used together because a venue may list contracts whose payout depends on an election, economic release, weather reading, sports result or other defined event. They are not synonyms. The contract’s written terms—not its headline—determine what is being traded, how it is settled and which legal category may apply.
In the United States, the Commodity Futures Trading Commission (CFTC) uses “event contract” as a descriptive term rather than a defined term in the Commodity Exchange Act or CFTC regulations. Depending on its structure, an event contract may meet the statutory definition of a swap or be listed as a futures contract. A venue’s registration, the intermediary handling your account, contract liquidity and the law that applies to your location all matter before you trade.

The core distinction: venue versus instrument
Think of the difference as the difference between a stock exchange and a share. The exchange is the marketplace with an order book, trading rules and surveillance. The share is the instrument that gives you a defined financial exposure. In the same way, a prediction market is a marketplace or venue, and an event contract is the event-linked derivative listed on it.
In a March 16, 2026 advance notice of proposed rulemaking (ANPRM), the CFTC said “event contract” is not a defined term in the Commodity Exchange Act or CFTC regulations. For that notice, the agency uses “prediction market” for a CFTC-registered designated contract market (DCM) or swap execution facility (SEF) that offers event contracts. That is an agency-specific usage for the notice, not a universal dictionary definition or a conclusion that every website using the label is a regulated prediction market.

| Question | Prediction market | Event contract |
|---|---|---|
| What is it? | A marketplace or regulated venue where event-linked contracts can be quoted and traded. | A derivative contract whose payoff depends on whether a specified event occurs or on the value of an event-related outcome. |
| What do you trade? | You trade through the venue’s order book or matching system. | You buy or sell the contract itself, subject to its terms, price and settlement process. |
| What determines the result? | The venue’s rules and the contracts it lists. | The contract’s trigger, evidence source, payout formula and settlement rules. |
| Can the legal label vary? | Yes. The venue may be a DCM or SEF, if registered and operating within that framework. | Yes. The CFTC says an event contract may fit the statutory definition of a swap, while a contract listed as a future is excluded from the statutory definition of swap. Other event-linked instruments can fall under Securities and Exchange Commission (SEC) jurisdiction, including security-based swaps. |
A venue can therefore list several event contracts, each with different triggers, payout amounts, expiration dates and legal treatment. Calling the venue a “prediction market” does not tell you whether a particular contract is a future, swap or another instrument.
How an event contract creates a price
Market-implied probability
The CFTC explains that an event-contract price reflects traders’ perceived probability of the specified outcome. In a simple binary design, a contract that pays a fixed amount if an event occurs may trade at a price that resembles a probability percentage. For example, a contract quoted at 62 cents may indicate that traders, collectively, are pricing roughly a 62% chance of the defined outcome. That is an interpretation of the market price, not a guaranteed forecast, a regulator-certified probability or proof that traders are accurate.
Prices move as participants submit bids and offers, react to new information or change their willingness to hold risk. The order book commonly displays a bid—the highest current buying interest—and an ask—the lowest current selling interest. The difference between them is the spread. A narrow spread can make entry or exit easier; a wide spread can make an apparently favorable price difficult to trade in practice.
Price is not the same as probability
A quoted price is affected by more than beliefs about the event. It can reflect available liquidity, the time remaining before settlement, fees, position limits, hedging demand and the possibility that the contract’s evidence will be disputed or delayed. A market-implied probability also depends on the exact wording. “Will inflation exceed 3%?” is not interchangeable with “Will the official annual inflation rate be at least 3.0%?” The relevant data release, rounding convention and measurement period belong to the contract, not to a casual reading of the question.
Trading before the event and at settlement
Entering and exiting
CFTC consumer material says customers may trade in and out before settlement at the current market price. You are not necessarily required to hold a position until the event is resolved. To exit, you normally submit an order in the opposite direction, but the price you receive depends on the order book at that moment. A market with little activity may have no buyer near the displayed price, or may fill only part of your order.

- Liquidity: measures how readily a position can be opened or closed without moving the price substantially. It varies by contract and can change sharply when news arrives.
- Spread: the gap between the best bid and ask. Crossing a wide spread is an immediate trading cost even if the event probability has not changed.
- Timing: a contract can become harder to exit close to an announcement, during a trading halt or while the venue is waiting for official evidence.
- Fees and collateral: the account agreement and venue rules determine commissions, transaction charges, margin or other required funds. These details are contract- and operator-specific.
Settlement is a contract process
When the contract reaches its settlement point, the written terms determine whether it pays and how much. Read the provisions that specify:
- The precise trigger: the event, threshold, date and time zone.
- The authoritative evidence: an agency release, exchange result, weather observation, public statement or another named source.
- The observation window and any revisions or corrections the source may publish.
- The payout amount, whether it is binary or uses a formula, and the currency or account treatment.
- Who makes the settlement determination, when it is announced and how a dispute or review is handled.
The CFTC tells customers to expect timely and transparent information about contract terms, prices, payouts and who decides settlement and how. A plain-language headline is not a substitute for those provisions. A contract can settle differently from what a reader assumes if the official definition, source or deadline is narrower than the event as described in news coverage.

Payoff design and legal classification
Binary and other contingent payoffs
Many event contracts are described as binary because they pay one amount if a defined condition is met and another amount—often zero—if it is not. The label does not by itself establish the contract’s legal status. The CFTC’s 2026 notice says the same event-linked payoff can fit different statutory categories depending on structure.
Swap, future or security-based swap
The notice explains that an event contract may fit the Commodity Exchange Act’s statutory definition of a swap. It also notes that futures are excluded from the statutory definition of swap, so a contract listed as a future can be treated differently. Other event-linked instruments may fall under SEC jurisdiction, including security-based swaps. Determining the category requires examining the actual terms, how the instrument is offered and the applicable law; the phrase “event contract” is not enough.
This distinction affects registration, trading rules, reporting, intermediary obligations and which regulator has authority. It also means that two contracts with similar headlines—such as “Will a particular index finish above a level?”—may not have identical protections or requirements if their structures differ.

What oversight a regulated venue provides
The CFTC describes registered exchanges as responsible for their own trading rules and for monitoring anomalies and abusive conduct, with agency oversight and enforcement. Futures commission merchants and other intermediaries have additional obligations. Those safeguards can improve transparency and market integrity, but they do not eliminate financial risk, guarantee liquidity or prevent every settlement dispute.

- Venue rules: define order handling, trading hours, position limits, halts, error corrections and settlement procedures.
- Market surveillance: looks for manipulation, unusual activity and other rule violations; surveillance is not a promise that a contract will be profitable.
- Intermediary controls: an intermediary may have duties involving customer funds, disclosures, records and execution, depending on its registration and role.
- Enforcement: the CFTC can investigate and enforce applicable rules, but enforcement authority does not make every product available to every person or resolve every private dispute.
U.S. regulatory status in 2026
The March 2026 ANPRM is a request for information
The CFTC’s March 16, 2026 publication is an advance notice of proposed rulemaking. It asks for information about event contracts and prediction markets, including registration, listing requirements, manipulation risks and the Commission’s authority to prohibit particular contracts it determines are contrary to the public interest. An ANPRM is not a final rule. It does not settle every contract category, establish a nationwide approval for every operator or resolve all jurisdictional disputes.
Contract-specific review can matter
The CFTC staff index lists a September 22, 2026 advisory concerning so-called “mention markets”—contracts tied to whether a person says specified words, appears at an event or interacts with another person. The index says staff described limited circumstances in which such contracts might be listed and emphasized complete, contract-specific analysis and manipulation concerns. That is staff guidance about a particular class of contract, not a blanket conclusion about all event contracts.
Jurisdiction and customer access
The CFTC asserts exclusive jurisdiction over certain commodity derivatives traded on registered markets. State authorities and private parties have challenged how some contracts should be treated, and the materials available do not establish a complete outcome for every lawsuit, state, operator or contract. Do not assume that a product is lawful nationwide, available in every state or regulated identically merely because it uses the term “prediction market.” Check the operator’s registration, the specific contract rules and the law applicable where you are located.
How the market has expanded
CFTC figures show a sharp increase in the number of event contracts submitted for listing, although these figures do not measure trading volume, revenue or the number of active traders.

| Period | Figure | What it measures |
|---|---|---|
| 2006–2020 | Approximately five event contracts per year on average | Contracts listed by designated contract markets, according to the CFTC’s 2026 notice. |
| 2021 | 131 event contracts | Event contracts listed during the year. |
| 2025 | Approximately 1,600 event contracts | Contracts certified for listing. The CFTC says they covered financial indices, economic indicators, weather, political and international events, science, culture, current events and sports. |
“Certified for listing” means a contract was accepted into the listing process under the applicable framework. It does not mean that the contract traded actively, attracted a particular number of users or had a specific volume.
Independent reader supportYour contribution helps us test, update, and keep practical guides available for everyone. What to check before using a prediction market
1. Verify the venue and account structure
- Identify whether the operator is a CFTC-registered DCM, SEF or another type of service.
- Identify the intermediary holding or routing your funds and its registration status.
- Confirm that customers in your state or territory are permitted to access the product.
- Read the fee schedule, funding rules, withdrawal conditions and disclosures before placing an order.
2. Read the entire contract specification
- Copy the exact event definition, threshold, deadline and time zone into your notes.
- Find the named data source or evidence provider and determine whether preliminary, revised or corrected data controls.
- Check the payout amount, settlement date, minimum tick, position limits and any collateral or margin requirement.
- Read the error, halt, cancellation and dispute provisions.
3. Test the practical exit
- Look at both bid and ask prices, not just a single headline quote.
- Estimate the spread and any fees for entering and exiting.
- Check recent trading activity and displayed depth at several price levels.
- Decide in advance what you will do if the market becomes illiquid or settlement evidence is delayed.
4. Separate information from certainty
Use the quoted price as a snapshot of participants’ collective pricing under the contract’s rules. It is not a promise that the event will occur, a substitute for independent analysis or an assurance that you can exit at the same price later.
Common mistakes and how to avoid them
Confusing the venue with the contract
A website or exchange name describes where trading occurs. It does not tell you the payout, legal classification or settlement evidence for every listed product. Start with the contract specification.
Treating a headline as the trigger
News reports may use broad language while the contract uses a narrow official definition. A person “appearing” at an event, for example, could depend on a precise time window, location or evidence source. The written trigger controls.
Assuming a price is a certified probability
Prices incorporate liquidity, fees, risk preferences and the possibility of trading out before settlement. They are market-implied estimates, not regulator-approved forecasts.
Best Value
Ignoring the exit price
The last traded price may not be available for your order size. Review the current bid, ask and depth, and account for the spread before deciding that a position can be closed easily.
Reading an ANPRM as final law
The March 2026 CFTC notice seeks information and discusses possible regulatory approaches. It is not binding final rulemaking and does not answer every state or contract-specific question.
Assuming oversight removes loss risk
Registered-venue safeguards address rules, surveillance and intermediary duties. They do not guarantee a favorable outcome, continuous liquidity or the absence of disputes.
A practical decision framework
If you want event information
Use the market price as one observable signal of how participants are pricing the contract-defined outcome. Compare it with the contract’s evidence source and timing, and remember that the signal can be distorted by low liquidity or a wide spread.
If you want to hedge a business exposure
First match the contract trigger to the risk you actually face. A broad economic or weather headline may not track your company’s revenue, costs or geographic exposure. Then confirm the payout size, expiration and ability to exit before relying on the position as a hedge. The CFTC Chairman has said event contracts can help businesses hedge event-driven risks and investors manage portfolio exposure; that is a stated policy view, not a guarantee that a particular contract will offset your loss.
If you want to speculate
Limit the amount at risk to what you can afford to lose, define the maximum loss and identify the settlement evidence before trading. A binary-looking payoff can still involve execution risk, fees, illiquidity and legal or access changes.
Questions to ask when two products look similar
| Comparison point | What to ask |
|---|---|
| Venue versus instrument | Is this the registered marketplace, or the specific contract being offered? |
| Payoff and classification | What does the contract pay, and is it structured as a future, swap or another instrument? |
| Price and liquidity | What are the current bid, ask, spread and available size? |
| Trigger and evidence | What exact event, source, threshold, time zone and revision policy control settlement? |
| Oversight | Which entity sets the rules, monitors trading and handles customer funds? |
| Jurisdiction | Can a customer in the relevant state or territory legally access this contract today? |
Bottom line
A prediction market is the venue; an event contract is the contingent-payoff instrument traded there. The contract price can provide a market-implied probability, but it is not a guaranteed forecast. The contract specification controls the trigger, evidence, payout and settlement process, while the instrument’s structure determines whether it may be treated as a future, swap or another regulated product. In the United States, the CFTC’s 2026 policy discussion is still at the advance-notice stage, so verify the venue, intermediary, contract terms, liquidity and jurisdiction before treating any product as available or suitable.
