Portugal Prosecutors Probe US Use of Lajes Base During Iran War

Portugal’s Prosecutor General’s Office has opened an investigation into the government’s authorisation for the United States to use Lajes Air Base in the Azores during the Iran conflict. The investigation followed a complaint by members of the Left Bloc, but the office has not publicly described its scope or findings. Its opening does not establish that the authorisation was unlawful.

What prosecutors have—and have not—said

Reuters reported on 3 October 2026 that the Prosecutor General’s Office had opened an investigation after receiving a complaint from Left Bloc members. RTP, which reported the complaint in April, said it asked prosecutors to examine whether the use of Lajes complied with the law. Reuters said the office provided no further details. The reported announcement does not identify the legal provisions being examined, evidence collected, investigative steps, or a timetable. Nor does it report a conclusion that the government broke the law or acted properly. Those points remain unresolved in the public accounts cited here.

What Portugal’s government says it authorised

On 5 March 2026, Prime Minister Luís Montenegro said the United States had made a formal request to use Lajes after the strike and that Portugal granted conditional authorisation. He described the permitted operations as defensive or retaliatory, necessary and proportionate, and limited to military targets. On 2 April, Foreign Minister Paulo Rangel told Parliament that US use of Lajes complied with international law under the conditions he described: a response to a necessary and proportionate strike that did not target civilians. The government also said Portugal was not involved in the Iran conflict. Rangel’s statement expresses the government’s legal position; it is not an independent legal ruling. The complaint and the government’s position

According to the reporting, the complainants alleged a serious breach of international law and asked prosecutors to examine whether use of the base respected the law. The government, by contrast, says it imposed limits on the authorisation and considers the use lawful under the circumstances it outlined. The investigation places those competing positions under scrutiny; it does not itself resolve them.

Reuters also reported that a longstanding agreement permits US use of Lajes without prior authorisation in peacetime but requires Portuguese approval once hostilities begin. That is Reuters’ description of the agreement; the agreement text and the specific authorisation documents are not reproduced in the public accounts cited here. How the issue reached Parliament

The investigation is one part of a wider political dispute over Portugal’s role and the use of Lajes. A parliamentary record documents a debate on 2 June 2026 concerning inquiries into Portugal’s involvement in the conflict and the granting of Lajes and national airspace for logistical support to US and Israeli military operations. What would clarify the case

A clearer account of the legal question would require public information about the investigation’s scope and, if released, the relevant authorisation and agreement documents. The available reporting does not establish what evidence prosecutors are examining or whether they have reached any view. Until the authorities disclose more, the distinction is important: Portugal’s government has defended its conditional approval, while prosecutors’ reported decision to investigate is a procedural development rather than a verdict.
