Poland’s competition regulator alleges that Google offered press publishers payment for use of their articles without sharing the data needed to judge or negotiate those offers. The case is an active investigation—not a finding that Google broke the law—and concerns Google Search, Google News and Google Discover.
What Poland alleges Google did
On October 5, 2026, Poland’s Office of Competition and Consumer Protection (UOKiK) announced allegations against four companies in Google’s corporate group. The authority says Google had not signed agreements with most Polish press publishers setting terms and remuneration for use of their publications in Search, News and Discover. UOKiK’s announcement describes the dispute as involving negotiations with organizations representing Polish publishers.

The central allegation is that publishers were asked to assess remuneration offers without information UOKiK says they needed to evaluate them. The authority says Google did not explain how it used press publications, the revenue it received from that use, the parameters behind its calculations, or provide documents that would let publishers verify the assumptions. UOKiK says this left publishers unable to judge whether offers were worthwhile or make their own data-supported proposals. These are the regulator’s allegations, not adjudicated findings.
Why the information matters to publishers
UOKiK’s policy concern is that search and recommendation services may show article excerpts or AI-generated summaries, giving users information without a click through to a publisher’s full story. The regulator says this can combine platform advertising revenue with lower traffic and revenue for publishers. It has not quantified that effect in this announcement, so it should be understood as the authority’s explanation of the issue, not a measured estimate of the impact in this case.

Poland’s copyright amendment implementing the EU Digital Single Market Directive allows platforms to use press publications for remuneration and requires them to provide information publishers need to determine that remuneration. The Polish Ministry of Culture and National Heritage explained the amendment and negotiation framework in 2024 (Ministry explanation, July 26, 2024). The amendment entered into force on September 20, 2024, according to the Office of Electronic Communications (UKE).
Who handles negotiations and payment disputes?
Two Polish authorities have distinct roles. UOKiK investigates the competition-law allegation; it says it is not a party to publisher negotiations and does not decide whether a proposed payment rate is appropriate. UKE administers the statutory remuneration procedure, including mediation and, when legal conditions are met, a possible determination of the amount or calculation method.
Rank #2
| Authority | Role in the dispute |
|---|---|
| UOKiK | Investigates suspected abuse of a dominant position in negotiations. Dominance alone is not prohibited; the alleged issue is using market power to impose unfair terms. |
| UKE | Handles the remuneration procedure: parties negotiate first, may seek mediation, and UKE may determine the amount or method of calculation if mediation fails and statutory conditions are met. |
UKE says remuneration considerations include the service provider’s revenue from reproducing or making publications available—including advertising revenue—over the last two full financial years, the type of press publication, and the period of use. Either party may request mediation if no agreement has been reached within three months after an offer to conclude an agreement. See UKE’s mediation explainer, February 24, 2026, for the procedure.

No. UOKiK’s October 5, 2026 announcement reports allegations and an investigation, not a final infringement decision, a payment order or a fine in this case. The authority says competition law permits a penalty of up to 10% of an undertaking’s turnover for the conduct it describes. That is a statutory maximum cited by UOKiK, not a proposed or imposed penalty against Google here.
How the Polish case differs from Spain’s Google settlement
Spain offers a comparison of possible regulatory remedies, not evidence of what happened in Poland. In December 2025, Spain’s competition authority, the CNMC, accepted commitments from Google after proceedings about possible abuse in negotiations with Spanish publishers and news agencies. The commitments include explaining remuneration methodology, parameters and relevant advertising revenue; setting negotiation phases and deadlines; annual review of offers; and specified separation of press-publication negotiations from Google News Showcase and other services. The CNMC said the settlement closed proceedings without an infringement finding or fine; the commitments are binding and monitored. CNMC announcement, December 19, 2025.
That Spanish outcome does not determine the merits or likely outcome of Poland’s pending investigation. The cases concern separate proceedings and should not be treated as decisions on identical facts.

UOKiK expressly distinguishes its investigation from a European Commission proceeding concerning Google AI services. The Polish allegations concern press content in Search results, Google News and Discover. The authority says the proceedings are independent; the Polish case should not be described as an investigation into AI summaries unless a source specifically establishes that connection.
