Choose standard PERM when your employer’s job is not a Schedule A occupation. Choose Schedule A only when the offered permanent job is a qualifying professional-nurse or physical-therapist position and you can document the required license or credential. Schedule A removes the ordinary PERM recruitment test; it does not remove labor-certification paperwork, employer sponsorship, the immigrant-petition process, or the need to qualify for an employment-based preference category.
A third possibility is an EB-2 national interest waiver (NIW). NIW is a separate waiver route that can waive the job-offer and labor-certification requirements in a qualifying case; it is neither PERM nor Schedule A. The right comparison therefore starts with the job and evidence, not with which process sounds faster.

PERM and Schedule A in one view
| Question | Standard PERM | Schedule A Group I |
|---|---|---|
| Which jobs can use it? | Generally eligible employer-sponsored permanent jobs outside applicable exceptions. | Qualifying professional nurses and physical therapists listed in Group I. |
| Is a U.S. labor-market test required? | Yes. The employer conducts the required recruitment and asks the Department of Labor (DOL) to certify that qualified, willing and available U.S. workers are not sufficient for the opportunity. | No ordinary PERM recruitment test. DOL has already designated the listed occupation level for Schedule A treatment. |
| Where is ETA Form 9089 handled? | The employer submits the labor-certification application to DOL. If certified, it accompanies Form I-140 to U.S. Citizenship and Immigration Services (USCIS). | The employer submits the Schedule A package, including ETA-9089 and supporting evidence, to the appropriate DHS/USCIS office with the immigrant-petition filing. |
| What additional worker proof matters? | The worker must meet the employer’s stated minimum requirements and the requirements of the chosen immigrant classification. | The worker must also satisfy the Group I occupation-specific license or credential rule. |
| Who sponsors? | The employer. | The employer. |
DOL describes PERM as the process through which an employer obtains certification that there are not enough able, willing, qualified and available U.S. workers for the job, and that hiring the foreign worker will not adversely affect similarly employed U.S. workers’ wages and working conditions. See the DOL permanent labor-certification overview and the DOL FLAG PERM process.
Do these 3 things before closing this tab:
1Clear out junk files and repair common Windows errors2Fix the driver behind crashes, sound loss and screen glitches3Repair Windows errors before they cause bigger problemsSchedule A is an exception inside that labor-certification framework. The regulation’s preamble says DOL determined that sufficient U.S. workers were not available for the occupations listed on Schedule A and that similarly employed U.S. workers’ wages and working conditions would not be adversely affected. That occupation-level determination is why the employer does not repeat the standard PERM recruitment test, but it does not turn Schedule A into an automatic green card.

What standard PERM actually requires
An employer-led test of the offered job
PERM focuses on a specific, permanent employment opportunity and the employer’s recruitment record. The employer, not the foreign worker, controls the filing. The job’s duties, minimum education, experience and other requirements must be defined before recruitment and must be the requirements the sponsored worker can satisfy. A worker cannot substitute a résumé for an employer’s recruitment obligations.
The normal PERM sequence
- Define the permanent opportunity. The employer establishes the job, duties, work location and minimum requirements for the sponsored position.
- Obtain a prevailing-wage determination. The employer obtains the wage information used for the labor-certification process.
- Conduct the required recruitment. Recruitment is designed to test whether able, willing, qualified and available U.S. workers can fill the opportunity under the stated terms.
- Evaluate applicants and preserve the record. The employer must handle U.S. applicants consistently with the stated requirements and maintain the supporting record for the filing.
- File ETA Form 9089 with DOL. The employer asks DOL to certify the opportunity after completing the required steps.
- Use the certification in the immigrant-petition stage. After certification, the labor certification is submitted with Form I-140 to USCIS, followed by the available adjustment-of-status or immigrant-visa stage when the worker is otherwise eligible.
The purpose is not to prove that no American could ever perform the work. It is to document the regulatory test for this opportunity, in this location and under these stated requirements. An employer’s general difficulty hiring, a desire to retain a particular employee or a worker’s foreign degree does not by itself make a job PERM-exempt.
What Schedule A changes—and what it does not
The recruitment test is the main difference
For a listed Schedule A occupation, DOL has made the occupation-level finding that supports the exception. The employer therefore does not run the ordinary PERM labor-market recruitment process before filing. This is best understood as streamlined labor certification, not as no labor certification.

The employer still obtains prevailing-wage information, provides the required notice of filing and completes ETA Form 9089. The Schedule A evidence and labor-certification materials are filed with the appropriate DHS/USCIS office rather than sent through the ordinary DOL PERM certification route. The governing DOL publication reproducing the 20 CFR Part 656 provisions is available at 69 Fed. Reg. 77326 (Dec. 27, 2004).
Schedule A does not create EB-2 or EB-3 eligibility
Schedule A is not an immigrant classification. The employer and worker must still qualify for the applicable employment-based preference category, commonly EB-2 or EB-3 depending on the job and the worker’s qualifications. The route also still requires an employer-sponsored permanent position and an approved immigrant petition. A Schedule A filing can therefore fail even when the occupation is listed if the worker cannot prove the required credentials, the job does not meet the classification rules or another part of the petition is deficient.
Who qualifies for Schedule A Group I?
Group I is narrow. It covers qualifying professional nurses and physical therapists, not every health-care occupation and not every job that involves patient care. The occupation, duties, state of intended employment and documentary evidence must line up.

Professional nurses
The regulation provides three alternative ways for a professional nurse to satisfy the listed credential requirement:

- An unrestricted permanent license to practice professional nursing in the state where the nurse intends to work; or
- Passing the National Council Licensure Examination for Registered Nurses (NCLEX-RN).
These are occupation-specific Schedule A proofs. A temporary authorization, an unrelated nursing credential or an employer’s statement that the worker is qualified should not be treated as interchangeable with the listed evidence. The intended state matters because the regulation ties licensing evidence to the place of employment.
Physical therapists
A physical therapist must possess the qualifications necessary to take the licensing examination in the intended state. The filing uses the statement or certification specified by the state licensing official to establish that qualification. The requirement is therefore more than showing a physical-therapy degree: the evidence must address examination eligibility under the intended state’s licensing system.
Group I is different from Group II
Schedule A also contains Group II criteria, but those criteria are separate from the Group I nurse and physical-therapist rules discussed here. A job outside Group I does not become eligible merely because the employer has struggled to recruit. If a proposed position is not covered by the applicable Schedule A list and no other exception applies, standard PERM is the employer-sponsored labor-certification route to analyze.
How a Schedule A Group I filing works
- Confirm the occupation and duties. Match the permanent job to professional nursing or physical therapy as actually performed, rather than relying only on a title.
- Confirm the intended state. Licensing and examination evidence must correspond to the state where the worker will practice.
- Collect the Group I proof. A nurse gathers the applicable CGFNS certification, unrestricted permanent state license or NCLEX-RN evidence. A physical therapist gathers proof of eligibility to take the state licensing examination and the required licensing-official statement.
- Obtain prevailing-wage information. Schedule A avoids the standard recruitment test, not the wage documentation.
- Give the required notice of filing. The employer completes the notice step required for the Schedule A labor-certification package.
- Complete ETA Form 9089 and assemble the filing. The employer includes the job information, prevailing-wage details and Schedule A evidence.
- Submit the materials with the USCIS/DHS immigrant-petition filing. The package is filed through the Schedule A route, rather than first seeking ordinary PERM certification from DOL.
The employer remains responsible for the sponsorship and for ensuring that the offered job and supporting documents are consistent. Schedule A does not let a worker self-petition merely because the worker holds a nursing or physical-therapy credential.

NIW: a separate question, not a shortcut label
An EB-2 national interest waiver can waive the job-offer and labor-certification requirements for a qualifying case. That makes NIW structurally different from both PERM and Schedule A: it is a waiver theory, not an exception that an employer elects for a listed occupation.
NIW cases can also have different mobility consequences because the petition is not tied to the same employer-sponsored labor-certification structure. However, the complete current NIW eligibility test is not addressed here. Do not assume that a worker who dislikes recruitment automatically qualifies, or that a nurse, physical therapist or other professional receives an NIW simply from holding an advanced degree or working in a high-demand field. A separate analysis must establish the current EB-2 and waiver requirements.
Choosing the route: a practical decision framework
Start with the job, not the worker’s nationality
- Is the offered permanent job professional nursing or physical therapy? If yes, test Group I occupation and evidence rules first.
- Is the job outside the listed occupations? Analyze standard PERM unless a different legal basis, such as a potentially viable NIW, applies.
- Does the employer control the sponsorship? Both PERM and Schedule A are employer-led. An unwilling or unable employer cannot be replaced by the worker’s preference for one route.
- Can the worker meet the exact job requirements? The worker must satisfy the employer’s minimum requirements and the relevant preference-category rules; Schedule A adds its own credential evidence.
Examples
- Registered nurse with NCLEX-RN passage and a permanent job offer in the state of intended practice: Schedule A Group I may be the labor-certification route to evaluate, provided the employer completes the required filing and the petition’s other requirements are met.
- Physical therapist eligible for the intended state’s licensing examination: Schedule A Group I may be available when the required licensing-official documentation supports that eligibility.
- Software engineer whose employer cannot find enough applicants: Recruiting difficulty alone does not create Schedule A eligibility. Standard PERM is the route to examine unless another legal basis applies.
- Professional considering a self-directed EB-2 theory: NIW is a distinct possibility to investigate, but it requires its own eligibility analysis and is not guaranteed by avoiding PERM.
Documents and facts to assemble before deciding
A reliable route analysis depends on facts that are often missing from an initial question. Gather the following before asking an employer or lawyer to choose a filing strategy:
- The offered occupation, detailed duties, worksite and intended state;
- The employer’s written minimum education, experience, license and skill requirements;
- Whether the job is permanent and whether the employer is willing and able to sponsor;
- For a nurse: CGFNS certification, an unrestricted permanent state license or NCLEX-RN evidence, as applicable;
- For a physical therapist: proof of qualifications to take the intended state’s licensing examination and the required licensing-official statement;
- Foreign-degree evaluations, licenses and translations that support the claimed requirements;
- The proposed EB-2 or EB-3 classification and the worker’s evidence for that category;
- Priority-date and visa-availability information for the relevant category and country of chargeability; and
- Whether a separate NIW theory is realistically available.
This checklist identifies decision inputs; it does not determine eligibility or predict approval.
Job changes and portability after filing
Route choice can affect what happens after an immigrant petition and adjustment application are filed. USCIS describes AC21 portability for certain employment-based adjustment applicants whose adjustment application has been pending for at least 180 days, when the required same-or-similar-occupation condition is met. The rule is not an unrestricted right to change employers, and the underlying petition and adjustment requirements still matter.

USCIS also explains that extraordinary-ability and NIW cases are exceptions to that portability provision. That distinction is one reason not to treat all employment-based routes as interchangeable. Read the current USCIS discussion of transfer of the underlying basis and portability before relying on a planned job change.
Common mistakes and how to correct them
“Schedule A means no labor certification.”
Why it fails: The employer still files ETA-9089, prevailing-wage information, the notice of filing and occupation-specific evidence. Correction: Describe Schedule A as an exception to the ordinary recruitment test, not as an exemption from all labor-certification materials.
“Any nurse or therapist can use Schedule A.”
Why it fails: Group I is limited to qualifying professional nurses and physical therapists, with specific evidence rules. Correction: Match the actual job and state-specific credential evidence before selecting the route.
“A hard-to-fill job is automatically Schedule A.”
Why it fails: Employer recruiting problems do not expand the regulatory list. Correction: Use standard PERM for an otherwise eligible job outside the list, unless another legal basis applies.
Best Value
“Schedule A guarantees an EB-2 or EB-3 green card.”
Why it fails: Schedule A does not establish preference-category eligibility, petition approval, visa availability or adjustment eligibility. Correction: Treat labor certification as one stage in a larger process.
“The worker can change jobs freely after 180 days.”
Why it fails: USCIS’s portability discussion includes conditions, including a same-or-similar occupation requirement, and identifies exceptions. Correction: Review the current USCIS policy and the facts of the approved petition before moving.
What the comparison can—and cannot—tell you
The broad distinction is stable: PERM is the ordinary employer-led labor certification with a recruitment test; Schedule A Group I is a listed-occupation exception for qualifying professional nurses and physical therapists; NIW is a separate waiver route. The comparison does not provide a visa-bulletin prediction, processing-time estimate or filing-fee quote. Those items change by category, country, agency policy and date and must be checked against current official notices.
Because the Schedule A regulatory text cited here reproduces the 2004 final rule, verify the current eCFR language if a later amendment is suspected. Likewise, consult the current USCIS Policy Manual page when evaluating portability or an NIW strategy. Individual eligibility depends on the offered duties, licensing evidence, employer sponsorship, classification, visa availability and the complete record.
Quick Recap
A concise route checklist
- Identify the permanent job and state of intended employment.
- Test whether the job is actually professional nursing or physical therapy under Schedule A Group I.
- If it is Group I, verify the nurse’s or therapist’s exact credential evidence.
- If it is not listed, map the employer’s job to the standard PERM sequence.
- Confirm the employer’s willingness and ability to sponsor and to support the required filing record.
- Choose the intended EB-2 or EB-3 classification independently of the labor-certification route.
- Consider NIW only as a separate, fact-specific waiver analysis.
- Check current visa availability and USCIS portability rules before making timing or job-change decisions.
