PERM vs. EB-2 NIW: Eligibility, Process, and Employer Requirements

PERM and EB-2 National Interest Waiver (NIW) are different employment-based immigration structures. PERM is normally an employer-led labor-certification process for a specific permanent, full-time U.S. job. EB-2 NIW is an EB-2 immigrant petition in which the applicant asks USCIS to waive the usual job-offer and labor-certification requirements because the proposed work serves the national interest.

Neither route is automatically faster, easier, or more likely to succeed. PERM depends on the employer, job, prevailing wage, recruitment and labor-market test. NIW requires the applicant to qualify for the underlying EB-2 category and then satisfy USCIS’s three-prong, discretionary national-interest analysis.

The structural difference between PERM and EB-2 NIW

The key question is who is asking the government for what. In a PERM case, a U.S. employer asks the Department of Labor (DOL) to certify that it has a qualifying permanent job and that hiring the foreign worker will not displace or disadvantage available U.S. workers. After certification, the employer uses that certification in an employment-based immigrant petition.

In an EB-2 NIW case, the petitioner asks U.S. Citizenship and Immigration Services (USCIS) to classify the person under EB-2 and waive the normal job-offer and labor-certification requirements. USCIS evaluates the applicant’s qualifications and the national-interest rationale for the proposed endeavor. A person may self-petition for an NIW, but self-petitioning does not remove the underlying EB-2 or evidentiary requirements.

Issue PERM labor certification EB-2 NIW
Government request DOL certification that the permanent job’s wage and labor-market requirements are satisfied. USCIS EB-2 classification plus a discretionary waiver of the job-offer and labor-certification requirements.
Who normally files The qualifying U.S. employer. DOL states that “The filing of applications is the responsibility of the employer, not the employee.” The worker may file on their own behalf; an employer is not required if the NIW is granted.
Job requirement A specific permanent, full-time job opportunity is central to the filing. No permanent job offer is required when the waiver is approved.
Primary eligibility focus Employer, job requirements, prevailing wage, recruitment and availability of U.S. workers. Underlying EB-2 eligibility plus all three NIW prongs.
Main agencies and stages DOL labor certification, followed by an employer-filed Form I-140 with USCIS. USCIS adjudication of an I-140-based EB-2 NIW petition and supporting evidence.

See the DOL’s Permanent Labor Certification page and the USCIS January 15, 2025 NIW policy alert for the governing descriptions.

Who can use the PERM route?

A qualifying U.S. employer

PERM is generally unavailable as a worker-only filing. The sponsoring employer must be a qualifying U.S. employer with a valid Federal Employer Identification Number (FEIN) and a U.S. location to which U.S. workers can be referred. The employer identifies the position, controls the recruitment process and submits the application.

A permanent, full-time job opportunity

The job must be a permanent, full-time position. The employer must define the actual minimum requirements for the offered role and be prepared to employ the foreign worker under those terms if the case proceeds. PERM is therefore tied to a particular position, worksite or intended employment area, and set of job requirements rather than to a résumé in the abstract.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Proof that U.S. workers are not adversely affected

DOL describes the labor-certification purpose as showing that there are not sufficient U.S. workers who are able, willing, qualified and available for the job in the intended employment area. The employer must also show that employing the foreign worker will not adversely affect the wages and working conditions of similarly employed U.S. workers.

Prevailing wage before filing

Before filing PERM, the employer must obtain a valid prevailing wage determination from DOL’s National Prevailing Wage Center. The employer requests that determination using Form ETA-9141. The prevailing wage is a government-determined benchmark for the occupation and conditions described; it is not automatically the worker’s guaranteed salary, a particular wage level selected by the employee, or a finding that the foreign worker qualifies for the position. DOL’s wage resources are available at Prevailing Wage Information and Resources.

Recruitment and notice obligations

The employer must complete the applicable pre-filing recruitment and notice-of-filing steps before submitting the PERM application. The exact recruitment requirements depend on the occupation and the governing regulatory provision. The employer must document compliance rather than merely assert that recruitment occurred.

PERM process: the employer-led sequence

  1. Define the job. Identify a permanent, full-time opportunity, its duties, minimum requirements and intended employment area. The requirements should describe the genuine job rather than being tailored to the foreign worker’s résumé.
  2. Confirm employer eligibility. The sponsoring company should have a valid FEIN and a U.S. location where U.S. workers can be referred.
  3. Request the prevailing wage. Submit Form ETA-9141 to the National Prevailing Wage Center and receive the determination before filing PERM. Keep the determination with the case records.
  4. Conduct required recruitment and notice. Complete the recruitment steps that apply to the occupation and provide the required notice of filing. Record dates, locations, responses and disposition of applicants so the employer can demonstrate compliance.
  5. File ETA Form 9089 with DOL. The employer, not the employee, submits the PERM application through DOL’s process described on the FLAG Permanent Labor Certification (PERM) page.
  6. Use certification in the immigrant petition. If DOL certifies the application, the employer submits the certified labor certification to the appropriate USCIS service center with Form I-140. DOL states that the certification expires if it is not submitted within 180 days. That 180-day period is the validity window for submission, not an estimate of total case processing time.

PERM certification and the I-140 are separate stages. A DOL certification does not itself grant permanent residence; it supplies the labor-certification component for the employer’s subsequent USCIS petition.

Who qualifies for EB-2 NIW?

First satisfy the underlying EB-2 category

USCIS’s January 15, 2025 policy alert makes the order explicit: the applicant must first qualify for EB-2 as either an advanced-degree professional or a person of exceptional ability. Only then does USCIS evaluate the request for a national interest waiver.

Advanced-degree professional

An advanced degree generally means a U.S. academic or professional degree, or a foreign equivalent, above a bachelor’s degree. USCIS also explains that a U.S. bachelor’s degree or foreign equivalent followed by at least five years of progressive experience in the specialty may be considered equivalent to an advanced degree. The equivalency must be evaluated against the particular specialty and current USCIS policy; five years of experience is not a universal substitute for every educational requirement.

Person of exceptional ability

An applicant who does not qualify through the advanced-degree pathway may seek EB-2 classification as a person of exceptional ability. The NIW request still cannot be considered in isolation: the petition must establish the underlying EB-2 classification and then address the waiver framework.

The three NIW prongs USCIS applies

USCIS evaluates an NIW request under a three-part, evidence-based framework. The analysis is discretionary and case-specific. A strong résumé, advanced degree or impressive job title does not automatically establish any prong.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Prong 1: The proposed endeavor has substantial merit and national importance

The petition must identify a specific proposed endeavor and explain why it has substantial merit and national importance. The focus is the endeavor itself, not simply the general importance of the applicant’s occupation. The statement should make clear what the applicant proposes to do, the field or problem addressed and why the endeavor matters beyond an ordinary employment description.

Prong 2: The petitioner is well positioned to advance the endeavor

The applicant must show that they are well positioned to advance the identified endeavor. Evidence should connect the person’s education, experience and demonstrated work to the proposed activities. USCIS is looking for a credible connection between the applicant and the endeavor, not a prediction based only on future aspirations.

Prong 3: On balance, waiving the job offer and labor certification benefits the United States

Finally, the petitioner must establish that, on balance, the United States would benefit from waiving the conventional job-offer and labor-certification requirements. This is a comparative judgment: the petition explains why requiring a particular employer-sponsored job and labor-market test would be less useful than allowing the applicant to pursue the proposed endeavor under the national-interest framework.

USCIS’s administrative decision applying the framework illustrates how the prongs are analyzed in an actual case; it is available at Administrative decision applying the NIW framework.

How the NIW filing works

  1. Select the EB-2 basis. Organize evidence showing qualification as an advanced-degree professional or person of exceptional ability. If relying on the bachelor’s-plus-five-years equivalency, document the degree equivalency and progressive specialty experience.
  2. Define one coherent endeavor. Describe the work the applicant proposes to advance in the United States. Avoid treating a broad occupation, employer name or list of credentials as the endeavor itself.
  3. Prepare evidence for each prong. Match documents and explanations separately to substantial merit and national importance, the applicant’s positioning, and the balance favoring a waiver.
  4. File the I-140-based EB-2 NIW petition. USCIS permits persons seeking a national interest waiver to file on their own behalf. An employer may support the case, but an employer-sponsored permanent job is not a prerequisite when the NIW is granted.
  5. Respond to USCIS requests accurately. Any request for evidence should be answered with material that addresses the specific deficiency identified by USCIS rather than repeating general career information.

USCIS states: “Persons seeking a national interest waiver can file the petition on their own behalf.” The statement describes who may file; it is not a promise of approval.

Employer requirements compared directly

Employer-related question PERM EB-2 NIW
Must there be a U.S. employer sponsor? Yes, a qualifying employer normally drives the filing. No employer job offer is required when the NIW is granted, and the applicant may self-petition.
Who defines the job or endeavor? The employer defines the permanent job, duties and minimum requirements. The petitioner defines the proposed endeavor and explains its national-interest significance.
Is a prevailing wage determination required? Yes, it must be received before PERM filing. Not as a PERM prerequisite, because the waiver request seeks to remove the job-offer and labor-certification requirements.
Is recruitment of U.S. workers required? Yes, applicable recruitment and notice steps must be completed and documented. There is no PERM recruitment process when the waiver is granted.
What happens if the employment relationship changes? The certification is tied to the certified job and employer filing; changes can affect the case and require case-specific legal analysis. The petition is centered on the applicant’s proposed endeavor rather than one PERM-certified position, but the scope of the endeavor and evidence still matter.

The table describes the structure of each route, not a guarantee that any particular petition will be approved.

Choosing between PERM and NIW

PERM is usually the better fit when

  • A U.S. employer has a genuine permanent, full-time position and is prepared to sponsor it.
  • The employer can define requirements, obtain the prevailing wage and complete the required recruitment and notice steps.
  • The immigration strategy is tied to continuing employment in that specific sponsored role.

NIW may fit when

  • The applicant can first establish EB-2 eligibility independently of a particular employer.
  • The proposed work can be articulated as a specific endeavor with substantial merit and national importance.
  • The evidence shows the applicant is well positioned to advance that endeavor and that waiving the job offer and labor certification benefits the United States.

Neither label answers the case by itself

Choosing NIW solely because it permits self-petitioning is incomplete; the applicant still faces the EB-2 threshold and all three discretionary prongs. Choosing PERM solely because an employer is willing to sponsor is also incomplete; the employer must satisfy the labor-market, wage, recruitment and filing requirements for the actual job.

Timing, validity and what cannot be inferred

The available official material does not establish comparable current, end-to-end timelines for PERM and NIW. Processing times can vary by agency workload, case facts, requests for evidence and later immigration steps. Therefore, neither pathway should be described categorically as faster based only on its name.

The concrete time figure in the PERM process is the 180-day validity period for a certified labor application. The employer must submit the certification to USCIS with Form I-140 within that period. It is not a prediction that the entire PERM or green-card process will finish in 180 days.

No reliable approval rate, average duration or success percentage is established here. Quoting such figures without a dated source and a clear definition can mislead applicants because the underlying populations and stages differ.

Common mistakes and how to avoid them

Calling NIW an automatic waiver

NIW is discretionary. The waiver request does not bypass EB-2 eligibility, and a résumé alone does not prove national importance or positioning.

Treating a job title as the NIW endeavor

A title such as engineer, researcher or entrepreneur identifies an occupation, not necessarily a proposed endeavor. The petition must explain the specific work and its national-interest rationale.

Confusing prevailing wage with salary or qualification

DOL’s prevailing wage determination is a benchmark for the job as described. It is not a guaranteed salary and does not certify that the foreign worker meets the job requirements.

Starting recruitment before wage and job details are settled

PERM requires the prevailing wage determination before filing, and recruitment must correspond to the actual position and applicable rules. Changing the job requirements midstream can undermine the consistency of the record.

Missing the certification deadline

A certified PERM application that is not submitted to USCIS with Form I-140 within 180 days expires for that purpose. Employers should calendar the deadline when certification is issued.

Assuming self-petition means no employer evidence matters

NIW removes the need for a sponsoring job offer if granted, but the petition still needs a persuasive, evidence-based explanation of the endeavor and the applicant’s ability to advance it.

Preparation checklist

For a PERM case

  • Confirm the employer has a valid FEIN and qualifying U.S. location.
  • Write the permanent, full-time job description and minimum requirements accurately.
  • Request and receive the prevailing wage determination on Form ETA-9141 before filing.
  • Complete the applicable recruitment and notice-of-filing steps.
  • Maintain records showing recruitment activity and treatment of applicants.
  • File ETA Form 9089 and, after certification, submit the certification with Form I-140 within 180 days.

For an NIW case

  • Document EB-2 eligibility as an advanced-degree professional or person of exceptional ability.
  • If using the bachelor’s-plus-five-years route, document the foreign or U.S. degree equivalency and progressive specialty experience.
  • State one specific proposed endeavor and explain its substantial merit and national importance.
  • Connect the applicant’s education, experience and record to being well positioned to advance that endeavor.
  • Explain why waiving the job offer and labor certification benefits the United States on balance.
  • Organize evidence by prong so USCIS can see which requirement each document addresses.

When professional advice is warranted

PERM and NIW involve different legal standards, documentary records and risk points. A qualified immigration attorney can assess the proposed endeavor, EB-2 credentials, employer and job circumstances, recruitment plan and available evidence. The correct route depends on the complete facts of the case, not on a short résumé summary or a general claim that one pathway is easier.
