PERM Processing Steps and Timelines for Employer-Sponsored Green Cards (2026 Guide)

PERM is the U.S. Department of Labor (DOL) labor-certification stage of many employer-sponsored green-card cases. The employer defines a permanent, full-time job, obtains a prevailing-wage determination, completes the recruitment required for that occupation, and files Form ETA-9089. DOL may certify, deny, audit, or otherwise question the case. Certification is not a green card: the employer generally must submit the certified labor certification with Form I-140 to U.S. Citizenship and Immigration Services (USCIS) within 180 days.

The latest DOL snapshot available for this guide listed analyst review at December 2025 priority dates on October 5, 2026, and reported an average analyst-review time of 336 calendar days for August 2026. Those figures describe different measurements, are not promises for an individual case, and must be read alongside a government-shutdown notice that said Office of Foreign Labor Certification (OFLC) processing and public FLAG access were suspended beginning October 1, 2026. Verify live DOL and FLAG status before relying on any current filing or adjudication assumption.

What PERM does—and what it does not do

Program Electronic Review Management (PERM) is the DOL process used to certify that an employer’s proposed permanent job opportunity meets labor-certification requirements. The employer, not the worker, leads the filing. DOL evaluates the job opportunity and the employer’s recruitment and documentation; it does not issue the immigrant visa or the green card.

After a PERM application is certified, the case normally moves to Form I-140 with USCIS. Later immigrant-visa or adjustment-of-status steps are separate and depend on the worker’s category, country of chargeability, and visa availability. A PERM approval therefore protects an important place in the case, but it is only one stage.

PERM process at a glance

Stage Who acts What must happen Important clock or result
Define the opportunity Employer Set the permanent, full-time position’s duties, work location and minimum requirements. The description must be the real opportunity the employer intends to fill.
Prevailing wage determination Employer and DOL National Prevailing Wage Center Submit Form ETA-9141 and obtain the wage applicable to the described opportunity. A PWD is required before the PERM application; the higher of the two wages identified in the ETA-9089 instructions must be used.
Recruitment and notice Employer Complete the recruitment steps for the occupation and provide the required notice of filing. Keep the recruitment report and supporting records; DOL may request them.
PERM filing Employer Submit Form ETA-9089 online through FLAG after establishing required accounts or by mail. DOL’s receipt date is the filing date and is used as the priority date by USCIS and the Department of State.
DOL determination DOL Certifying Officer Review the application and any audit or information request. Possible outcomes include certification, denial, audit, request for more information or supervised recruitment.
Post-certification filing Employer and USCIS Submit the certified labor certification with Form I-140. The certification expires if not submitted to USCIS within 180 days.

Step 1: Define the permanent job opportunity

The employer first establishes the actual U.S. job opportunity. It should be a permanent, full-time position and must be described with its genuine duties and minimum requirements. This is not a résumé exercise in which the requirements are customized after selecting a worker; the employer must be able to explain and document the opportunity it is offering.

What the employer decides

  • The job’s duties and occupational description.
  • The minimum education, experience, skills and other requirements the employer will apply.
  • The location and conditions relevant to the opportunity.
  • The employment category for which labor certification is being sought.

Those decisions affect the prevailing-wage request and the recruitment plan. Changing material facts later can create inconsistencies between the PWD, advertisements, notice and ETA-9089, so the employer should settle the description before beginning the next stage.

Why the worker should review this stage

The worker may not submit the PERM application, but should ask the employer or its authorized representative for the position title, minimum requirements and work location being used. A mismatch between the job the worker expects and the job certified by DOL can complicate the later I-140 or questions about the offered position.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Step 2: Request the prevailing wage determination

Before filing PERM, the employer submits Form ETA-9141 to DOL’s National Prevailing Wage Center. The resulting prevailing wage corresponds to the opportunity as described—not simply to the employee’s current salary or an informal market estimate.

How the wage is used

DOL’s ETA-9089 instructions require the employer to use the higher of the two wages identified as applicable when completing the application. The employer should compare the determination with the offered wage and preserve the PWD and the information submitted to obtain it.

Why this step controls the schedule

The PERM application cannot be filed before the required PWD is obtained. A correction to the job description, location or requirements can require revisiting the wage request and can move the recruitment and filing schedule. The employer should therefore confirm that the PWD describes the same opportunity that will appear in advertisements and on ETA-9089.

Step 3: Complete recruitment and the notice of filing

Recruitment is occupation-specific. There is no single checklist that applies to every PERM case. The employer must perform the regulatory steps for the category, give the required notice of filing, prepare a recruitment report describing what it did and what resulted, and retain supporting records.

  • A state workforce agency job order running for 30 days.
  • Two Sunday newspaper advertisements.

The employer also selects three additional recruitment steps from the regulatory alternatives. The mandatory steps must occur at least 30 days and no more than 180 days before filing. The additional steps have their own timing constraints, so the employer must document dates rather than treating the three alternatives as interchangeable with the mandatory items.

Nonprofessional occupations

Nonprofessional jobs have a different minimum recruitment framework, including a 30-day job order and two newspaper advertisements. The employer should not copy a professional-case plan without checking the occupation and applicable regulation.

Special categories and exceptions

The regulations provide exceptions or special handling for certain cases, including competitively recruited college and university teachers, Schedule A occupations and sheepherders. Those cases may not fit the typical professional or nonprofessional sequence. The employer should identify the category before publishing advertisements or relying on a standard calendar.

Notice, report and record retention

The employer provides the required notice of filing and keeps evidence of the recruitment steps, dates, content, results and any required internal documentation. The recruitment report should explain the steps taken and their results. DOL can request these materials before a final decision or in an audit; missing records can be more damaging than a weak recollection of what happened.

Step 4: File Form ETA-9089

Once the PWD and applicable recruitment are complete, the employer files Form ETA-9089. DOL allows online submission through FLAG after the employer establishes the required accounts, or submission by mail.

Filing date and priority date

The date DOL receives the application is the PERM filing date. USCIS and the Department of State use that date as the case’s priority date. Keep proof of the submission and receipt because later stages may depend on establishing when the labor certification was filed.

Consistency check before submission

  • Compare the ETA-9089 job duties and requirements with the PWD.
  • Confirm that the advertisements and job order reflect the opportunity being offered.
  • Check that recruitment dates fall within the applicable windows.
  • Make sure the employer can produce the recruitment report and underlying records.
  • Verify that the offered wage satisfies the wage requirement identified in the ETA-9089 instructions.

Step 5: Understand DOL’s possible decisions

After filing, DOL may certify the application, deny it, select it for an audit, request more information, or require supervised recruitment. These are different paths rather than stages that every case passes through.

Certification

Certification means DOL has approved the labor certification application. It does not grant permanent residence, authorize a worker to remain in the United States, or replace the I-140 and later immigration steps.

Denial

A denial ends the application unless the employer uses whatever review or refiling options are available for the circumstances. The decision and the underlying record determine what can be corrected; an employer should not assume that simply submitting the same application again will solve the issue.

Audit or information request

An audit letter identifies documents DOL requires and sets a response deadline. The standard deadline is 30 days from the date of the letter. The Certifying Officer may, at discretion, grant one extension of up to 30 days. A substantial failure to provide the requested documents can result in denial.

An audit can lengthen an individual case because the employer must assemble and submit the requested evidence before DOL completes its review. The deadline in the actual notice controls; employers should not wait for a reminder or assume that a request for an extension will be granted.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Supervised recruitment

DOL may require supervised recruitment rather than accepting the employer’s original recruitment record. That creates additional instructions and timing requirements, so the case no longer follows the ordinary schedule.

How long PERM takes right now

DOL’s FLAG processing page, dated October 5, 2026, showed PERM analyst review at December 2025 priority dates. The same page reported an average analyst-review processing time of 336 calendar days for August 2026, attributed to the Office of Foreign Labor Certification. These figures should not be combined into a promise that a case filed on a particular date will finish in 336 days.

Measure Latest stated value What it tells you What it does not tell you

Audit-review average Unavailable on the cited snapshot No average was displayed for that path. You cannot infer an audit timeline from the analyst-review average.

DOL states that actual processing times vary with each employer’s material facts and circumstances. The agency generally updates PERM and prevailing-wage data by the end of the first work week of each month. Because the figures move, any estimate should include the snapshot’s as-of date and distinguish queue position from elapsed calendar days.

The 2026 shutdown-status warning

DOL’s Foreign Labor Certification page also reported that a government shutdown beginning October 1, 2026 stopped OFLC processing and suspended public access to FLAG. The searched official material did not establish whether operations resumed after the October 5 snapshot. Before an employer files, checks a case, or treats the published averages as active service levels, verify the current DOL and FLAG operating status.

How to estimate an individual case without overpromising

Start with the actual ETA-9089 filing date and priority date, then compare that date with the live analyst-review queue. Separately ask whether the case has received an audit, information request or supervised-recruitment notice. A case still in ordinary analyst review should not be measured against an audit average, and an audited case should not be assigned the 336-day analyst figure as though the paths were identical.

For an employee seeking an update, the useful questions are concrete: What is the ETA-9089 filing date? Has DOL issued an audit or other request? Which deadline appears on the notice? Has the employer confirmed the current FLAG operating status? The employer or its authorized representative controls the case record and is best positioned to answer them.

What happens immediately after PERM approval

DOL says the certified labor certification must be submitted to USCIS with Form I-140 within 180 days of certification. This is a separate deadline from the long wait for DOL review. The employer should calendar the certification date, prepare the I-140 package and submit the original certified labor certification within that 180-day validity period.

What PERM approval does not establish

  • It does not itself approve Form I-140.
  • It does not grant a green card or immigrant visa.
  • It does not by itself establish that an immigrant visa number is immediately available.
  • It does not replace later USCIS, Department of State or consular processing requirements.

The priority date created by DOL’s receipt of ETA-9089 remains an important reference for later stages, but the worker must still qualify for and complete the next immigration filings.

Employer and employee responsibilities

Employer responsibilities

  • Define and document the genuine permanent, full-time opportunity.
  • Submit ETA-9141 and obtain the required PWD before filing PERM.
  • Conduct the recruitment and notice required for the occupation.
  • Prepare the recruitment report and retain supporting records.
  • File ETA-9089 accurately through FLAG or by mail.
  • Answer an audit or information request by the stated deadline.
  • Submit the certified labor certification with Form I-140 within 180 days.

Employee responsibilities

  • Give the employer accurate education and experience information for the offered position.
  • Confirm that the job title, duties, minimum requirements and location being sponsored match the intended permanent role.
  • Keep a personal record of the ETA-9089 filing date and priority date when the employer provides it.
  • Ask promptly for copies or explanations of any audit-related notice that affects the case.
  • Track the transition from PERM to I-140 rather than treating certification as the end of the green-card process.

Common PERM problems and practical fixes

Using a universal recruitment checklist

Problem: The employer follows the professional-occupation pattern for a nonprofessional job, or overlooks a special category.

Fix: Identify the occupation and regulatory category first. Confirm whether the case involves a college or university teacher, Schedule A occupation, sheepherder or another exception before setting dates.

  • What You Get: Anker 332 USB-C Hub (5-in-1), welcome guide, our worry-free 18-month warranty, and friendly customer service.

Filing before the PWD is ready

Problem: The employer starts recruitment or files ETA-9089 without the required PWD, or the final job description no longer matches the wage request.

Fix: Reconcile the PWD, advertisements, notice and ETA-9089 before submission and preserve the underlying ETA-9141 and determination.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Missing the recruitment timing window

Problem: A mandatory step falls outside the 30-to-180-day window, or the employer cannot prove when an additional step occurred.

Fix: Maintain a dated recruitment calendar and retain proof of publication, job-order duration, notice and each additional step.

Incomplete audit response

Problem: The employer sends a partial packet, misses the 30-day deadline or assumes an extension is automatic.

Fix: Read the audit letter line by line, map every request to a document, submit by the stated deadline and request the single possible extension only when necessary. A substantial failure can lead to denial.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Letting the 180-day validity period lapse

Problem: The employer treats certification as permanent and delays the I-140.

Fix: Calendar the certification date immediately and submit the certified labor certification to USCIS with Form I-140 before 180 days expire.

A document checklist for case tracking

  • Final job description, duties, requirements and work location.
  • Form ETA-9141 and the resulting prevailing-wage determination.
  • Required notice of filing.
  • State workforce agency job-order confirmation and dates.
  • Two Sunday newspaper advertisements when required.
  • Evidence for each selected additional recruitment step.
  • Recruitment report and records of results.
  • Form ETA-9089 submission confirmation, filing date and priority date.
  • Any audit, information-request or supervised-recruitment notice and proof of the response.
  • DOL certification and the I-140 submission record showing it was filed within 180 days.

Bottom line for planning a PERM case

Plan PERM as an employer-controlled sequence: define the real permanent job, obtain the PWD, complete the occupation-specific recruitment and notice, file ETA-9089, and preserve every record. Use DOL’s live FLAG page for timing, but label every figure with its as-of date and distinguish queue position from average calendar days. On October 5, 2026, DOL listed December 2025 priority dates in analyst review and a 336-day average for August 2026; a separate shutdown notice said OFLC processing and FLAG access had been suspended from October 1, with no clear official statement in the available material confirming resumption. After certification, the employer has 180 days to send the labor certification with Form I-140 to USCIS.
