PERM is the U.S. Department of Labor (DOL) labor-market certification used in many employer-sponsored employment-based green-card cases. It is not a green card, an immigrant visa, or a guarantee that a visa number is available. In the usual process, the sponsoring employer defines a permanent, full-time job, obtains a prevailing-wage determination, completes the required recruitment and notice steps, and files Form ETA-9089 with DOL. After certification, the employer generally files Form I-140 with U.S. Citizenship and Immigration Services (USCIS).
The filing date normally becomes the case’s priority date. That date can establish a place in the visa queue, but the category, the worker’s country of chargeability, and the Department of State’s monthly Visa Bulletin determine when an immigrant visa or adjustment filing may actually be available.
What is PERM processing?
PERM is the name commonly used for DOL’s Program Electronic Review Management labor-certification process. DOL uses it to certify to USCIS that a specific employer-sponsored job opportunity satisfies labor-market protections. The employer must show that there are not sufficient U.S. workers who are able, willing, qualified, and available for the job in the intended area of employment, and that employing the foreign worker will not adversely affect the wages and working conditions of similarly employed U.S. workers.
The certification concerns the job opportunity and the recruitment process, not the worker’s entire immigration case. DOL does not grant permanent residence. USCIS later decides the immigrant petition and, when applicable, the adjustment-of-status application; the Department of State handles immigrant-visa processing at a U.S. consulate. A certified PERM therefore is an important labor-certification result, but it is only one stage of a larger process.

What PERM does not provide
- It does not issue a green card or an immigrant visa.
- It does not itself authorize employment or create a temporary status.
- It does not guarantee approval of Form I-140 or an adjustment-of-status or consular case.
- It does not make a visa number immediately available.
DOL’s Permanent Labor Certification page states, “The filing of applications is the responsibility of the employer, not the employee.” That division of responsibility is central: the employer, rather than the prospective immigrant, owns the labor-certification filing.
Who is responsible for each part?
| Stage or decision | Primary actor | What it means |
|---|---|---|
| Job opportunity and minimum requirements | Employer | Defines the permanent, full-time position, its actual duties, worksite or area of employment, and the minimum requirements it genuinely needs. |
| Prevailing-wage determination | Employer requests; DOL’s National Prevailing Wage Center issues | DOL determines the wage level and occupation-based prevailing wage that applies before the PERM filing. |
| Recruitment and notice | Employer | Conducts the recruitment and gives the required notice under the occupation-specific rules. |
| ETA-9089 labor-certification application | Employer files; DOL adjudicates | The employer submits the application through FLAG or, as DOL’s overview also describes, by mail. DOL may certify it or take another action. |
| Form I-140 immigrant petition | Employer files with USCIS | Usually follows a certified PERM and asks USCIS to classify the worker in the relevant employment-based category. |
| Immigrant visa or permanent residence | USCIS or Department of State, depending on location and route | The worker may pursue adjustment of status in the United States or consular immigrant-visa processing abroad when the category and priority date permit. |
The worker supplies accurate background, education, experience, and immigration information and must meet the position’s stated requirements. The worker does not file the PERM application, choose the requirements unilaterally, or control DOL’s review.

How the PERM process works step by step
1. Define a qualifying job opportunity
The employer starts with a real, permanent, full-time position. It identifies the job’s duties, minimum education and experience, skills, licenses, work location, and other requirements as they actually existed before the filing. Requirements cannot be tailored merely to the foreign worker’s background; they must be the employer’s genuine minimum requirements for the opportunity.

DOL’s rules differ by occupation and route. Professional and non-professional occupations have different recruitment paths. College and university teachers may fall under special handling rules, and professional athletes have a specific provision. The applicable rule should be selected before recruitment rather than treating one checklist as universal.
2. Request the prevailing-wage determination
Before filing PERM, the employer requests a prevailing-wage determination from DOL’s National Prevailing Wage Center. The determination identifies the occupation and the wage that applies to the area and requirements described. The employer must have a valid determination before submitting ETA-9089 and must be prepared to offer at least the required wage under the applicable rules.
A change in duties, requirements, location, or other material facts can affect the wage analysis. Employers should keep the job description, wage request, and later filing consistent; unexplained differences can create questions during review.
3. Complete recruitment and notice requirements
Recruitment is designed to test the U.S. labor market for the specific opportunity. The required steps depend on whether the position is professional, non-professional, subject to special handling, or covered by another provision. Employers also have notice-of-filing obligations so that U.S. workers can learn about the opportunity and raise concerns through the required channel.

Because the rules vary, an employer should document each required advertisement, contact, date, location, response, and recruitment result according to the route used. A general internet posting or a single job-board advertisement is not automatically a complete PERM recruitment program. The employer must follow the regulation that applies to the occupation and preserve the records DOL expects.
4. File Form ETA-9089
Once the wage determination and recruitment steps are complete, the employer files Form ETA-9089 with DOL. DOL’s FLAG system supports electronic filing, and the agency’s overview also describes a mail option. The application identifies the employer, job, worksite, requirements, wage, recruitment, and foreign worker information.
The filing date matters beyond queue placement. DOL explains, “The date the labor certification application is received by the DOL is known as the filing date and is used by USCIS and the Department of State as the priority date.” Keep proof of the date DOL received the application and a complete copy of what was submitted.
5. Respond if DOL takes additional action
DOL may certify the application, issue an audit or other request, or deny it. An audit can require the employer to produce recruitment records and other supporting documentation. The employer must answer within the stated deadline and should submit records that match the filed application. If a case is denied, the employer must evaluate the available procedural options and whether a new, corrected case is appropriate; a worker cannot cure a denial by filing PERM independently.
What DOL is evaluating
PERM review centers on the employer’s labor-market test and the job opportunity described in ETA-9089. The important questions include:

- Were the minimum requirements the employer’s actual, lawful requirements rather than qualifications added to fit one person?
- Did the employer obtain the required prevailing-wage determination before filing?
- Did the employer complete the recruitment and notice steps required for this occupation and route?
- Could able, willing, qualified, and available U.S. workers be found, and were responses handled consistently with the stated requirements?
- Would employing the foreign worker avoid an adverse effect on the wages and working conditions of similarly employed U.S. workers?
DOL’s certification is a labor-market finding. USCIS still examines the employer’s immigrant petition, the worker’s qualifications, the offered position, and the requested employment-based category.
How long does PERM take?
Processing time changes as DOL receives and adjudicates cases. On October 5, 2026, DOL’s Office of Foreign Labor Certification dashboard showed both the PERM analyst-review queue and the audit-review queue at December 2025 priority dates. The dashboard reported an average analyst-review time of 336 calendar days for August 2026; the audit-review average was listed as N/A in that snapshot.
Those figures are a dated queue report, not a prediction for an individual case. DOL warns that a case can vary with its facts and circumstances, and the dashboard changes monthly. Check the live OFLC processing-times dashboard for the current queue before relying on any estimate. The reported analyst average does not include every period an employer spends preparing the job description, obtaining the wage determination, conducting recruitment, responding to an audit, or waiting for later USCIS and Department of State stages.
Why an end-to-end estimate is different
The overall green-card timeline includes several separate waits: preparation and wage processing before filing; DOL adjudication; any audit response; Form I-140 processing at USCIS; and, if a visa number is not immediately available, the employment-based visa queue. A PERM queue date cannot be converted into a guaranteed total time for permanent residence.
What happens after PERM is certified?
- Employer files Form I-140 with USCIS. The certified labor certification is generally submitted with the employer’s immigrant petition in the appropriate employment-based category.
- USCIS adjudicates the petition. Approval of PERM does not compel USCIS to approve the I-140. USCIS reviews the petition, the employer, the offered position, and the worker’s eligibility.
- The priority date is tracked. In a labor-certification case, the PERM filing date generally supplies the priority date used by USCIS and the Department of State.
- The case waits for visa availability when necessary. Availability depends on the preference category, the worker’s country of chargeability, and the date in the current Visa Bulletin. A priority date is a place in line, not a visa number.
- The worker completes the final residence stage. If eligible and in the United States, the worker may file adjustment of status under the applicable USCIS filing-chart instructions. Otherwise, the worker generally uses consular immigrant-visa processing abroad. The correct route depends on location, category, eligibility, and visa availability.
Because Visa Bulletin dates move forward, backward, or remain unchanged, applicants should check the Department of State’s current bulletin and USCIS’s monthly instructions for whether the filing or final-action chart applies in that month.

PERM compared with other employment-based routes
Not every employment-based green-card case uses ordinary PERM. The main differences are whether a labor certification and permanent job offer are required, who files, and how visa availability applies.
| Route | Labor certification? | Permanent job offer and sponsoring employer | Who files the immigrant petition | Visa-number constraint |
|---|---|---|---|---|
| Ordinary PERM-based case | Yes, DOL labor certification is required before the usual I-140. | Yes; the employer defines and sponsors the permanent, full-time opportunity. | Employer files Form I-140 with USCIS after certification. | Category, country of chargeability, and priority date control availability. |
| Schedule A | Uses a distinct labor-certification route rather than ordinary PERM processing. | Generally involves an employer-sponsored job offer under the applicable Schedule A rules. | Employer files the applicable petition and supporting labor-certification documentation with USCIS. | Employment-based category, country, and priority date still matter. |
| Qualifying EB-2 National Interest Waiver | Exempt from the job-offer and labor-certification requirements when the statutory and regulatory criteria are met. | A qualifying permanent job offer and sponsoring employer are not required in the same way as ordinary PERM. | The beneficiary may self-petition Form I-140 with USCIS. | Visa availability remains subject to the category, country, and priority date. |
Schedule A and National Interest Waiver cases are not interchangeable shortcuts. Eligibility is fact-specific, and the filing strategy should be checked against the current USCIS category instructions.
Common mistakes and practical safeguards
Assuming the worker controls the case
The employer owns the PERM filing and the underlying recruitment. A worker can review personal information and provide evidence of qualifications, but should not represent that the worker filed the application or independently performed the employer’s recruitment.
Using a generic recruitment checklist
Recruitment requirements differ by occupation and special rule. Treating one set of advertisements as universal can leave a case incomplete. Identify the applicable route first, then calendar every required notice and recruitment action.
Changing the job after recruitment
The duties, requirements, location, and wage described in recruitment and ETA-9089 must remain aligned. A material change can require a new wage determination, new recruitment, or a new filing rather than an informal edit.
Best Value
Confusing certification with residence
A certified PERM does not approve the I-140 and does not permit the worker to skip visa-number limits. Plan for the USCIS petition and the final residence stage separately.

Queue dates and averages are snapshots. Record the date of any dashboard check and revisit the live DOL data, the current Visa Bulletin, and USCIS filing-chart instructions before making a filing or travel decision.
Losing the employer’s records
The employer should retain the prevailing-wage determination, recruitment evidence, notice documentation, applications and résumés received, recruitment report, correspondence, and the filed ETA-9089. These records are especially important if DOL audits the case.
When individualized advice is important
Professional immigration counsel can be useful when the occupation has unusual recruitment rules, the job requirements are being redesigned, an audit arrives, the employer is considering Schedule A or a National Interest Waiver, or the worker’s priority date and location create a difficult filing decision. Counsel cannot guarantee certification or visa availability, but can assess the facts against the current regulations and agency instructions. Verify any provider’s credentials and scope of service before sharing documents or paying fees.
