Federal FMLA is separate: it provides eligible employees up to 12 workweeks of unpaid, job-protected leave. The two may run at the same time, so they do not automatically provide 24 weeks away from work.
How the two leave programs compare
| Question | North Carolina paid parental leave | Federal FMLA |
|---|---|---|
| Pay | For qualifying events on or after October 1, 2026, 100 percent of eligible regular pay, according to North Carolina OSHR. | Unpaid by itself. An employer-provided paid benefit or accrued paid leave may apply, but FMLA itself does not require pay, according to the U.S. Department of Labor. |
| Maximum duration | 12 weeks for eligible covered employees for qualifying events on or after October 1, 2026 (OSHR). | Up to 12 workweeks for qualifying reasons in the applicable 12-month period (U.S. Department of Labor). |
| Who may be covered | OSHR identifies executive-branch employees and employees of participating public schools and community colleges. Confirm that your employer participates. | Public agencies are covered employers regardless of size, but individual employees must still meet FMLA eligibility requirements (U.S. Department of Labor). |
| Eligibility test | OSHR’s current overview does not establish detailed eligibility and procedure rules for the updated policy. Do not assume the older policy thresholds remain in force. | Generally, 12 months of employment, at least 1,250 hours worked in the 12 months before leave, and employment at a worksite where the employer has at least 50 employees within 75 miles (U.S. Department of Labor). |
| Qualifying events | OSHR’s program covers qualifying parental events; consult its current overview and your agency HR for the event-specific rules. | Includes birth and care of a newborn, placement for adoption or foster care and bonding, as well as other qualifying family and medical reasons (U.S. Department of Labor). |
| Job and benefits protection | Check the current state policy and your agency HR for the protections and coordination rules that apply. | Generally, eligible employees retain group health coverage on the same conditions and return to the same or an equivalent job (U.S. Department of Labor). |
| Can they overlap? | Yes. Paid parental leave may run concurrently with FMLA; ask HR how each leave will be designated and counted. | |
| Effective date | OSHR identifies October 1, 2026, for the 12-week paid benefit. | FMLA is a separate federal entitlement; it is not limited to that state-program date. |
Why the event date matters
OSHR states that the 12-week paid benefit applies to qualifying events on or after October 1, 2026. Its overview also describes earlier benefit amounts: four weeks for other eligible parents and eight weeks for eligible employees who give birth before that date. Those earlier amounts should not be confused with the new benefit or applied to later events.

Federal FMLA
For an individual employee to qualify, the Department of Labor generally requires at least 12 months of employment, 1,250 hours worked during the 12 months immediately before leave, and at least 50 employees employed by the employer within 75 miles of the employee’s worksite. Public agencies are covered employers regardless of size, but that does not waive the employee-level tests. Review the Department of Labor’s FMLA FAQ and ask HR to assess your work history and worksite.

North Carolina’s state program
The state program is not described as applying to every public employee. OSHR identifies executive-branch employees and employees of participating public schools and community colleges. Check whether your employer participates and whether your role is covered.
An older OSHR policy dated July 2025 used 12 months of continuous State service and 1,040 hours in pay status. Because OSHR says the detailed policy is being updated for the October 2026 law, those older thresholds are not confirmed eligibility rules for the new benefit. Do not rely on them without confirmation from your agency HR office.
What FMLA protects—and what it does not pay
FMLA provides eligible employees up to 12 workweeks of leave for qualifying reasons, including birth and bonding with a newborn, or placement and bonding following adoption or foster care. It also covers certain family-care, personal medical, and military-related reasons. The law requires unpaid leave; it does not itself provide a paycheck. An employer-provided paid benefit or accrued paid leave may overlap with FMLA, subject to applicable rules.
During FMLA leave, group health benefits generally continue under the same conditions as if the employee were working. When leave ends, the employee generally must be restored to the same job or an equivalent one. See the Department of Labor FAQ for the federal rules.
How concurrent leave affects the time away
When an employee qualifies for both programs for the same event, paid parental leave may run concurrently with FMLA. In that case, the weeks are overlapping, not sequential: a week of state paid leave may also count as a week of FMLA leave. The paid benefit changes whether the employee receives pay during the applicable state leave; it does not automatically add another 12 weeks after FMLA.
For FMLA bonding leave after birth or placement, intermittent leave is available only with employer approval, and the leave must conclude within 12 months after the birth or placement. Ask HR how the state benefit and FMLA will be scheduled and counted in your particular case.

What to confirm with your agency HR office
OSHR says the detailed policy and FAQs are being updated to reflect the October 2026 law, so implementation details such as eligibility, notice, scheduling, and coordination should be confirmed with HR. Before making plans, provide your HR office with the information needed to assess both programs:
- Your employer and whether it participates in the state program.
- The event type and date, including whether it falls on or after October 1, 2026.
- Your service history, hours worked, worksite, and other information relevant to FMLA eligibility.
- How paid parental leave will be coordinated with FMLA, including how leave will be designated and counted.
- Any notice, documentation, or scheduling requirements that apply to your situation.
This is a general comparison, not an eligibility determination or legal advice. Your agency HR office can explain how current rules apply to your job, work history, hours, employer, and event date.
