There is no reliable “EU provider = EU-only data” shortcut. Compare the specific product, endpoint, model, account tier, configuration and every data flow. OpenAI documents European processing for eligible API projects and European storage at rest for newly created ChatGPT Enterprise and Edu workspaces. Mistral describes GDPR transfer safeguards and lets Enterprise organizations disable some features that transfer data outside the EU. Those statements cover different scopes; neither establishes that every prompt, log, backup, support interaction, integration or subprocessor stays in Europe.
This guide turns the published controls into a procurement method. It is current to October 13, 2026, and is practical buying guidance rather than a legal opinion or certification assessment.

What you are actually comparing
“Data handling” is not one setting. An AI deployment can have separate locations and retention rules for inference, conversation history, uploaded files, safety systems, application logs, backups, support tickets, billing records and connected tools. A provider may process a request in Europe while storing account metadata elsewhere, or offer European storage for a workspace while a particular connector sends content to a third party.

Use the same evidence questions for every candidate. Require answers for the exact service and plan you will deploy, not for a corporate group in general.
- Processing: Where is inference performed for each endpoint and model? Does “regional” cover only GPU inference, or also preprocessing, moderation, tracing, caching, support and connected tools?
- Storage: Which categories are stored at rest, in which countries, for how long and in which backup systems?
- Transfers: Which legal entities and subprocessors receive data, for what purpose and under what transfer mechanism?
- Retention: What is the default period, what can you configure, and which security or legal exceptions survive deletion requests?
- Contract: Which DPA and service terms apply to the exact tier? Do they define controller and processor roles, instructions, assistance, breach notice, deletion, audits and subprocessors?
- Assurance: Is the service and deployment you will use inside the scope of the current SOC report or ISO certificate?
- Eligibility: Does a regional, zero-data-retention or transfer-control feature require a particular commercial tier, approval or newly created project?
What OpenAI publishes about regional processing and storage
Eligible API projects can select Europe
OpenAI says eligible API customers can create a new project with Europe selected as its region. Requests from those projects are handled in-region with zero data retention. In OpenAI’s definition, zero data retention means the request and response are not stored at rest on OpenAI’s servers. It does not, by itself, mean that every transient processing step, support record, account field, tool or downstream service is located in Europe.
The creation rule matters operationally: OpenAI says an existing project cannot be converted to the European region after it has been created. Treat region selection as an architecture decision made before production data is sent. Confirm that the intended endpoint and model appear in the current regional-processing matrix; eligibility is not universal and the matrix can change.

New ChatGPT Enterprise and Edu workspaces can store content in Europe
OpenAI states that newly created ChatGPT Enterprise and Edu workspaces can use European data-at-rest storage for customer content. The stated categories include conversations, prompts, uploaded files and multimodal content. This is a workspace control, not a blanket promise for every API product, feature or integration. Verify whether your planned tools, connectors, analytics and support paths are included before treating the workspace as region-restricted.
Inference location and storage location are different controls
OpenAI’s business privacy materials say eligible customers can select data-at-rest locations and that eligible customers may opt into in-region GPU inference in the United States or Europe. API customers can select the US or Europe for processing on supported endpoints. Processing and storage should be recorded as separate requirements in your design: a request can be inferred in one region, retained in another, and copied into logs or backups governed by a third party.
Retention, deletion and contractual documentation
OpenAI says it can execute a DPA for ChatGPT Business, Enterprise and API customers. For Enterprise, Edu and Healthcare workspace data, its enterprise privacy information says administrators control retention and deleted conversations are removed within 30 days unless legal retention is required. That workspace statement should not be generalized to every API endpoint or feature. Ask for the deletion rule for each data class you will create, including files, logs, abuse-monitoring records, backups and support attachments.

Security and certification evidence
OpenAI lists alignment or certification information including CSA STAR, SOC 2 Type 2 and standards in the ISO/IEC 27001 family. These names are evidence about defined control boundaries, not a guarantee that your particular configuration is compliant. Request the current report or certificate, its validity dates, the covered services and any exceptions. A certificate for one product does not automatically cover another product, a custom connector or your own application.
What Mistral publishes about EU transfers
Contractual safeguards for outside-EU service providers
Mistral says contracts with service providers that process personal data outside the EU include safeguards under GDPR Article 46. Where the recipient country has no EU adequacy decision, it says it attaches the latest European Commission Standard Contractual Clauses. This addresses the legal mechanism for a transfer; it does not mean the transfer is disabled or that processing is physically confined to the EU.
Security review and extra protections for subprocessors
Mistral states that outside-EU subprocessors undergo a security review and may receive additional safeguards such as zero data retention or encryption. “May” is important: obtain the current subprocessor list and determine which safeguard applies to each recipient and data category in your deployment. A security review is not the same as an EU location, and encryption does not answer who holds keys or whether content is decrypted for support or abuse prevention.
Enterprise controls can disable some outside-EU transfers
Mistral says Enterprise customers can deactivate some features involving transfers outside the EU at organization level. The published wording is deliberately limited to “some features”; it does not promise that every Enterprise workflow is EU-only. Ask for the feature inventory, the default state, the exact functionality lost when a transfer is disabled and whether future product changes can introduce a new transfer path.
Why a European headquarters is not a compliance answer
The European Data Protection Board’s April 2025 AI landscape report identifies Mistral AI in Paris and Aleph Alpha in Heidelberg. That is useful market context, not a current control matrix. The available material does not establish equivalent, current first-party details for Aleph Alpha on residency, retention, DPAs or subprocessors. Do not infer those controls from a company’s address, incorporation or model-training location.

The same caution applies to any provider described as European. Ask for product-level evidence: endpoint geography, storage classes, transfer recipients, retention controls and contractual terms. A provider can be headquartered in Europe while using non-European cloud, telemetry, support or payment infrastructure; conversely, a non-European provider can offer a European processing option for a defined service.

How to run a defensible vendor comparison
1. Freeze the use case and data classes
Write down who will use the system, what it will do and what information will enter it. Separate public text, ordinary business data, personal data, special-category data, credentials, source code and regulated records. State whether prompts are interactive, batch, retrieval-augmented, fine-tuning or agentic. A provider may offer a suitable control for one mode but not another.
2. Draw the complete data-flow diagram
Include the user interface or API gateway, identity provider, application servers, retrieval database, model endpoint, moderation or safety service, observability platform, ticketing system, backups and human support. Mark the country and legal entity for each hop. Do not stop at the model endpoint: a connector that exports a prompt can defeat an otherwise well-scoped regional setting.
3. Verify eligibility before signing
Ask the account team to confirm, in writing, the required plan, approval and project or workspace creation steps. For OpenAI, check the current endpoint/model matrix and create a new European API project if your selected workflow qualifies. For a Mistral Enterprise deployment, identify which outside-EU features can be disabled and what functionality disappears. Keep screenshots or written confirmations with the procurement record because product eligibility changes.

Collect the DPA, service terms, security addendum, subprocessor list, retention schedule, regional-processing description, incident-notification procedure and current assurance reports. Check that the legal entity named in each document matches the contracting entity and that the product name matches your planned service.
5. Test configuration and deletion with non-sensitive data
In a staging account, enable the intended region and retention settings. Send a unique test value through each workflow, including uploads, retrieval, tools and support. Confirm where administrative logs appear, then exercise deletion and record what disappears, when and from which interface. A vendor statement is necessary, but an internal configuration test catches accidental logging and connector paths.
6. Map customer obligations
Document the lawful basis, privacy notice, user access and correction process, minimization rules, retention schedule and deletion workflow. Decide whether a data protection impact assessment is required. Define who can change model, region, connector or retention settings and require review before that happens. Vendor controls do not replace role-based access, secrets management, redaction or incident response in your own application.

Questions to put in the DPA and security questionnaire
- Are you acting as processor, controller or a separate controller for each processing purpose?
- Which exact legal entities and subprocessors can receive prompts, outputs, files, telemetry or support material?
- For each recipient, what country, purpose and transfer mechanism applies?
- Can the customer prohibit use of content for model training or service improvement, and is that prohibition contractual?
- What is retained by default for requests, responses, files, abuse monitoring, logs, backups and billing?
- Which retention settings are available through the console or API, and which require provider approval?
- What does zero data retention exclude, and how are temporary caches, safety review and legal holds handled?
- How quickly are data classes deleted after an account or object deletion request?
- What assistance is provided for data-subject requests, impact assessments and breach investigations?
- How are subprocessor changes announced, and can the customer object or terminate?
- Which report or certificate covers the service, region and deployment architecture being purchased?
- Can regional or transfer settings be changed by an administrator, support agent or product update without customer approval?
Common mistakes and how to correct them
Mistake: treating “European” as a location guarantee
Correction: require a service-specific flow diagram and subprocessor list. Headquarters and engineering locations are background facts, not evidence that data remains in Europe.
Mistake: reading “processing in Europe” as “all data in Europe”
Correction: split inference, storage, logs, backups, support and connected services into separate contract questions. Record the answer for each data category.
Mistake: assuming a certification badge proves compliance
Correction: review the audit boundary, validity period, exceptions and covered product. Then assess your own purpose, users and controls.
Mistake: overlooking project and tier prerequisites
Correction: confirm eligibility before migration. OpenAI says an existing API project cannot be converted to the European region, so a project created in the wrong region may require a new project and application reconfiguration.
Mistake: disabling a transfer without checking the trade-off
Correction: for Mistral, identify the “some features” covered by organization-level controls and test the resulting workflow. A disabled feature may remove support, analytics, a connector or another capability your process depends on.
Mistake: promising “100% EU-only” or “GDPR compliant by default”
Correction: use qualified language tied to a specific endpoint, tier, setting and data class. Obtain legal advice for the deployment’s actual role and risk.
How the EU AI Act fits into the decision
OpenAI’s customer guidance states that it is committed to developing models that comply with applicable EU AI Act requirements and helping customers find information they may need for their own compliance. That is OpenAI’s stated position, not an independent determination that a provider or your application complies.
Your analysis starts with the system’s purpose and your role in the AI value chain. Identify whether you are a provider, deployer or another regulated actor; classify the use case; list transparency, documentation, human-oversight, logging and other duties; and obtain qualified advice where the classification is uncertain. A European hosting choice does not remove obligations created by the system’s function.
Choosing between the documented options
When OpenAI’s documented controls may fit
OpenAI may fit a deployment that needs a supported API endpoint with European processing, a newly created European project and a contractual zero-data-retention arrangement, or a new Enterprise or Edu workspace with European storage at rest. The fit depends on endpoint/model eligibility, connector behavior, retention scope and your acceptance of any non-European auxiliary processing.

Mistral may fit an Enterprise buyer that can accept documented international subprocessors under Article 46 safeguards and wants to disable particular outside-EU transfer features. The fit depends on the feature list, the resulting loss of functionality, the DPA, current subprocessors and deletion terms.
When neither published position is sufficient
If policy requires every data class, support path and backup to remain in a named European jurisdiction, do not approve either option based only on the statements summarized here. Request a deployment-specific architecture, contractual commitments and verification evidence, or consider a self-managed arrangement whose full data flow you can control.
A procurement record you can defend later
Keep a dated decision file containing the use-case description, data classification, architecture diagram, endpoint and model names, project or workspace ID, screenshots of region and retention settings, DPA version, subprocessor list, assurance reports, test results and approval owner. Recheck the endpoint matrix, terms and subprocessors before launch and after material product changes. Regional processing and compliance documentation are point-in-time specifications, not permanent properties of a brand.
The defensible conclusion is therefore specific: approve a named product configuration for a named data flow, with stated retention, transfer and contractual boundaries. Do not approve “an AI provider” or “a European provider” as an abstract category.
