A 35-year-old OpenAI engineer, Abdulrahman Alfozan, was arrested on October 9, 2026, after investigators allegedly found a covert recorder concealed in toilet paper and plugged into a television USB port in an executive conference room. Prosecutors charged him with using or attempting to use a device to intercept oral communications. The criminal complaint does not establish that anyone accessed recordings, that trade secrets were obtained, or that Alfozan is guilty.
What happened at OpenAI
According to the U.S. Department of Justice and a federal criminal complaint in the Northern District of California, OpenAI determined that a recording device had been installed in an executive conference room on or about September 28, 2026. The device was allegedly wrapped in toilet paper and connected to a USB port on the back of a television. Its contents were encrypted.

OpenAI personnel discovered the recorder on September 30. The room was used for meetings involving confidential company information, including technical research, product plans, business-development opportunities, government engagements, commercial relationships and strategic decisions.
Timeline of the case
| Date | Event |
|---|---|
| September 28, 2026 | OpenAI says the recorder was installed on or about this date, according to the DOJ complaint summary. |
| September 30, 2026 | Employees found the device in an executive conference room in OpenAI’s San Francisco office. |
| October 9, 2026 | DOJ announced the arrest of Abdulrahman Alfozan, 35, a Saudi national and OpenAI employee, on a federal interception charge. |
| October 13, 2026 | Alfozan made his initial appearance in federal court. The Associated Press reported that he was due back in court on October 19. |
Who was arrested and what is he charged with?
DOJ identified the defendant as Abdulrahman Alfozan, a Saudi national who worked as an engineer at OpenAI. The announced charge is using or endeavoring to use a device to intercept oral communications. That charge concerns the alleged use or attempted use of interception equipment; it is not a conviction and does not by itself prove that a recording was successfully made or retrieved.

What evidence do prosecutors cite?
Security-camera footage
The complaint, as reported by the Associated Press, alleges that CCTV captured Alfozan near the conference room on nearly a dozen occasions even though he was not authorized to enter it. After OpenAI added a camera, investigators allegedly recorded him checking behind the television where the first device had been placed.
A second recorder
Investigators also allegedly found a similar recorder in an unattended bag containing Alfozan’s wallet and identification. Prosecutors cite the access pattern, the camera footage and the second device as links between Alfozan and the equipment. These are allegations described in the complaint, not findings after a trial.

What device was found?
The DOJ releases describe the item generically as an encrypted recording device. The San Francisco Standard, citing court documents, identified it as a Seeed XIAO ESP32-S3 Sense development board fitted with a detachable camera sensor, a digital microphone and microSD storage.

That hardware identification is attributed to the Standard’s report and the court documents it cited. The public DOJ materials do not independently provide the model name. The encryption reported for the device also means that the public record does not show what, if anything, investigators were able to read from its storage.

Why the conference room mattered
Prosecutors say meetings in the room frequently covered highly confidential technical, commercial and strategic matters. The complaint specifically describes discussions that could include:
- Proprietary research and nonpublic technical progress
- Product plans and strategic decisions
- Business-development opportunities
- Government engagements
- Commercial relationships
The description explains why investigators treated the alleged placement as a serious insider-security incident. It does not establish that any particular secret was captured or disclosed.

What is established—and what remains unknown
| Publicly established in the announced case | Not established by the materials reviewed |
|---|---|
| DOJ announced Alfozan’s arrest and a federal interception charge. | That Alfozan is guilty; the case was still pending. |
| OpenAI found a recorder in the conference room on September 30. | That the device successfully recorded or that anyone accessed its encrypted contents. |
| The complaint alleges CCTV and a second device connected Alfozan to the placement. | That trade secrets or other sensitive information were obtained, disclosed or used. |
| The room was used for meetings involving confidential company matters. | That a foreign government directed or sponsored the alleged conduct. |
Where the case stands
Alfozan appeared in federal court on October 13, four days after his arrest. The Associated Press reported a further court date of October 19. At this stage, the public record consists of the DOJ announcement and reporting on a criminal complaint. Court allegations must be tested through the federal criminal process, and Alfozan is presumed innocent unless proven guilty.
Why the wording matters
The central allegation is the attempted or actual interception of oral communications using a recording device. Finding hardware in a sensitive room can support an investigation, but it does not answer several separate questions: whether the recorder was powered, whether it captured intelligible audio or video, whether encrypted files can be decrypted, and whether any confidential information left the company. None of those outcomes is established in the materials announcing the arrest.
