Open-source AI and closed AI are not opposite ends of a simple free-versus-paid choice. The practical decision is whether your team needs control over weights, data handling and deployment badly enough to operate the system itself, or whether a managed provider’s infrastructure, support and updates are worth the dependency. Start by separating three terms: a genuinely open-source AI release, an open-weight model, and a closed model exposed through a hosted API. Then compare the options against your workload, data, total cost, risk controls and legal responsibilities.
Open-source, open-weight and closed AI are different things
In software, “open source” usually refers to code released under terms that permit inspection, modification and redistribution. AI systems are assembled from more parts, so the label is harder to apply. A model may publish its trained parameters while keeping the training data, data-processing code or full training recipe private. Another release may provide source code and documentation but restrict commercial use or redistribution.

The Open Source Initiative’s Open Source AI Definition 1.0 treats openness as a package. It addresses information about the training data, the code used to acquire and process that data, the code used to train and run the system, and the model parameters. OSI also states that its definition does not require a specific legal mechanism for assuring that model parameters are freely available to everyone. In other words, legal form and practical access both matter.

Open-weight means the trained weights are publicly available. The OECD uses that narrower description. Weights are the numerical parameters produced by training; they are what an inference engine loads to generate outputs. Public weights can enable local serving, fine-tuning and independent evaluation, but they do not prove that the original training data, filtering process, training code or all documentation is available.

Closed or proprietary models keep the weights and usually the training pipeline under the provider’s control. Customers call a hosted endpoint, software development kit or application. The provider chooses the serving hardware, controls model updates and sets the service terms. Some providers offer downloadable models as a separate product, so classify the exact version and license rather than relying on a company-wide label.
Why the distinction changes your decision
- Public weights can be copied, modified or run in a private network, but the operator must supply compute, storage, security and monitoring.
- A hosted closed model removes much of that infrastructure work, but prompts, logs and outputs follow the provider’s data path and retention controls.
- “Free to download” describes an acquisition price, not the cost of serving requests, patching systems or staffing operations.
- An open release does not remove copyright, privacy, safety or sector-specific obligations.
The OECD reported that more than half of the foundation-model market consisted of open-weight models in its 2025 openness primer. That is a time-bound market snapshot, not a current 2026 market measurement and not evidence that open weights are suitable for every workload.
What is actually released?
Before comparing products, make an inventory of the artifacts you can obtain and the rights attached to each one. A useful release review covers six layers.

Weights determine the model’s learned behavior. Architecture describes how those weights are organized and what runtime can execute them. Check whether the release includes all weights, a quantized variant, tokenizer files, configuration and a supported inference runtime. A partial checkpoint or research-only artifact may not be deployable for production traffic.
Inference and training code
Inference code is the software that loads weights and generates responses. Training code covers data preparation, optimization and checkpoint creation. A release can provide one without the other. If you need to reproduce training, audit a data transformation or build a specialized fine-tuning pipeline, verify that the relevant code and dependencies are present and licensed for that use.

Data information
Training-data information may range from a high-level description to detailed sources, filtering rules and documentation of copyrighted material. Public weights alone cannot tell you which texts, images, audio or records influenced the model. This matters for provenance review, privacy assessments, licensing analysis and requests from affected people.
Documentation and evaluation
Read the model card, safety notes, supported languages, context limits, known failure modes and evaluation methodology. A benchmark score without the task definition, prompt format and hardware conditions is not enough to predict your results. Ask whether the publisher describes downstream fine-tuning, prohibited uses and update policy.

Inspect the weight license, code licenses and acceptable-use policy separately. Verify commercial use, modification, attribution, redistribution, sublicensing, hosting for third parties and obligations triggered by fine-tuning. A permissive code license does not automatically grant the same rights to weights or training data.
Access and operational interfaces
Determine how you obtain files, whether access can be revoked, which runtimes are supported and whether security updates are signed or published. For a hosted API, inspect endpoint regions, authentication, quotas, logging, retention, portability and deprecation notices instead of assuming that an API behaves like a downloadable package.
Open-weight/self-managed and closed/managed paths compared
| Decision axis | Open-weight or self-managed path | Closed or managed path | Questions to verify |
|---|---|---|---|
| License and rights | Review weight, code, data, acceptable-use, attribution, redistribution and commercial terms independently. | Review API or service terms, usage restrictions, output and data rights, and portability. | Which exact model version and governing policy apply? Obtain legal review for the intended use. |
| Deployment and data path | You may run on infrastructure you control; you assume compute, storage, deployment, patching and serving. | The provider operates more of the serving stack; your data handling depends on provider settings and contracts. | Where do prompts, logs and outputs travel and persist? Who controls access, telemetry, retention and incident response? |
| Capability | You can inspect, adapt and fine-tune released weights where the license and tooling permit. | You access provider-served capabilities without managing weights, but the provider controls the model and interface. | Evaluate the actual task for quality, latency, reliability, language coverage and failure modes. |
| Total cost | No license fee may still leave GPU, storage, engineering, power and operations costs. | API or managed-service charges can be efficient for some workloads; the provider carries more infrastructure work. | Calculate cost per successful task at realistic utilization, peak capacity, redundancy, support and staff time. |
| Security and safety | Local control and external evaluation can help, but modified weights may bypass safeguards and create new misuse risks. | Central provider controls may reduce your operating burden, while creating dependency on provider security and availability. | Define the threat model, application controls, red-team plan, monitoring, abuse response and update policy. |
| Support and continuity | Support may come from your team, a community or a runtime vendor; self-hosted provider support can be limited. | Provider support and hosted updates can reduce operations while increasing dependency. | Check SLA, escalation, deprecation, portability, outage procedures and exit options. |
| Governance and legal role | Open release does not remove obligations; any EU exceptions are conditional and limited. | Provider and deployer duties depend on roles, use case, jurisdiction and current law. | Identify provider and deployer roles, model classification, affected jurisdictions and applicable rules. |
Data control: where does a request go?
For a self-managed model, prompts can remain inside your network, but only if your serving stack, logs, backups, observability tools and support channels are configured that way. A local endpoint can still leak sensitive text through debug logs, unencrypted object storage or an employee’s copied prompt. Map the complete path, not just the location of the GPU.

For a managed model, request data may pass through the provider’s API gateway, safety filters, routing layer, logs and subprocessors. Contract terms may limit retention or training use, but those protections are specific to the service and plan. Verify regional processing, deletion windows, administrator access, incident notification and whether prompts are used to improve the service.

Questions for sensitive workloads
- Can the system operate without sending raw records outside a defined boundary?
- Can you redact or tokenize personal data before inference?
- Are logs encrypted, access-controlled and retained only as long as necessary?
- Can an administrator reconstruct which model version answered a request?
- What happens to queued requests and backups during an outage or account closure?
Capability, customization and reliability
Open weights are attractive when the model must be adapted to a domain, language or device. You can run controlled fine-tuning, add retrieval components, alter decoding and benchmark a fixed checkpoint. That flexibility comes with engineering work: data curation, training infrastructure, regression tests, model packaging and rollback procedures.
A hosted closed model is often faster to integrate. You call a stable interface, receive provider-managed capacity and can adopt improvements without rebuilding the serving stack. The trade-off is less control over hidden updates, tokenizer behavior, routing and model retirement. An application that depends on exact output style or calibrated scores should pin versions where possible and maintain a test suite for every upgrade.
Evaluate the workload, not the label
- Define success in business terms: correct classifications, resolved support cases, accepted code changes or another measurable outcome.
- Create a representative, permissioned test set that includes difficult languages, long context, ambiguous requests and known safety cases.
- Measure quality, latency, availability, refusal behavior, cost per successful task and human-review rate.
- Test under realistic concurrency and peak loads; a model that is accurate on a laptop may not meet production latency targets.
- Repeat the evaluation after fine-tuning, quantization, provider updates or prompt changes.
Do not infer parity from model names or parameter counts. The available evidence does not establish a universal benchmark winner, price advantage or break-even point between the two paths.
Total cost: license price is only one line
Self-hosting begins with hardware or rented GPU capacity. Add storage for weights and datasets, network egress, power, cooling, orchestration, observability, security hardening, backups, redundancy and staff time. Fine-tuning adds data preparation, experiment tracking and evaluation. Upgrades can require parallel capacity while the new version is validated.

Managed services convert much of that work into usage, subscription or capacity charges. They may be more efficient for intermittent traffic because you pay for consumption instead of keeping hardware ready. A self-managed deployment may be cheaper for sustained, predictable utilization or strict data-locality requirements. OpenAI’s gpt-oss documentation makes the same conditional point: costs vary, self-hosting can be cheaper in some cases, and an API can be more efficient when hosting, maintenance and upgrades are counted.
A practical cost model
- Demand: requests per day, input and output tokens, concurrency and peak-to-average ratio.
- Capacity: accelerator type, memory, replicas, failover and expected utilization.
- Operations: deployment, patching, monitoring, on-call coverage, security reviews and incident response.
- Quality: human review, retries, rejected outputs and downstream correction costs.
- Exit: migration engineering, data export and parallel operation during a provider or model change.
Compare total cost per successful task over the same period and service-level target. Avoid claiming a universal “open is cheaper” or “API is cheaper” rule.

Open releases can make external evaluation easier because researchers can inspect behavior under controlled conditions and reproduce tests on a fixed checkpoint. Local deployment can reduce exposure of sensitive prompts. However, anyone who obtains the weights may modify or remove safeguards. A safe base model does not guarantee a safe fine-tune, retrieval layer or user interface.
Managed providers can maintain centralized abuse controls, patch infrastructure and respond to incidents across customers. You still depend on their security, uptime, moderation choices and update schedule. Your application remains responsible for authorization, input validation, output handling, audit trails and human escalation.

What the EU AI Act nuance means
The European Commission AI Act Service Desk describes a narrow provider-side exemption for some general-purpose AI models released under qualifying free and open-source terms. The conditions include permission to access, use, modify and distribute without monetisation; public availability of weights, architecture and usage information; and no systemic-risk classification.
Even when those conditions are met, copyright-policy and training-data-summary duties remain. The exemption does not automatically cover every open model, downstream business, deployer or AI system, and systemic-risk models are excluded. Determine your role, model classification, intended use and affected jurisdictions with qualified counsel, then verify the current legal text and dates before deployment.
Example: what self-managing gpt-oss entails
OpenAI describes gpt-oss weights as downloadable under Apache 2.0 and its usage policy. The weights are not served through OpenAI’s API or ChatGPT. The documentation says operators manage deployment themselves and pay for compute, storage and hosting; it also says there is no hands-on support for self-hosted or third-party-hosted setups.
What’s actually slowing this PC down?
Pick the symptom - the matching free tool is one click away.
For one specific 120B gpt-oss-safeguard model, the documentation gives a single 80 GB GPU as a fit example and names an NVIDIA H100. That is a model-specific hardware illustration, not a universal requirement for every gpt-oss configuration or other open-weight model. The example demonstrates the operational question you must answer: who supplies the accelerator, runtime, monitoring, patching and support when the model is not hosted for you?
Decision checklist for a real project
- Classify the data. Mark personal, confidential, regulated and export-controlled data. Decide whether any category may leave your environment.
- Define the workload. Record quality thresholds, languages, context length, peak concurrency, latency target, availability objective and human-review requirements.
- Shortlist exact releases. Capture model version, checkpoint, tokenizer, runtime, license, acceptable-use policy and deprecation terms.
- Map the data flow. Draw prompts, outputs, logs, backups, telemetry, subprocessors and administrator access for each candidate.
- Run a representative evaluation. Compare quality, failure modes, latency, utilization and cost per successful task, not headline benchmarks.
- Price operations. Include hardware or API charges, storage, networking, engineering, security, support, redundancy, upgrades and exit work.
- Assign ownership. Name who patches the runtime, reviews model changes, handles abuse reports, rotates credentials and leads incidents.
- Plan continuity. Test rollback, provider outage procedures, model replacement, weight or prompt export and a migration path.
- Complete legal review. Check intellectual-property rights, privacy, sector rules, provider/deployer roles and current AI regulations.
- Set a review date. Reassess when traffic, data sensitivity, model version, law or provider terms change.
Which path fits common situations?
Choose a managed closed model when
- You need to launch quickly and do not have a team for GPU operations and model serving.
- Traffic is variable enough that owning or reserving capacity would leave hardware idle.
- The provider’s contract, region controls and retention settings satisfy your data requirements.
- You can tolerate provider versioning and have tests that detect quality or behavior changes.
Choose open weights with self-management when
- Data locality, offline operation or network isolation is a hard requirement.
- You need to inspect, fine-tune or quantize the model beyond a hosted interface’s controls.
- You have the staff and budget to operate secure, observable inference and maintain the model over time.
- You can accept responsibility for evaluating modified safeguards and downstream misuse.
Use a hybrid architecture when
- Highly sensitive tasks must remain local while general workloads can use a managed endpoint.
- You need a local fallback for outages but prefer hosted capacity for normal peaks.
- Different business units have different latency, control and compliance requirements.
A hybrid design still needs explicit routing rules, consistent audit records and separate evaluations. It is not a way to avoid licensing, security or legal analysis.
Bottom line
Pick the deployment model that matches your actual constraints, not the most attractive label. Open-source AI can mean deep transparency, but open weights alone provide a narrower promise and shift infrastructure and accountability to you. Closed models can deliver faster integration and managed operations, but you accept provider dependence and must verify data handling, version control and exit options. A defensible choice comes from a workload evaluation, a full cost model, a documented data path, a license review and an assigned operations owner.
