GST and TDS are different taxes. For online gaming in India, GST is a 28% indirect tax on the gaming supply, effective from 1 October 2023. The platform accounts for that supply, and the cost may be built into an entry fee or other price. TDS is income-tax withholding on a player’s net winnings: section 194BA applies a 30% rate when a withdrawal occurs and again on remaining net winnings at the end of the financial year.
That means a 30% deduction from a withdrawal is not GST. It is normally TDS against taxable online-game winnings. Deposits, gross wallet credits and every individual game result are not automatically taxed at 30%; net winnings are determined under Rule 133 of the Income-tax Rules, 1962.

GST and TDS answer different questions
The easiest way to avoid confusion is to ask what the charge is taxing:
Quick wins for a faster PC:
Fix the driver behind crashes, sound loss and screen glitchesFind Drivers →Clear out junk files and repair common Windows errorsFree Scan →- GST: the supply of online gaming by the supplier.
- TDS: income treated as the player’s net winnings from online gaming.
GST is an indirect tax. The gaming supplier is responsible for accounting for it, although the economic cost can be reflected in the amount a player pays. TDS is a withholding mechanism under the Income-tax Act. The platform deducts it from an amount otherwise available to the player and reports the deduction for income-tax purposes.

The GST Council clarified a 28% rate for actionable claims supplied in online gaming. A Press Information Bureau release dated 26 March 2025 states that the online-gaming GST change was introduced from 1 October 2023. The Income Tax Department’s current TDS-rate table lists 30% under section 194BA; that provision took effect on 1 April 2023.
GST on online gaming: what is taxed and how players see it
The 28% rate and its effective date
For online gaming covered by the clarified framework, GST is 28% from 1 October 2023. This is a rate on the taxable gaming supply, not a 28% income-tax deduction from a player’s winnings.
The government material establishes the rate and start date, but it does not establish one universal wallet or checkout design that every platform must use. One service might show a tax component on an invoice; another might incorporate the cost into an entry price or other charge. A player should therefore rely on the platform’s current tax invoice, wallet ledger and terms rather than assume that a displayed balance is GST-inclusive or GST-exclusive.
Deposit, entry amount and withdrawal are not interchangeable
A deposit is money moved into a gaming wallet. An entry amount or other consideration can be part of the gaming supply. A withdrawal is money moved out of the wallet. Those labels describe different transactions, and a withdrawal is not automatically a GST base merely because it follows a game.
Whether GST is separately displayed, embedded in pricing or described in another way depends on the supplier’s invoicing and accounting treatment. If the amount matters for reconciling a balance, download the invoice or statement and identify:
- the amount charged to enter or participate;
- any GST line or tax-inclusive notation;
- the date and description of the supply;
- the amount credited as winnings; and
- any separate withdrawal, processing or other charge.
Do not use a platform’s GST presentation to estimate your TDS. GST and TDS use different legal bases.

TDS under section 194BA: the 30% withholding
What section 194BA says
Section 194BA applies where a person responsible for paying online-game winnings pays income to a player. The statutory wording requires the payer to “deduct income-tax on the net winnings in his user account.” The Income Tax Department’s TDS table gives the rate as 30%.
This is why a withdrawal can show a deduction of 30%. It is withholding of income tax, not a second GST charge. The deduction is connected to net winnings calculated under the prescribed rules, not simply to every rupee deposited or every gross credit appearing in a wallet.
It applies to an “online game” as defined in the provision
The cited provisions use a definition covering an internet-accessible online game. They do not create separate 194BA or 115BBJ rates for games described as skill-based versus chance-based. On the information available in these provisions, the statutory rate is the same for both categories when the activity falls within the online-game rules.

How “net winnings” are determined
Rule 133 is the governing calculation rule
A Ministry of Electronics and Information Technology answer to Lok Sabha Starred Question No. 196, dated 2 August 2023, states that the Central Government prescribed Rule 133 in the Income-tax Rules, 1962 and that the rule lays down the formula for calculating net winnings. The same answer explains that net winnings are calculated after aggregating winnings, including losses, during the year.
That instruction matters because a wallet can contain several kinds of entries at once: deposits, contest or game entries, refunds, winnings, losses and withdrawals. A gross-credit approach would treat every positive credit as taxable and ignore the year’s offsetting game results. Section 194BA does not describe that approach; it refers to net winnings in the user account.

What “including losses during the year” means in practice
For a calendar of play, preserve the complete financial-year ledger rather than checking only the last game or the last withdrawal. The relevant record should let you reconcile:

- deposits and other funds added by you;
- game or contest amounts used;
- winnings credited;
- losses recorded in the year’s activity;
- withdrawals and their dates; and
- TDS already deducted.
The platform’s statement should be read alongside Rule 133 and your own bank records. If the statement calls a deposit a “winnings” credit, ask the platform to explain the ledger classification instead of assuming that the label determines the tax result.
Losses are not a licence to ignore TDS
Losses are relevant to the year’s net-winnings calculation, but that does not mean a player can simply subtract any preferred number from a withdrawal. The statutory calculation and the platform’s account records control. Keep evidence of losses and ask for a corrected statement if the ledger does not reconcile with the activity shown.
When TDS is deducted
Withdrawal during the financial year
When you withdraw during the financial year, section 194BA requires deduction on the net winnings associated with that withdrawal, using the Rule 133 calculation. The deduction can therefore appear at the moment money leaves the user account rather than when a game result first credits the wallet.
Do these 3 things before closing this tab:
1Fix the driver behind crashes, sound loss and screen glitches2Clear out junk files and repair common Windows errors3Scan for outdated or missing drivers - takes under a minuteA 30% line on a withdrawal statement should be checked against the stated net-winnings amount. If the statement shows only a single “tax” figure, request the underlying calculation and the financial-year period used.
No withdrawal before year-end
Waiting to withdraw does not necessarily defer TDS indefinitely. The provision also requires deduction on remaining net winnings in the user account at the end of the financial year. Consequently, a player who makes no withdrawal can still see a year-end deduction or an adjustment to the wallet balance.
Several withdrawals in one year
Each withdrawal should be reconciled with the cumulative financial-year ledger and TDS already deducted. Do not add the 30% rate repeatedly to the full amount of every withdrawal without checking whether earlier withdrawals and losses have already been included in the net-winnings calculation.

Financial year versus assessment year
The withholding provision became effective on 1 April 2023. The final special tax-rate provision, section 115BBJ, applies for assessment year 2024-25 onward. A platform statement may identify a financial year, while your income-tax return uses the corresponding assessment year. Keep both labels when saving statements and certificates.

Illustrative example only: assume a platform’s Rule 133 statement for a particular withdrawal says that the withdrawal contains ₹20,000 of net winnings. At 30%, the TDS amount shown would be ₹6,000, leaving ₹14,000 of that component after withholding. The platform’s GST treatment of game entries is a separate matter and is not calculated by taking 28% of the ₹6,000 TDS figure.
Now assume the financial-year statement later identifies ₹10,000 of remaining net winnings in the user account at year-end, after accounting for the year’s activity and prior deductions. A further 30% withholding on that remaining amount would be ₹3,000. These numbers are purely illustrative; the actual net-winnings amount must come from the statutory calculation and the platform’s financial-year ledger.
The example demonstrates two points: TDS follows net winnings rather than a deposit amount, and the withholding event can occur both at withdrawal and at year-end.
What happens at final tax time
Section 194BA is the withholding mechanism. Section 115BBJ provides a separate 30% special income-tax rate on online-game net winnings for assessment year 2024-25 onward. The two provisions explain why the number on a TDS statement and the special rate applied to online-game net winnings are both 30%, while serving different functions.
Withholding is not a substitute for reviewing your return. Match the platform’s TDS information, account statements and bank credits to the financial year and assessment year used in your income-tax records. If figures disagree, obtain a corrected statement or professional advice before filing; do not assume that a wallet balance alone proves the final tax position.

A practical reconciliation checklist for players
- Identify the period. Mark the financial year covered by every wallet export, withdrawal statement and TDS document.
- Separate transaction types. Keep deposits, game entries, winnings, losses, withdrawals and taxes in different columns or ledger categories.
- Find the net-winnings figure. Look for the platform’s Rule 133 calculation or a statement that explains how it was derived.
- Check the 30% arithmetic. Compare the TDS amount with the stated net-winnings base, allowing for rounding or presentation conventions shown by the platform.
- Check year-end treatment. If you had remaining net winnings at the end of the financial year, look for the required deduction even if there was no withdrawal.
- Verify the GST record separately. Use the invoice or supply ledger to determine whether GST was shown separately or embedded in the price.
- Save evidence. Retain downloadable statements, invoices, withdrawal confirmations, bank entries and communications with the platform.
Common mistakes and how to correct them
Mistake: treating GST and TDS as two deductions from the same base
Correct the ledger by placing GST-related supply entries and TDS-related withholding entries in separate columns. GST concerns the supplier’s taxable supply; TDS concerns the player’s net winnings.
Mistake: calculating 30% of every deposit
A deposit is not automatically net winnings. Ask for the Rule 133 calculation and reconcile it with the year’s winnings and losses.
Mistake: calculating 30% of every gross credit
Gross credits can include entries that are not the year’s net winnings. Use the financial-year aggregate and the platform’s underlying ledger.
Mistake: assuming no withdrawal means no TDS
The law also addresses remaining net winnings at financial year-end. Check the year-end statement.
Mistake: assuming a “skill” label removes the tax
The cited statutory provisions do not establish a separate lower rate for skill-based games. Determine whether the activity falls within the defined online-game provisions, then apply the relevant statement and tax rules.
Mistake: treating a wallet display as a tax invoice
A balance screen may omit GST details or combine several transaction types. Download the formal invoice and ledger, and ask the supplier to explain unexplained labels or adjustments.
Regulatory context is separate from the tax calculation
Government blocking directions are a regulatory-enforcement issue, not a formula for GST or TDS. A MeitY and Press Information Bureau update reported 1,410 blocking directions relating to online betting, gambling and gaming websites between 2022 and February 2025. That figure does not change the 28% GST rate, the 30% section 194BA withholding rate or the Rule 133 calculation.
What to ask the platform when the numbers do not match
- Which financial year does this statement cover?
- What amount did you treat as net winnings under Rule 133?
- How were the year’s losses included?
- Which withdrawal triggered this TDS deduction?
- Was a separate year-end deduction made on remaining net winnings?
- Where is GST shown for the relevant gaming supply, and is the displayed price tax-inclusive?
- Does the TDS information match the document used for my income-tax records?
Ask for a transaction-level export when the answer cannot be verified from a summary wallet screen. If the platform cannot reconcile its statement, consult a qualified Indian tax professional with the ledger, bank records and TDS documents.
