The October 1, 2026 order in United States v. Kyle granted Melisa Kyle’s motion to suppress evidence. It is a district court decision in one criminal case—not a nationwide ban on license-plate readers.
What happened in United States v. Kyle?
In United States v. Kyle, No. 4:26-cr-00189, U.S. District Judge Sara E. Hill of the Northern District of Oklahoma considered a Tulsa County deputy’s use of historical automated license-plate reader (ALPR) records. Deputy Freddie Alaniz queried systems that included Flock and VehicleManager for a vehicle with California plates. The court examined whether the deputy had grounds to stop Kyle, whether the traffic stop was unlawfully extended, and whether the retrospective ALPR query itself was a search under the Fourth Amendment. Judge Hill concluded that the historical query was a search, conducted without a warrant and unsupported by probable cause, and granted the suppression motion. The opinion states: “Alaniz’s use of the ALPR Systems was an Unconstitutional Warrantless Search.” [Opinion and Order, Oct. 1, 2026]
Why did the court distinguish a plate read from a month of tracking?
A camera recording a plate at one place and time captures a limited observation on a public road. A query that gathers many such observations into a retrospective location history can reveal a much broader picture of a person’s movements. Judge Hill treated the query in this case as a search of the whole of a person’s movements, rather than as an isolated observation of a car in public. [Court opinion]

In contemporary reporting on the decision, Hill described the practice as “a type of indiscriminate mass surveillance.” That phrase reflects her opinion in this case; it should not be read as a consensus statement by all courts. [Carscoops report]
Did a judge rule Flock unconstitutional?
No. The order did not declare Flock, VehicleManager, or all ALPR technology unconstitutional. It addressed the deputy’s historical query under the circumstances before the court: records from multiple systems, more than 50 sightings, roughly a month of locations, no warrant, and no probable cause. The ruling is about that search and the evidence in Kyle’s criminal case, not every use of a plate-reading camera. [Court opinion]

Does the ruling apply nationwide?
No. Judge Hill sits on the U.S. District Court for the Northern District of Oklahoma. This is a district court order in one criminal case, not a Federal Circuit ruling or a nationwide injunction. It does not bind courts across the country, and it does not itself prohibit police departments elsewhere from using ALPR systems.
