Her attorney says the surgeon had marked the right leg—and that the mark was still there after the left leg was removed. The account comes from a lawsuit and statements reported by The Guardian and WHIO; the allegations have not been established by a court.
What Jacks says happened
According to The Guardian’s account of the complaint, Jacks consented to surgery involving her right lower extremity, not removal of her left leg. The planned right-leg amputation was part of her treatment for squamous cell carcinoma. The complaint alleges that the hospital removed the left leg instead during the September 2025 operation.
The Guardian reported that Jacks later had her right leg amputated at another Ohio hospital, four months after the first operation. The reporting therefore describes her as having lost both legs, but the circumstances alleged in the lawsuit remain claims rather than court findings.
What her attorney says about the surgical checks
The complaint reportedly alleges that two surgical “time-outs” occurred before the operation. Such pauses are intended to confirm the patient, procedure and surgical site. The complaint says the team proceeded on the wrong leg despite those checks.

Jacks’s attorney, Brad Layne, told WHIO: “The surgeon actually marked the correct leg pre-surgery. The mark was still on the correct leg after the wrong leg had been taken off.” Layne also told the station: “She went into surgery, and when she woke up, the wrong leg had been taken off. Yeah, it defies explanation, obviously.” These are the attorney’s descriptions of the event, not findings independently established in the reviewed reporting.
How the hospital responded
In a statement carried by WHIO, Selby General Hospital said: “Our proactive review of what took place confirmed this was an avoidable event and that our expected operating room procedures were not followed.” The hospital also said: “Those involved were held accountable for their actions and are no longer in their positions.”

The hospital said it cooperated with a review by the Ohio Department of Health, which it described as confirming that its surgical protocols were safe and effective. It said corrective measures included mandatory retraining of surgical employees and additional requirements. The underlying state review is not included in the reporting reviewed here, so those conclusions and actions are presented as the hospital described them.
The reported effect on Jacks and her family
WTAP quoted Layne describing the daily practical challenges of double amputation, including transfers, dressing and the need for care at home. He said Jacks’s husband left his job to care for her. That account comes from her attorney.

What the lawsuit seeks—and what remains unknown
The Guardian reported that Jacks and her husband named nine defendants, including the hospital and members of the medical and surgical teams. The complaint alleges gross negligence, battery and reckless conduct, and seeks compensatory and punitive damages. Those are allegations and requests for relief, not findings that the defendants are liable or that damages have been awarded.
The lawsuit was reported filed in Washington County, Ohio, in September 2026. The sources reviewed do not establish its subsequent procedural status; they report no verdict, settlement or later court outcome.
