Norway’s ethics rules vs ESG investing screens: what’s the difference?

Norway’s ethics rules and ESG screens are different systems. The rules governing Norway’s Government Pension Fund Global (GPFG) are a public mandate issued through the Ministry of Finance. They set specific product and conduct criteria that can lead to observation, exclusion or ownership follow-up. An ESG screen is a method chosen by an asset owner, fund manager, index provider or client. It may exclude activities, select stronger companies relative to peers, or incorporate financially material environmental, social and governance issues into investment decisions.

The approaches can overlap—for example, both may address coal, weapons or severe human-rights controversies—but an ESG label does not mean a portfolio follows Norway’s criteria. The only reliable way to assess a fund is to read its methodology, thresholds, holdings and engagement policy.

What Norway’s ethics framework is

The GPFG has been subject to observation and exclusion guidelines since 2004. Their stated purpose is to avoid investments in companies that cause or contribute to serious violations of fundamental ethical norms. This is a mandate for one sovereign wealth fund, not a definition that applies to every Norwegian investor or to ESG investing worldwide.

The Ministry of Finance sets the state governance framework. The Council on Ethics is an independent body that evaluates or monitors companies and provides recommendations or information under that framework. Norges Bank makes investment and ownership decisions within the mandate, subject to the temporary arrangements introduced after the former guidelines were repealed in November 2025.

Product-based criteria

Some activities can make a company ineligible because of what it produces or sells. The Ministry identifies tobacco, cannabis, certain weapons and coal among products that may be unacceptable under the framework. The wording matters: the rules do not automatically cover every company with any connection to a broad sector. Eligibility depends on whether the relevant Norwegian criterion is met.

Conduct-based criteria

Other criteria concern how a company operates. They include serious human-rights violations; weapons-related violations of international humanitarian law; corruption; severe environmental damage; unacceptable greenhouse-gas emissions; and other particularly serious ethical violations. These are high-threshold standards aimed at severe conduct, rather than a general score for how sustainable a company appears.

Depending on the applicable process, a company may be placed under observation, excluded from investment or addressed through ownership activity. Observation is not the same as an immediate ban: it allows conduct to be monitored under the framework. Ownership follow-up uses the investor relationship to seek change rather than automatically selling.

What an ESG screen means

“ESG screen” describes a family of methods, not one universal rulebook. The Principles for Responsible Investment (PRI) distinguishes several common approaches.

Negative or exclusionary screening

Negative screening deliberately excludes issuers, investments, sectors or activities because they violate stated norms or values, or because the investor anticipates unacceptable risks. A policy might exclude tobacco, controversial weapons, thermal coal or companies breaching a specified human-rights standard. The policy owner chooses the definitions, data source and cut-off.

Two funds can both advertise exclusionary ESG investing while reaching different results. One may exclude a company when any revenue comes from a prohibited activity; another may apply a 5% or 10% revenue threshold. Some policies measure an issuer’s consolidated revenue, while others examine subsidiaries, business segments or estimated exposure. The fund’s written methodology is therefore more informative than the label.

Positive or best-in-class screening

Positive, or best-in-class, screening applies filters to include issuers with stronger ESG performance relative to industry peers or against specified environmental, social or governance criteria. It does not necessarily eliminate an entire sector. A fund can retain energy, mining, chemicals or defense companies while selecting those it rates as leaders within their peer groups.

Relative selection also means that a company can qualify even when its absolute impact is material. A lower-emitting producer may rank ahead of other producers without meeting a zero-emissions standard. Investors who want an activity ban must look for explicit exclusion language rather than assume that a high ESG score removes the activity.

ESG integration

PRI defines ESG integration as “the explicit and systematic inclusion of ESG issues in investment analysis and investment decisions.” Integration usually changes financial analysis—such as forecasts, valuation, credit assessment, position size or risk limits—rather than creating an automatic prohibited list.

An integrated strategy may still hold companies in controversial industries if the manager believes the relevant ESG risks are priced, manageable or improving. Engagement and voting can be part of the process. A portfolio can therefore have a broad investable universe while giving climate, labor, governance or regulatory risks a formal place in decisions.

Other combinations

Funds commonly combine methods. A policy might exclude companies above a revenue threshold, select best-in-class holdings among the rest, and use engagement for companies that remain investable. The terms “norms-based,” “thematic,” “sustainable” and “responsible” can describe additional filters, but none has a single global implementation. Read the binding index rules or prospectus, not only the marketing summary.

Rule design Defined product criteria and high-threshold conduct criteria Negative, positive/best-in-class, norms-based, thematic or integrated approaches, often combined
Sector treatment A sector or activity can be barred when a Norwegian criterion is met A sector may be excluded, retained with selected leaders, or assessed through financial analysis and engagement
Decision process Public institutional roles involving the Ministry, Council on Ethics and Norges Bank Varies by fund; details depend on its prospectus, index rules, data provider and engagement policy
Current status Interim ethical guidelines apply while the framework is reviewed after a request from Norway’s Storting No single global ESG rulebook; definitions, thresholds and implementation vary by provider

Does Norway’s oil fund use ESG screening?

The GPFG uses an ethics framework that includes product and conduct restrictions, but describing it simply as “an ESG screen” loses the institutional distinction. Its criteria are established in a government mandate and are applied through named public bodies. The framework’s objective is to avoid specified serious ethical violations; it is not a general ranking of every holding’s ESG quality.

Norges Bank also has investment and ownership responsibilities under its mandate. Those activities can involve assessing sustainability risks and engaging with companies, but ownership work should not be confused with an automatic exclusion rule. A company can be subject to monitoring or dialogue without being removed from the portfolio.

The Ministry’s current ethical-guidelines information, updated 2 March 2026, describes interim arrangements following the repeal of the former guidelines. Any account of the GPFG process should therefore identify whether it is describing the pre-November 2025 system or the current interim period.

Can an ESG fund still invest in oil, weapons or tobacco?

Yes, depending on its method. An ESG label alone does not answer the question.

  • Absolute exclusion: A fund may prohibit an activity or companies above a stated revenue, ownership or controversy threshold. The exact definition can differ between funds.
  • Best-in-class selection: The fund may keep companies from a controversial sector and choose those with stronger peer-relative ESG scores.
  • ESG integration: The manager may retain a company while adjusting valuation, risk limits, position size or engagement in response to ESG factors.
  • Combined policies: A fund may exclude some activities, retain other sectors, and use voting or engagement for holdings that remain eligible.

Norway’s rules provide a specific public benchmark for the GPFG, but they do not turn every ESG fund’s policy into a Norwegian-style prohibition. To know whether a particular fund can hold oil, weapons or tobacco, check the prohibited-activity definitions, revenue thresholds, controversy rules and latest holdings.

What changed on 7 November 2025?

The Council on Ethics’ 2025 annual report records that the former Guidelines for Observation and Exclusion were repealed on 7 November 2025. The Ministry of Finance says interim ethical guidelines now apply while the framework is reviewed following a request from the Storting.

What remains during the interim period

The Council on Ethics continues monitoring companies and informing Norges Bank about companies that may be relevant for ownership activity. Under the interim arrangement, the Council does not make ordinary observation or exclusion recommendations, and Norges Bank does not make those decisions under the former process.

This is a change in procedure, not proof that the underlying ethical questions disappeared. It means that older explainers describing a routine Council recommendation followed by a Norges Bank observation or exclusion decision do not fully describe the arrangement in force after 7 November 2025.

How to date an explanation

When reading a fund description, policy paper or news article, check its publication date and the version of the guidelines it cites. Statements about a company’s historical exclusion may refer to a decision made before the repeal. Statements about current monitoring or ownership activity should be read against the interim rules and the Ministry’s latest guidance.

How to examine an ESG-labelled fund

Use the following questions before treating an ESG claim as equivalent to Norway’s ethics rules.

  1. Identify the method. Is the fund using absolute exclusion, negative screening, positive or best-in-class selection, ESG integration, thematic investing, engagement, or a combination?
  2. Find the trigger. What revenue, activity, controversy, emissions or ESG-score threshold causes a security to be excluded or downgraded? Note whether the threshold is a percentage, a qualitative judgment or a third-party rating.
  3. Check the level of measurement. Does the policy assess the listed issuer, a parent group, subsidiaries, joint ventures or individual business lines? Is exposure measured by reported revenue, production, ownership or another estimate?
  4. Read the treatment of controversies. Determine whether a severe incident causes immediate divestment, a watch list, a remediation period, a score reduction or engagement. “Engagement” is not the same outcome as “exclusion.”
  5. Inspect the data and methodology. Which provider supplies ESG scores or controversy data? How are missing, delayed or disputed data handled? When was the methodology last changed?
  6. Review voting and engagement. Does the manager use shareholder votes, direct dialogue, escalation or collaborative initiatives instead of—or alongside—selling? Look for escalation steps and reporting, not just a promise to engage.
  7. Compare the holdings. Read the latest portfolio and identify whether sectors you expected to be banned are present. A holding does not automatically prove a policy breach: it may fall below a threshold, be held through a subsidiary classification or reflect a lag between rebalancing dates.
  8. Check rebalancing frequency. Screens may be reviewed monthly, quarterly, annually or after a data event. A portfolio can temporarily contain a security that no longer qualifies or exclude one that has newly crossed a threshold.
  9. Separate index rules from fund discretion. An index may define eligibility while the fund applies tracking, sampling or transition rules. The prospectus and index methodology together explain what the manager is required to do.

Common misunderstandings and how to avoid them

“Ethical” and “ESG” are interchangeable

They are not. Norway’s framework is a public ethical mandate for a named fund. ESG is a broad investment vocabulary covering values-based exclusions, peer-relative selection and financial integration. A fund can use ESG analysis without adopting Norway’s ethical criteria, and the GPFG’s rules should not be presented as a universal ESG standard.

Every ESG fund has the same banned industries

There is no single global list. One policy may prohibit tobacco and controversial weapons; another may focus on thermal coal; a third may impose no sector bans and rely on integration. Even funds with the same headline exclusion can differ in revenue cut-offs, corporate-structure rules and controversy treatment.

A high ESG score proves ethical compliance

Scores are methodology-dependent and often relative to an industry. A company can rank well among peers while operating in a sector that another investor excludes outright. Scores also depend on disclosure, estimation and the treatment of missing information.

Ownership activity means a company is excluded

Engagement, voting and observation keep an investment relationship in place while the investor seeks information or change. Exclusion removes the company from the eligible portfolio. They are distinct tools and should be reported separately.

Older descriptions of Norway’s process are current

The former observation-and-exclusion process ended when the guidelines were repealed on 7 November 2025. During the review, the interim framework changes the Council’s recommendation role and Norges Bank’s decision process. Always verify the date and governing document.

A practical decision framework for readers

If your priority is avoiding a particular activity, start with a negative-screen policy and verify its threshold. If you want companies that perform better than peers while remaining invested across an industry, investigate best-in-class methodology and its sector-relative scores. If your priority is risk-adjusted returns and active stewardship, examine ESG integration, voting records and engagement escalation.

For a Norway-specific comparison, map the fund’s rules against the GPFG criteria one by one: tobacco, cannabis, specified weapons, coal, serious human-rights violations, weapons-related humanitarian-law violations, corruption, severe environmental damage, unacceptable greenhouse-gas emissions and other particularly serious ethical violations. Record whether each item is an exclusion, an observation or an engagement matter under the fund’s own documents. Do not infer equivalence from a similar-sounding label.

What to document before investing

  • The fund’s legal name, domicile and prospectus version.
  • The responsible index provider or manager and the date of its methodology.
  • Each excluded activity and the numerical or qualitative threshold.
  • Rules for subsidiaries, joint ventures, bonds and derivatives.
  • How controversies, missing data and appeals are handled.
  • The rebalancing schedule and any transition period.
  • Current holdings, voting records and engagement reports.
  • Whether the fund’s objective is values alignment, financial-risk management, peer-relative selection or a combination.

That record lets you compare a fund with the GPFG’s public criteria without claiming that the two systems are identical. It also gives you a way to reassess the fund when its methodology, data provider or holdings change.
